at known a life was lost. that shouldn't if in appropriate action had been taken. >> early. no charges. that is the decision from the contra costa county district attorney in the shooting ddath of tyrell wilson. >> good evening, everybody. thanks for being here tonight for kron. 4 news at 9 o'clock. i'm grant lotus and i'm vicki liviakis. 33 year-old terrell wilson was shot and killed by andrew hall in march of 2021. hall as a former danville police officer, deputy already serving jail time for a separate shooting back in 2018 contra costa county has already had to pay millions of dollars to wilson's family in connection with the shooting. but the family disappointed to learn that hall will not be charged with killing their kron four's. dan thorn spoke with the family's attorney tonight then joins us live from the newsroom with the latest. good evening, dan. good evening, grant vicki. contra costa county district attorney diana becton is. >> officially announcing the news tomorrow. but what we learned to die tonight that

tomorrow morning contra costa county has had to pay more than 9 million dollars to settle civil rights suits filed by the families of wilson and arboleda reporting the newsroom. dan thorn kron, 4 news. thank you, dan. there's been a development in a story we first brought you last night today, the castro valley highway patrol released new images of the white nissan suv. >> that was used in a hit and run where a 6 year-old boy was injured. you see it here. investigators are still looking for the driver. they hope these new images will help the crash happened tuesday on nunes avenue just off castro valley boulevard near 5.80. the child was crossing the road with his mother and suffered severe injuries had to go to the hospital. but as we confirmed yesterday, fortunately, the child was released from the hospital the day after the crash in tonight is said to be doing okay. anybody with more information on this hit and run is asked to contact the castro valley. chp in the south bay, san jose police are seeking the public's help to

find the driver responsible for a hit and run crash involving an elderly woman and a toddler. disturbing video shows the woman pushing a stroller in a crosswalk when they were hit our first recess. stasio has that story in a warning. the an edited video of the crash may be difficult to watch. >> it is incredibly disturbing to see a woman pushing a stroller with a toddler inside struck as they cross the intersection of sierra and mona k elaine and senate say this happened tuesday around 06:00pm. the driver didn't stop. and police now searching for the gray mazda style vehicle similar to this stock photo provided by the senate say police department. >> it's so sad, too. have to talk about a tragedy like this. just statements. roth is with vision, 0. a city agency dedicated to improving public safety on the streets of santa say. >> police say that the woman was admitted to the hospital. fortunately, the toddler wasn't physically injured.

year-old d'angelo. boone are facing arson and mutilation charges, but no murder charge is not yet. both men were arraigned in contra costa county superior court in martinez. the burning body of 25 year-old oakland native micaela sharlman was discovered on october 17th on a trail near gentry town. drive. police believe sharlman was set on fire after she was killed. but the investigation remains open. hundreds of berkeley high school students attended the funeral for 2 teenagers who were killed at a party almost 4 weeks ago. families and friends of 15 year-old jay z and his brother, 17 year-old angel garcia walk to their caskets into the church to say their final goodbyes. both funerals had been delayed due to one autopsy backlog in alameda county, oakland police. they're still looking for 3 suspects who burst inside the home and fired shot on october. 1st, berkeley police have arrested 3 men in

connection to a recent shooting that killed a man and uc berkeley. south campus area. investigators say the shooting happened right after a fight started in the area. >> of duran and telegraph avenues. this is back on october 8, 4 people were shot. police identified and arrested 3 suspects this week. officers say they found a number of guns in the suspects homes, including several ghost guns. you see them here as well as evidence that other ghost guns. we're being made there. >> a man in brentwood is in custody following a monthslong investigation into the accused illegal gun manufacturer. a search warrant served at 23 year-old scott leiper's home reveals that he used 3 d printers to produce firearms. among the items confiscated for evidence, 3 d printers and supplies used to make those guns. 2 semi automatic rifles, 30 round magazines and containers of ammunition leeper was booked into the martinez detention facility. his bail set at $200,000.

a town hall meetings tonight in burlingame. our kron four's gayle on was there and shares the congresswoman's last messages to constituents and what might be next for her. >> congresswoman jackie spear greeting constituents at the community center in burley game thursday through this. you are here and kicking off their well town hall meetings after spending 4 decades in public service. there comes a time i think every career. >> when you have to assess the. the interests of your family and your interest in wanting to continue to pursue your dreams and, you know, they came in recently and i recognize that it was time to come home. representatives spears, a san francisco native and a graduate of mercy high school in burlingame. she decided to dedicate her life to public service after surviving the 1978 jonestown massacre.

into the 30's last night. it was chilly there. now to 37 degrees, half moon bay, but all around the bay area. some cold temperatures to start out your morning. those well below the average for this time of year. 38 in santa rosa. 39 for low and napa. 39 in the bottle. 41 in livermore highs today. yeah. warmed up very nicely. had some numbers popping back up just a few more degrees. mid 70's in the san jose and also conquered 73 degrees in livermore. 72 in santa rosa and 69 in san francisco and oakland. yep, clear skies out there now. but i think as we head the early morning tomorrow, we're going to begin to see a few clouds begin to move in. that will probably keep the temperatures up just a little bit anyway. overnight, sun and clouds throughout your day on friday and cool mild temperatures around the bay area. and then as we get the weekend things changes, we're going to see some partly cloudy skies on saturday. but looks like a warmer sunday around the bay area right now. looks like a dry weekend as we're going to see high pressure trying to sneak back in temperatures outside right now. 46 degrees

in half moon bay. 49 in fairfax. 48 in a bottle. 50 in petaluma and 55 degrees in napa but may have we've got changes coming our way as that cold getting a little bit closer now, high pressure, the kind of get the sense now it's beginning to move just a little further to the east. and as that happens and against weekend, that's going allow some of those mid to high level clouds begin to move in late tonight and tomorrow, too. so we'll see more clouds on the way should be really sunrise and sunset for tomorrow. with some of those clouds up above. overall, though, staying mostly dry. now, that's what it's going to be for a little while. but i think next week looks more promising for some rain now than it has. temperatures for overnight. lows again will be chilly. 30's 40's out there for tonight. this cold front. yeah, it's going to sneak a little bit closer tomorrow. but high pressure just a little too strong cloud to get through here. just yet. the jet stream got a dip a little bit more. so we'll keep things a fairly mild tomorrow around the bay area. yeah, those clouds so certainly in a filter and tonight, maybe some patchy fog and early tomorrow morning, too. and then we'll

see those passing clouds throughout the day and then on saturday to looks like more clouds continue to move through, but stay mostly dry out there. most energy stay well to the north of the bay area. so temperatures tomorrow afternoon should be nice. they are looking a little bit cooler than they were today. put on some low 70's, though inland. you've got a lot of 60's hazy, sunshine around the bay along the coastline are generally in the 50's the next couple days. i think really keep things dry into the weekend. now, halloween looks dry, too. that's maybe the most important one in the forecast after that much colder temperatures and a chance of showers beginning on tuesday. from for your local election headquarters with only 12 days until the election races across the bay area are heating up yesterday. we told you how oakland mayoral candidate lauren taylor and treva reid at formed up an alliance encouraging their supporters to select the other as their second choice. as we have learned a second choice vote can make all the difference in a ranked choice election. a

council and says he expects his first place support to increase as election day nears the cost of buying a home took another leap this week. mortgage rates topping 7% for the first time in more than 2 decades. >> a year ago, the 30 year fixed rate stood at 3.1 4% and now homes are on the market much longer than that. they had been, which could bring in more buyers to look at the property. but with the high interest rates, it could also scare folks off. we spoke with east bay real estate expert david stark. >> people still want to buy homes, particularly in the east bay, but they're definitely tapping the brakes because of home ownership are still going to be pretty high because interest rates are higher. >> no doubt. stark also says the demand for homes in the bay area is outweighing the supply. some homeowners have held off putting their homes on the market because of the interest rates. but for people who have houses on the market, they may need to be patient. stark says the future of the housing market depends on

whether interest rates go up or down. and to what extent sales aren't the only impacted by mortgage rates. rental prices are rising nationally while demand for rental units are at their lowest level since. >> 2009. but in san francisco, the numbers have dropped the rental report for this month's show cities in other parts of the country have overtaken san francisco when it comes to high rent costs. last summer, new york city took the top spot for most expensive rent this month. san francisco dropped to number 3. boston is now in second place. there's also a national shortage of apartments. >> we ran the same question of like how many publications you submit before you sign a lease? and the most popular answer last year was one. and this year, the most popular answer was 5 or more. experts say rental prices drop in the winter when people shift their spending to holidays and to travel. so with your. >> looking around for a deal, you have the few months to find one. good advice there.

san francisco unified school district held a groundbreaking ceremony today to celebrate the beginning of construction on the new mission bay school. beautiful, sunny day for the school include a pre k through 5th grade elementary school learning hub for high school students and a professional learning space for teachers and staff. mayor london breed says she's proud of the progress being made to invest in the city's children. >> we have a school that's going to serve the kids of this community to make sure that the next generation, if the education they need to be prepared. >> for the future. the mission bay school is scheduled to open in august of 2025. for the first time ever, the warriors have been announced as the nba's most valuable team today. forbes says the team is worth 7 billion dollars. the warriors value increased 25% from last year

they need to protect themselves. so we didn't think that we need we are really into their orders anymore. >> member state restrictions remain in place. meaning you still need to wear masks in health care facilities and county health officials still say it's important to be vaccinated and boosted to prepare for a potential winter covid search as we enter the final stretch. this election season. a new poll indicates californians have made up their minds on several of the major ballot measures. our capitol correspondent eytan wallace gives us a look at the results. >> well, all kinds of propositions on the ballot, including a pair of sports betting measures and another that would tax the wealthy to raise funds for electric vehicle programs. but -paccording to a new poll on those measures, california say they're voting with just under 2 weeks until november 8, a new poll shows voters are not in favor of legalizing sports betting in california. of the

1700 plus californians surveyed for the poll from the public policy institute of california or ppi c. >> just 34% said they support prop 26 the ballot measure calls for in person sports betting on tribal lands and select horse racing tracks across the state. that's wagered at the tracks with see a 10% state tax with revenue going toward regulation for gambling, mental health and sports betting. and with support, not looking strong for prop. 26, it's looking even weaker for prop 27 which would allow online sports betting in california and would implement taxes and fees on tribes and gaming companies. the majority of the revenue raised would go toward homeless services and gambling addiction programs. but for the majority of the people surveyed support was just not there. about half the likely voters said. >> they actually thought it would be a thing if had and then there's prop 30 if passed, it would increase income taxes by nearly 2% for people who more than 2 million dollars per year with funding from that, go towards

subsidies for 0 emission vehicles, infrastructure for more charging stations and resources to fight fires. as of the last ppi seiple a month and a half ago, the majority of those surveyed said at the time they support the measure. but since then, governor newsom got in the mix coming up against the proper fast forward to today. and just 41% say they'll vote yes. people who supported the measure through a lot of things that make him feel curfews or change their mind. people are confused. they're most likely going vote now in the race for governor gavin newsom's lead over republican brian. dolly dropped slightly since the last poll. but newsom still comes out on top by 19 points. still more than half of those surveyed say they are concerned about the direction of the state are a lot of anxiety about >> economic conditions and how people are feeling about their governments. state their of course, the conditions in they're experiencing
