pretty sleepy. >> there are a few cars going more going out of town. >> or out of san francisco in are and then the other way at this hour. 9, 0, one. and happening today, former mma star cain velasquez will be back in court for a hearing. his charge with trying to kill a man accused of molesting one of his family members. kron four's camila barco is live in santa clara county with an update coming >> dari. the case continues for the mma fighter right now. cain velasquez hearing is taking place here at the santa clara county courthouse in today. a judge will heal cool here. arguments over motions made by the attorneys this case? well, it started back in late february. this is when prosecutors say that cain velasquez tried killing harry the large. he is accused of molesting a 4 year-old child who is related 2 velasquez now blazquez allegedly chased or take along highway one. 0, one and attempted to sh ot him. however, he ended up hurting

another man. blazquez has been denied bail. but this morning he is back in court. his supporters have been showing up here at the courthouse and believe he has been wrongfully accused. however, prosecutors, they don't think so. as far as the goes, well, he remains out of custody as he waits for his trial to start. he's being charged with lewd acts with a minor child. he has pleaded not guilty in that case, but are as far as the last kuz goes, he has yet to enter a plea. he is facing attempted murder charges and if convicted, he could be sent to jail for 20 years. and like i said, daria, the hearing is now taking place here at the santa clara county courthouse. we have our own chuck clifford inside right now as this hearing is going on. and of course, we'll have more info as we get them. but for now, send it back to you. all right. thanks a lot, camilla, 9, 0, 3. and we're following breaking news out of oakland to a fire on edgewater drive broke out earlier this morning. and you can see the

flames shooting up from the top of the building there. >> from this video that we got, this is near the oakland airport and it's a commercial business. that's all we know in the past firefighters got a handle on this fire. most of the flames are out. this was it at its peak. no word on any injuries. and ill. also in the east bay, former richmond police officers going to be arraigned on felony assault charges today. >> eric smith junior is accused of beating and tasing a man during a traffic stop in april and this is video of this. you can see what's happening there. smith says that he pulled over solemn mendoza junior because he suspected him of drunk driving and the situation escalated when mendoza tried to run away and in the end, the department ended up firing smith for using excessive force during that arrests. the biden administration's move to declare monkeypox a national public health emergency is supposed to boost the country's response to the out to break. the u.s. has 7,100

confirmed cases. and we know california is the second worst in the country. jessi turnure has an update from d c. good will free up money and other resources to help control the virus at a time when many states are having trouble keeping up with demand for vaccines. >> we're working hard to contain it while the u.s. remains under a public health emergency for covid-19, the biden administration declared another one thursday for a different virus. monkeypox. it is really i think the real time dimitri daskalakis is helping lead the national response to monkeypox, which has now infected more than 7,000 americans. the most important thing is to let people who have the knowledge and how about box transmit. the virus spreads through skin to skin contact and sharing bedding towels and clothing. patients have been primarily men who have with men. but health officials stress the virus can infect anyone could clear messaging to people about how to prevent infection

>> and in california, lawmakers are calling a state to do more to slow because of the slow spread of monkeypox in the slow rollout of vaccine, more than 800 cases have happened in california, which is the second most in the nation behind new york state state senator scott wiener who represents san francisco says the governor took a big step by declaring a state of emergency. but he says more has to be done. he sent the governor a letter calling on him to approve 38 million dollars to help with monkeypox on a local level. >> to support county public health departments which are responsible for expanding testing vaccination and community outreach. we need to make sure the counties but their public health departments have the support that they need. >> senator wiener has been chosen to chair a new monkeypox select committee. the committee is trying to come up with guidelines and resources for the entire state members of the committee are going to have their first meeting next tuesday. and

california and san francisco departments of health are considering using a different smallpox vaccine to treat monkeypox. it's called cam 2000 vaccine and it's a smallpox vaccine that was approved in 2007, 100 million doses have been stored in the strategic national stockpile. the state requested 200 of those shots and we're live working to learn more about the rollout of those doses. and when they might come to the bay area. meantime, on the peninsula, san mateo county, you can get a shot of monkeypox from the county. they don't have any vaccine clinics. the public health department is ex explaining why they are giving out some vaccines to major health care systems in the county, but they are divorting most of their supply. the san francisco because according to county health officials, that is where most of their residents in santa clara county, where they get their health care. but one resident

says they need to do more in his county. >> it seems the county needs to get in front of this and say, hey, we do have more doses. let's give these doses out. and if there's extra, you know what? that's great. invite people from san francisco to come down. san mateo county. >> san mateo county health officials say that they're working on creating a survey on their website, which will connect residents who want the shot with an opportunity to get the vaccine. the san francisco aids foundation is looking for people who could actually give shots for monkeypox. you have the unauthorized untrained administer of vaccines to be able to volunteer. you can contact the organization if you're interested. in the north. bay. solano county reports its first human case of west nile virus health officially the persons from vacaville. and they are currently recovering west nile virus is transmitted to humans and animals through getting bitten by an infected mosquito. so experts advise you to make sure they don't

breed around your house drain any standing water, make sure that your doors and windows have nice. tight fitting screens without the holes because those mosquitoes again and use insect repellent to keep the mosquito i don't even want to see that for biting. you. >> officials say the risk of west nile virus increases in a drought. and we know we're in a drought. slama county is in fact, in an extreme drought. so my gosh, between west nile and monkeypox and covid and you've got to really protect yourself these days. 9.10, right now. breaking news from overnight. one person is arrested after a shooting in the mirage hotel in las vegas. that happened last night. one person was killed mary jane by has the story. >> that's police say they located and have a rest of the shooting suspect all within 6 hours when the shooting first occurred, according to metro police, there was a fight ohat broke out in a hotel room between for people who all knew each other. one person, the real shot, the 3 others that shooter then left the

room. one person has died and that injured shooting victims were then taken to umc hospital. they were listed in critical condition as of this morning, the mirage hotel remained on lockdown during this incident. there's no other disruption to the las vegas strip or any other area right now. we've limited day any kind of traffic closures. initially the response required some, you extra police presence because we're told still trying to figure out exactly what hurt. >> but at this there should be really nothing visible or disruptive to the general public. now, here is what it looked like while inside the mirage of all this was unfolding and hotel guest reported there was a bit of confusion, but the mirage is now back open and guests were allowed to come back to their room after it was blocked off because of the shooting. and investigators say this is an isolated incident and believe there is no threat to the public during this time reporting in las vegas marriage in billions a kron, 4 news. >> it's 9.11, a new this morning. a shocking jobs report came out this morning that shows the u.s. added 528,000 jobs last month, despite rising inflation and

>> nice. thanks to that. we are some good morning you. good morning, everybody. we are dealing with still quite a bit of cloud cover along the east bay shoreline. you can see a little bit the way some sunshine peering its way through. but it's a little slow and sluggish to clear out. however, that's a different pattern that we're looking at off to the east. this is all this monsoon moisture which is now scooting off towards the east. that will happen through today. but we've got another day of rain up in tahoe before things clear out for a nice weekend, by the way, our future cast for we actually fall theses things fall apart later on when the atmosphere has more energy in it because the moisture source is leading. meanwhile, we okay back here in the bay here comes back. our marine layer in the morning hours. typical typical. that clears out by tomorrow afternoon. and we don't see too much activity in the mountains, but a little residual moisture might spark off an isolated showers. 73 at the arc. everybody else is still in the 60's at this latest hour, mid fif mid-sixties rather along the east bay shoreline. 63 for san francisco. we've got morning fog clouds, 70's for the bay

heading into the city or if you're heading up are in in the east bay. oh, sorry. let me let me let me get myself into place here because we're talking about the news now. what's going on in berkeley? we've been talking about this all week where cal wants to build building housing for students and people's park in the struggle over this. well, there was a meeting last night they were talking about the use of tear gas and pepper spray for crowd control. the mayor decided, though, to cancel that talk at the last minute. kron four's theresa stasi explains why. >> it was canceled because i don't believe that we should appeal are. current prohibition on the use of tear gas for crowd control situations. that is berkeley mayor jesse ever again on why thursday's meeting was quashed. that mayor explains the council was considering lifting the ban due to the need for more help. >> managing crowds such as in the case on wednesday as protesters clash with police at uc berkeley's new proposed development at people's park forms by the loudoun county

sheriff's department. that because we have a ban on tear gas that they're not going to sen. >> personnel, it berkeley called joint. and that was concert. and the fact that people's park is in an urban environment >> it is very likely that things could spill over onto city and we do not have enough police to effectively manage the situation. so we're going to need help. the mayor says since then, he has spoken with the alameda county sheriff who promise mutual aid, even with the ban. remember 2014 when there were a series of protests and solid a with the black lives matter movement and our police quite a bit of tear gas. and one night it that just the impact it has public health and indiscriminately at impacting other people. also, i think creates a chilling effect for people engage in first amendment activity. 7 people were arrested during wednesday's protest and the

development project is halted for now. uc berkeley spokesperson says school officials are trying to figure out the next phase need to assess. now we need to think about a different way forward. >> given the indisputable fact that we have some individuals in this community who are willing and able to engage in highly dangerous, violent, unlawful activity. >> as a means of expressing their opposition to a project that's meant to benefit the entire community. >> to recess stasio kron. 4 news. there's a new effort by san francisco city leaders to keep the doors open at laguna honda hospital. 2 lawsuits were filed against health and human services and the center for medicare, medicaid services. the first suit as the for federal funding for the hospital to stay in place. while this whole legal fight is playing out, the federal government is pulling the funding because of multiple health violations at laguna hospital. if the city does not meet the mid september deadline to recertify the hospital, then they're

supposed to lose the funding entirely and have to move everybody out. the second lawsuit asked that patients transfers be stop, which they are at this moment. it's a class action lawsuit filed on behalf of patients. >> we know that laguna honda has challenges. we understand the need to make corrective action. and we've already implemented significant amounts of corrective action based on the recommendations of cms and what we know that we have to do. >> some patients have already been moved to other facilities, but then they put a stop on the transfers. city officials say 9 patients died after being relocated. so they argued it was too dangerous. and now things are on hold for now. >> it's 9.35. and today the outside lands music festival returns to san francisco. >> in golden gate park and in the past, you can see how busy it was. more than 200,000 people are expected to attend the three-day festival. kron

details how investigators tracked this case for more than 4 months. from the night a lexus vanished to the day the man believed to have killed her was shot and killed by police. her ex-boyfriend, marshall jones on january. 26 gas station surveillance video shows a lexus making her way to jones's home in antioch, the forensic download of her car and cell phone data shows she was in the area of his home at 6.37. that night, though, there is no video of her arriving or ever leaving about 2 and a half hours after her car parked jones began a nearly two-hour phone call with his father, though police do not believe the 2 remained on the line with each other or that jones was with the phone the whole time. 4 minutes later, alexa says car turned on and began moving her phone was tracking with it. detective john notes historical data shows a lexus drove a specific way from any act to her home in oakley, with no deviations until this trip. the car parked in oakley

about 12 minutes after leaving antioch. the driver exited the vehicle alone. with the lexus is phone. about 8 minutes later, the phone was turned off the drivers then tracked on surveillance videos walking from oakley to antioch, again, believed to be jones. investigators say when jones got back home before midnight, he wrote a lexus a text message asking if she made it home following an outgoing unanswered phone call the next morning. alexa says mom called jones asking if he saw her the night before he said yes. and later texted saying she left his house at around 9 o'clock. oakley police opened a missing persons investigation less than 4 hours later the next day, january 28th jones gave oakley police consent to search his house except the master and spare bedrooms. he also turned his phone over to police for forensic download less than 2 hours later, detective john states in the letter that jones drove to his

mother's house and unloaded several large, heavy garbage bags into the backyard or garage later that night, gps tracking and surveillance footage puts jones in the area of pioneer in amador county. investigators eventually shared with the public that a handwritten note believed to have been written by jones provided directions on where to dispose of the body on february. first, when police say jones was seen staying at his mother's house with a gun, investigators executed a search warrant of marshall jones's home and found traces of blood later found to have alexa says dna. the shower curtains in jones's bathroom were also missing. the next day, jones flew alone to washington to stay with his father in the ensuing 4 months. antioch and oakley police executed a search warrant that jones's sister's home in vacaville and conducted air and ground searches in pioneer in antioch, alexa says cell phone

case was discovered by a search volunteer which had both alexa says and jones is dna on may 19th jones's mother was arrested for aiding and abetting, but she was released after no charges were filed less than 2 weeks later on june. first, jones was killed by police in washington after they say he lunged at officers with a knife. time to this day. alexis's body has not been. police are convinced she was murdered. phillipe djegal all kron. 4 news. it's 9.52. and a close call for a police officer and oakland. he was almost hit by gunfire. >> while in his car on a stakeout, it was wednesday and the officer was surveilling an armed robbery suspect on martin luther king junior way near macarthur bart station and he was in an unmarked car when 2 people unrelated, the operation started shooting from both sides of the car. you could see that the car got the riddled with bullets, but the officer was not hurt and
