guard down in los angeles. kron four's joey horta is following the latest live. good morning, joey. >> good morning, guys at this all boils down to water, state rice and what our federal rights over this whole situation here. it's something legal scholars will be debating for years to comment. here's how we got to this point. first, the president argues that antis protests interfere with immigration enforcement and they are an insurrection giving him the power to send the guard out next, a federal judge in san francisco orders trump to give control back to newsom and trump is in violation of the 10th amendment in the trump administration immediately files an appeal to temporarily blocked that decision for legal analyst michael yaki says this case is u.s. law students dream come true. >> federal interest. what is insurrection and against against all of this, of course, is the backdrop of the fact that at a time when and where we believe the president should have exercised his

authority under insurrection act. january 6th, nothing occurred. >> a 3 judge panel will consider this appeal. 2 of those judges are trump appointees. another is a biden appointee. it's not clear if they'll make a decision today, but yaki predicts this is going all the way to the supreme court. protesters will be out here at 11 30 this morning rallying to get those ice officers and also the national guard out of los angeles. a hearing is set to get underway online. only from this courthouse at 12 o'clock today. back to you. all right. we'll see what happens. thanks >> well, this hearing comes don't forget, as president trump is ordering ice to ramp up arrests in cities that lean democratic like san francisco. the white house says that ice will try to make at least 3,000 arrests a day, which is far and away beyond their current average of 650 arrest per day. the president also doing a reverse course at least for now on immigration raids that happened at restaurants and hotels and

farm saying that those industries would be hit particularly hard by ice arrest. so he doesn't want them to happen. there. >> well, the protests is if we didn't have the national guard on call reading they were drips. plus angeles, apart. they come and they checked it. they say is the national guard going to be there and of the national guard think they don't even show that's completely unnecessary. total waste of our tax dollars that are being >> i just think it should be happening. people terrible. >> i mentioned a moment ago, the president doesn't want the side streets to happen at restaurants and farms. but the washington post is reporting this morning that ice officials have reversed that directive and are now telling leaders represent field offices across the country that they do, in fact, have to raid work site locations. well, meantime, governor gavin newsom is vowing to fight back against the president's order to expand ice activity in democratic cities and states.

the governor released a statement which reads in part, quote, trump's plan is clear incite violence and chaos in blue states have an excuse to militarize our cities demonize his opponents. keep breaking the law and consolidate power. it's illegal and we will not let it stand and quote, democrats at the state capital agree. >> this continued actions do not make us safer. they still fear their families apart and force people for their into the shadows. many of the people that are being picked up have no criminal history. >> i have people that are calling me asking if they should send their kids to school. i was flying. hear somebody was asking me if they should go to work. this is absolutely out of control. >> well, republicans, though, argue that california's sanctuary state policies which democrats support are making the situation worse for everyone. happening this hour, california senator alex padilla is expected to speak on the senate floor in washington after a tense

encounter at a press conference led by homeland security secretary kristi noem. you've probably seen this video. padilla was forcibly removed, put to the ground and handcuffed after he tried to ask a question he plans to address what he calls the trump administration's militarization of las angeles following the deployment of thousands of national guard troops and active duty marines to help out in immigration raids. padilla is urging bipartisan opposition to what he describes as an abuse of power. >> 906. and in the south bay, santa clara county, home care workers are concerned about. they say the growing effect of the ice raids on their community and they're rallying for better pay. they are kron four's will tran following. this has been all morning as those. >> rally-goers have been arriving. will. >> home care workers. they were outside rallying for about one hour or so and now they plan to go inside and then give the board supervisors a piece of their mind. they're looking for 2

things this morning. we pay and protection. you can see the line as they're being screened and we're talking maybe a couple of 100 trying to slowly make their way inside. they're upset because they say they simply do not get paid enough that the average pay for them. it's around $20 an hour and that obviously it's not enough to live in the bay area said they would like a significant pay raise. the other thing that they are looking for is protection from the board of supervisors. they don't speak english, many of them, but through their family and friends, they fully know what's going on with ice raids. in fact, i got a chance to talk to one of the executives. she does not speak english. i spoke to her through a translator. here's the fear throughout the home care community in the south bay should all of you this is

i i we have the taxpayers we really hard. he said, i >> if mississippi that like our society and this time able he innovation and they need to up here. >> they don't know exactly what the board of supervisors can possibly do to protect them. but they hope that there's something in place because they are afraid to show up to work. at times. they say that a lot of their friends simply stay at home. and of course, that affects the home care community that thoseypeople i also need help as well and just do fortify what i had to say. many of them are wearing this. this is is translator. not all of them speak english. many of them are immigrants and even some even said they're undocumented and they are here fall, but they hope this will get the message through to them and continue rallying that the board of supervisors can come

>> we are back 9.25. is the time a fire pit explosion sent 6 people to the hospital in windsor over the weekend. fire officials say it happened saturday night about 9 o'clock. they say a propane tank inside a cabinet had been leaking and those vapors ignited. when someone opened the door, 6 people ended up being taken to the hospital. 2 with moderate injuries. the

other 4 had minor injuries. the incident happened on costello cuts. the place just east of highway 101. >> there's a tiny beetle doing some big damage in marin county posing a big threat to oak trees. so experts are now warning property owners about this little bug in nevada. watch out for the mediterranean oak borer. they say that because it bores into the trees, it's a beetle and it's one 8th of an inch long. so very short. it can do serious damage. it burrows into valley oaks and it carries fungus and it feeds on it. and here's the thing is the infestation starts way up the crowd. so you're not going to see it up there. but then it works its way down the trunk and eventually kills the tree. so by the time you notice it, you've got to do something. you may notice thinning leaves. keep you out for that lamb's that are dying. and if that happens immediately, call in our various done, hopefully they can save your tree. still

going to be about 23 minutes starting. james, back to thank you. reyna to 9.30, developing story this morning. a man walking his dog in san leandro was shot and killed over the weekend. yeah. shocking story. kron four's sara stinson spoke with neighbors who still can't believe it. >> police say a man was walking his dog right here along euclid avenue when he was shot in the back. a woman who lives nearby says she's concerned she didn't want to go on camera, but she tells us she's seen on house people hang out around here but never violent crime like this. >> this one is really, really quiet neighborhood. you know, my kids that live here. nothing happened like this before. eliana honor auto has lived in this san leandro neighborhood for 7 years. she says it was shocking to wake up to this scene. >> after a man was shot to death near her home saturday morning to like the stripes on the other, the building

>> the police say don't come closer, just, you know, go and your house. officers responded to the area of euclid avenue and east 14th street just before 8.30, police say they found a man in his late 40's lying on the ground with a dog, still least to his hand. the man died at the scene. his dog was not injured definitely more unusual scene when you still have the pet that's there. and from all appearances, it appear that he was just walking the dog. course, that's our investigators are still piecing together everything. teng says investigators are speaking with neighbors and gathering security video, an effort to identify the shooter was investigators obviously still piecing together the details to figure out. >> the reason the motive, we don't have much release on that front. well, i can say is what we've gathered so far that there is no indication that there's an ongoing threat to the community. this is the city's first homicide of 2025. >> there were a total of 4 last year. owner oddo says

she's never been worried for her kids safety until now. so this i worry about because says very close to a school. >> you know, we you know, for my kids that we go so that made me feel we're still waiting for the coroner's office to release the identity of the man killed here. all we know is that he lived in san leandro and his dog has been brought to a temporary animal shelter. i'm sara stinson reporting in san leandro kron. 4 news and also in san leandro. a single father is asking for the community's support. >> because he and his family need a new place to live. their apartment was destroyed in a fire friday afternoon. it's him and his 2 teenage sons and their dog. it only recently moved in to that apartment. he says the fire started in the kitchen. luckily nobody was hurt, but now they have nothing >> let's go to the east bay where crews work pretty quickly to contain a grass fire in alameda county. this broke out near mission road

roddy road in the seminole area yesterday evening. it's called the mission fire. cal fire says it grew to about 75 acres in size. but then they were able to contain it. officials say no structures were threatened. they're still looking into the cause of that fire. meanwhile, take a look at this. an suv somehow careened down 100 foot embankment in the north bay police and firefighters responded to petrified forest road that's just east of the napa. sonoma county border. a total of 4 people were inside. they were all hurt, had to be taken to the hospital. we're still trying to confirm their conditions this morning and exactly how it was that suv went rolling down the hill. 3 people are in jail this morning for an armed robbery that happened in oakland sunday night around 10:00pm. the business on macarthur boulevard was hit. >> by 3 people who walked in, they're thaten employee with guns and then they stole cash and cigarettes. cigarettes. and then there was a police pursuit and that vehicle ended up crashing into a parked car. and that's when

all 3 were taken into custody. san francisco police are asking your help in identifying a person who was found dead in a public bathroom in golden gate park last month, the body was found may 12th in the bathroom near mlk drive in 19th avenue. it was that of a male and theyy have shown us this sketch of the person. he's a about 30 years old. they think brown hair, brown eyes, 5 foot 9 and weighing about 157 pounds and he had multiple tattoos on his body, including you can see the cross on the upper right cheek bone there. the cause death is still being investigated. >> all right. now to a story that really reads like a miracle. don't be surprised if this becomes a movie at some point, a fremont man found alive after more than a week alone in the himalaya as he was injured while on a hike and survive. not only is incredible, but now his family is asking for medical bills because he's recovering in a hospital.

after he allegedly hit a teenager with his car and then drove off. this happened at the northgate mall parking lot last weekend. the a security guard was on duty at the time. witnesses told police that he was yelling at a group of teens and chasing them with his car before the crash happened. police say he drove away but later returned and surrender to investigators. the victim was hospitalized and is expected to be okay. that guard who police identified as milton kennedy has now been booked on felony child abuse charges. in san francisco city workers are speaking out this afternoon against proposed cuts and mass layoffs ahead of the city's board of supervisors meeting. this all comes as mayor daniel lurie proposes now budget cuts that are aimed at addressing the city's nearly 800 million dollar deficit. union groups say these proposed cuts would essentially gut city services and be detrimental to the cities, economic recovery. instead, they're advocating for the city to make cuts to private contracts. the group plans to meet at the city hall

rotunda this afternoon at 01:00pm ahead of the supervisors meeting. san francisco leaders, by the way, are voting on a permit to give the city's new men's soccer home stadium. mayor daniel lurie has presented a resolution to the board of supervisors hoping to get the golden city football club approved to play home games at the city's keys are stadium as well as practice at other san francisco field. the permit would be for 15 years with 3, 5, year extension options and a permit fee that would come out to about $1500 per game. >> president trump's ongoing tariff or may have an effect the next time you go to an amusement park because a lot of regional amusement parks are saying that they're buying bulk prizes like all these stuffed animals you see and also bulk parts like for the rise and things they say it's very difficult for them to plan for park operations this summer. so they want to be ready for anything and they're
