>> now at 5, a high stakes courtroom battle in san francisco today as president trump and governor newsom go head-to-head over who has control of the national guard. and sarpy residents are criticizing mayor dan daniel lurie's rv proposal limiting parking to 2 hours. some say this is their only shelter option. the news at 5 starts right now. other good evening.

thanks for being with us tonight for kron. 4 news at 5. i'm grant lotus and i'm catherine heenan. our top story. >> does the president have the right to deploy the national guard to the streets of los angeles? >> that was the question before the judges on the 9th circuit court of appeals today, a lower court ruled the president did not meet the standards to deploy the guard. however, the trump administration quickly appealed. now the decision is in the hands of a 3 judge panel kron four's dan kerman has been following this. he's live in our newsroom with more. dan, we're talking about la in this case, but a lot of people think this could later apply to other cities in the country. that's right. it's all about what this right gives the president and does he have to meet the statutory requirements to deploy the guard? that's what's before the 3 judge panel. and that's what they talked about for a little over an hour today. >> what does it mean for the president to be unable with regular forces to execute the laws for a little over an hour, 3 judge panel with the

9th circuit court of appeals peppered attorneys for governor newsome and president trump with questions as the 2 attorneys argued whether or not the president has the legal authority to deploy the national guard to the streets of los angeles. know there is no rule for their court. >> play reviewing that decision. >> the attorney for the trump administration argued the judicial branch has no legal authority to review such a decision by the president. and furthermore, his decision to deploy the guard does meet statutory requirements. >> the guard is essential to continue to safely enforce immigration laws and protecting federal buildings in los angeles. jessica mensch, according essential with this injunction, the state otherwise lives and property will be best or at least needs to some consideration. >> of whether there are more modest measures all in for the national guard before taking that great, extraordinary step. >> the attorney for the governor argued despite protests, ice is able to carry out its duties meeting. the

president doesn't meet the requirements for deploying the national guard every day that this order remains in effect. it is causing harm. >> our nation's broader democratic tradition of separation of the military from civilian affairs. >> and not is not just a problem for the 60 day presented appointment here. >> the question for this court will be do they agree with a lower court decision that the president didn't have the right to deploy the guard or will they side with the trump administration? it's not clear where the panel's going to go, but the 2 trump appointed judges seem to be inclined to not support what the district court judge had ordered, which would mean they would rule in favor of trump's order. rory little is a constitutional law professor at uc law. san francisco simply affirming the trump order at this point is going to suggest that it's not going to be so rare and that the president can call out the national guard almost whenever

he wants. that's a very dangerous position. and one would hope that the 9th circuit won't say that. whatever the ruling is, it will likely be appealed to the u.s. supreme court. right now, though, the car remains on the ground in los angeles. >> live in the newsroom. dan kerman kron, 4 news. thank you, dan. >> and of protesters gathered outside the 9th circuit court of appeals today in san francisco. they want ice, the national guard and the marines to get out of los angeles. organizers say they are upset that the appeals court has halted a ruling by a judge last week that returned control of the national guard. back to governor newsom. they're urging the court to serve as a check on president trump. u.s. senator from california, alex padilla addressed his peers for the first time today after he was forcibly removed from. >> a department of homeland security news conference last week. this was the moment when federal agents took him to the ground after removing him from

that news conference friday after he interrupted secretary kristi noem as she was addressing reporters. secretary noem says no one knew senator padilla was and that he had lunged at her during the briefing with reporters. however, padilla says federal agents actually escorted him into that briefing. he also added that he asked a question and when he did, he was tackled by fbi agents calling. this isn't about me. >> in fact, is that. >> just about immigrant communities or even just the state of california? it's what every single american was their constitutional rights. >> senator padilla concluded his speech today with a call to action for millions of americans to stand up and keep peacefully protesting against the trump administration's attack on what he calls fundamental rights. all right.

let's switch gears, talk weather here as we get a live look over san francisco. >> and kron 4 meteorologist kathy trafton this year. kathy, i know we've had some wind the last day or so, but that's easing up, right? that's gone. you know, we have a pattern where really starts rank in the late afternoon into the evening and then it tends to die off overnight only to regenerate again and again and again. we're going to see that pattern continue all the way through. >> this forecast so we're going to talk a lot about the sunshine and the warm weather today and tomorrow in the clear skies. but the wind, that's where the other big stories, nice view. golden gate bridge nary a cloud in sight. but that will soon change temperatures right now, anywhere from one degree warmer than yesterday. looking at you, san jose to 9 degrees warmer. looking at you conquered compared to yesterday. so we're seeing a warming trend. it's pretty much everywhere. only 62 in point raise. but wow, right now we're at 92 in st. louis. you notice micro-climate just starting to kick in as we inch

rochelle and his 2 teenage sons were in the process of moving into their new apartment on marina boulevard in san leandro when he heard a fire alarm and saw flames in the kitchen. listen, it is not just in the house and all the side. >> the also is that coming from the life was kind of part of it. he says when one of his sons attempted to break open the fire extinguisher, it was too late. the entire unit was engulfed in flames. >> all 3 escaped without injury and so did their dog. rachel, who makes money as a mobile notary says the alameda county fire department worked hard to put the fire out of the way to back up and place to get through it. i do. >> might know here. my laptop, we're likely saved i was able to get that for me either that or the show just separated from his wife and is in the process of getting a divorce. and this was supposed to be a fresh start. that was our first day new life. together was in a new light road. shell started an online fundraiser

to help him and his sons get back on their feet. the cause of the fire is still under investigation, has been no, i didn't grab. >> i would my kids, my thought. no, i'm not heard think life. meanwhile, rochelle and his sons are receiving assistance from the american red cross. rochelle is also working with the property manager to recoup the $4,000 in moving costs paid before the fire. >> philippe djegal all kron. 4 news. >> san francisco's transportation muni started discussions about rv permits and a newly proposed rule that mayor of lurie says would limit parking to 2 hours citywide. and this follows a rally by an rv coalition at san francisco city hall today. >> protesters there were blasting the proposed rule. kron 4. stephanie rothman has the story.

>> a new program in san francisco is aimed at detecting cancer and firefighters. mayor daniel lurie announced today that half a million dollars will be used for cancer screenings and kron four's. rob nesbitt reports on how that program will work for the firefighters at risk. the money for the new cancer prevention screening program is coming from. mayor daniel lori's proposed budget. >> the mayor says budget constraints are tight, but that the money was needed to say first responders lives. when firefighters respond to an emergency call, they aren't just putting themselves in harm's way at an active fire. >> they also face long-term health risks. san francisco fire chief team chris been knows this all too well in the past year. we've got to feel

girls work predominately this station. who suffered from cancer contracted on the job and on the line of duty from cancer, it's firefighters exposure to toxic substances, hazardous materials that makes them 14% more likely to die from cancer. according to the cdc mayor daniel lurie visit station 2 in chinatown to announce a new cancer screening pilot program for firefighters in the city when there is danger, you run towards it. you are the protectors of san francisco. and today we are here to protect you. 500,000 $1 of the mayor's proposed budget will go towards advanced imaging scans typically not covered by insurance. firefighters over the age of 40 with at least 5 years of service will be eligible. we know screenings can save lives. we know when we catch cancer early it drastically increases the survival rate of firefighters. the mayor says the screenings have identified cancers that

may have gone undiagnosed until advanced stages. he has partnered with the board of supervisors and firefighters union to ensure the pilot program is fully funded. chief chrisman says the screenings lead to proactive treatment directly affect his members lives. they really just want to help the public and do their jobs. this cut carve out in this budget is going to help them live longer and do their jobs and serve the public and keep the citizens of this great city safe. according to the san francisco firefighters union, the city has lost more than 300 firefighters to cancer in the last 20 years. >> reporting in san francisco, i'm rob nesbitt kron. 4 news. in marin county. a little beetle is posing a big threat to oak trees. experts are warning property owners in nevado to watch for the mediterranean. >> oak bor. beatles just and 8th of an inch law. so really small but can do serious damage. apparently the infestation starts at the trees, crowder canopy and can spread to the trunk, eventually killing it. earlier

windy. oh, yes, especially along the coast day after day. we see the winds strengthen in the afternoon, die down in the evenings overnight and then strengthen again the next afternoon thursday as one of our really, really windy days where you see that and then also on friday. so what's going on is we do have a weak area of high pressure and also because we don't have much in the way of clouds and fog. we're warming up and then look what happens over the weekend. it's the first weekend of summer and we've got a big trough not bringing us rain, but bringing us cooler temperatures. temperatures back to normal even a bit below normal. so we're in for a beautiful spell of weather. no rain, of course, for us. not this time of year. be very surprising. if we actually did have that. but we're in for just beautiful, put, you know, no problems. it's actually tranquil. this is one of the rest that's in our newscast. i think to have some happy news. yeah, i was kidding earlier because i keep saying, wow, it's great. oh, that's nice.

flagship club still thrives today has was a uc berkeley and a stanford grad. he devoted more than 50 years to the business is remembered for his passion for music, food and community. workers at food banks across the bay area are concerned about proposed cuts to snap the supplemental nutrition assistance program. those cuts would slash 300 billion dollars from the program. that's the equivalent of 9.5 billion meals across the country. second harvest of silicon valley says snap support 675,000 people in the bay area. local leaders are urging lawmakers to stop this bill warning it could harm communities already stretched very thin. >> snap isn't just a lie night and it is a real lifeline to 40 million americans who depend on it to be able to buy groceries from their local grocery stores and put food on the table.
