wildfire in the south bay prompting evacuations as more than 150 fire crews worked to put out those flames. thanks for joining us for kron. 4 news at 10. >> dan thorn and i'm noelle bellow. this fire burned nearly 100 acres in east side. san jose is 60% contained tonight. kron four's jack moments been following the fire since this afternoon. he joins us now live with the very latest details. jack. >> yeah, down into whether it was a mixture of tall, dry grass, high wind and the steepness of the foothills here that allowed the fire to spread fast as it did. but cal fire another. prepared and dance for the first big fighters of the season. >> i let a lot of fight. worried that. >> you know, it might come down this way. eventually flames covered close to 100 acres in the foothills between milpitas and eastside san jose

evacuation order or warning and you could just keep better track of the fires. >> that way from now on for now reporting live in san jose. jackie moment kron 4 news. >> all right, jack, thank you. in san francisco tonight, police have arrested a man accused of a hate crime in the marina district. this happened saturday at 02:00am on fillmore in multan streets. police say a man and a woman were sitting on a sidewalk when a another man nearby began shouting anti-semitic slurs. the situation escalated and the victim says there was an unprovoked assault. he had to be taken to the hospital. but one man, one diaz, rivas, says been booked into jail. san francisco state senator scott wiener responding to this attack saying in part, quote, antisemitism on both left and right is deadly. real. it happens in small ways and large in our schools and universities in the workplace, on social media and public meetings and in community spaces. >> a 19 year-old man accused now of defacing the pink triangle on twin peaks. san francisco police say they

responded to a report of vandalism around 12, 30 this afternoon. they found the suspect actively spray painting the installation officers arrested him after a brief chase. patrick carney, founder of the pink triangle, says he found out when police called as a total surprise and out of the blue. >> but the police got a call from somebody who witness spray painting that. so they came out and caught the guy which is great. but you can see the damage that was done. zigzagging lines that go back and forth across the pink triangle and they're about 14 inches wide. said, it's 26 of the tarp. so we'll have to replace those tarps, which is a big chore because we would have to demand dismantle whole area in order to replace them. so that's disappointing. so what i think do is just get some paint that matches the original color and pain over the black paint. however, that's a temporary fix and will still have to throw those

of los angeles continued in a san francisco courtroom today. this comes after a lower court ruled the president did not meet the standards to deploy the guard about the trump administration has appealed that and it's now in the hands of a 3 panel. judge, a 3 judge panel rather prom pours. dan kerman reports. >> united states court of appeals for the 9th circuit is now in session. >> attorneys for california governor gavin newsom and president donald trump argued before a three-judge panel of the 9th circuit court of appeals tuesday as to whether the president has the legal authority to deploy the california national guard to the streets of los angeles. civil unrest targeting federal law enforcement officials and design to prevent them from carrying out their duties. >> the courtship, the stuff for the president's judgment under problem through the attorney for the trump administration argued not only does the order meet the statutory requirements, but the judicial branch has no legal authority to review such

a decision by the president know there is no rule for their court to play in with you in that decision. the problem because it sets a president a precedent for this president and future presidents to take similar actions going forward. the attorney for the governor argued despite protests, ice is able to carry out its duties meeting. the president. >> doesn't meet the requirements for deploying the national guard every day that this order remains in effect. it is causing harm our nation's broader democratic tradition of separation of the military from civilian affairs. >> and not is not just a problem for the 60 day presumptive deployment here. >> for just over an hour, the 3 judge panel question the attorneys and evaluated the arguments. it's not clear where the panel's going to go, but the 2 trump appointed judges seem to be inclined to not support what the district court judge had ordered, which would mean they would rule in favor of trump's order. rory

little is a constitutional law professor at uc law. san francisco simply affirming the trump order at this point is going to suggest that it's not going to be so rare and that the president can call out the national guard almost whenever he wants. that's a very dangerous position. and one would hope that the 9th circuit won't say that whatever the ruling, it's likely it will be appealed to the u.s. supreme court. in the meantime, the california national guard remains on the ground in los angeles. >> dan kerman kron, 4 news. >> the city of san jose is pledging 1 million dollars to ensure its immigrant community gets legal help when they need it. the city council unanimously approved the funding during their meeting last week. the vote comes as the trump administration is continuing to ramp up ice activities. san jose mayor matt mahan says expanding the resources is the best the city can do. >> you have a lot of mixed status. families, but a lot of people in our community living in fear not going to school, not going to work. this has

impacts on all of us at the most basic level community members who are scared to report crime or be witness to a crime that doesn't make us safer. that makes us less safe. so we are going to stand up for immigrant community. we obviously cannot in any way interfere with federal law enforcement. that it's also not our role to carry out federal law enforcement. these dollars, though, are really meant to ensure that our community knows its rights has access to legal representation. and the due process is followed. >> and the vote followed a massive rally outside city hall against ice raids statewide. still ahead, several more bay area cities are set to waymo's out on the roads where the robo taxis are expanding. now. >> plus, san francisco sets aside half a million dollars to protect firefighters. how it will help prevent cancer from members of the department. and after the break, outcry continues in marin county. the fight rages

board's decision to cut to contracted employees who helped start the black student support tam high school last year for total disregard for students well-being involving anti-black racism him as all time high. this vote happened on june 3rd. and while the issue was not on the tuesday night board agenda, the community made it the night's priority. fortunately, we have just a big disparity support. >> you know what students are not giving up, christine to bury, put together a petition to reinstate the jobs of paul austin. anthony should tate austin. our petition continues to grow. we have over 1400 people that have signed that. >> more and more people are reaching in on this. and so we told them the last time we weren't going away, that issue mattered. >> and most importantly, our children matter. this is about my kids. everybody's kids. having the right to belong in their high school environment. more than 100 teachers at tam high have also come forward in

support of their positions. but we want to let our board know and we want to let our incoming superintendent know that this is really important that we're not willing to allow our elections to continue to not get what they need on our campus, that we're going to be here for months to keep the pressure on the contract, not renewed cost. a total of $250,000. the board president has explained her vote citing budget cuts last 4 days behind 1, 1, way passed 2026 27 school year. >> due to declining revenue, property taxes and cost revenue reversed. >> but to bury says the marin county superintendent of schools and other organizations have made offers to step in and help fund the program. and there's money out there. there's money in the budget. all we need is for the board to stop playing petty politics. and remember the principles that they ran the new superintendent. courtney good spent some time at tam high last week to learn about this program. the board president says it will

continue on with district employees. >> but many say the 2 positions cut are the backbone of this program. they worry it will fall apart next school year. and now these parents are urging school board to put this matter on next week's agenda. i'm sara stinson reporting kron. 4 news. >> 11 union members arrested while protesting cuts to public services in san francisco. according to union officials, more than a dozen city workers went to the board of supervisors meeting earlier this afternoon and began chanting this halted the meeting for nearly 2 hours. the san francisco sheriff's office confirmed the arrests. they say all 11 people were cited and released shortly thereafter. the union members oppose mayor daniel lurie's budget proposal, which includes layoffs and funding cuts to several public services, including health programs and emergency management. new at 10 waymo

rolling out robo-taxi service on the peninsula starting today. riders can catch a driverless car in burlingame brisbane, millbrae san bruno and south san francisco companies also expanding its coverage in silicon valley with more areas added around palo alto and mountain view service to san francisco airport. not yet available, but the company does plan to begin mapping routes in that area in the near future. city of san mateo has its first ever female police captain john mara vs. we'll step into the role this sunday after 20 years with the san mateo police department, she'll be the first woman to ever hold that title. and the second highest ranking woman in the department's history and san francisco mayor daniel lurie, setting aside a portion of this year's budget to help protect the health of firefighters. >> $500,000 will be used to pay for cancer screenings for crew members. anyone over the age of 40 who has been with

the department for more than 5 years will be eligible exposure of toxic substances and hazardous materials in the job makes firefighters 14% more likely to die from cancer. and that's according to the the san francisco fire department says it has lost 2 crew members to the disease this year alone. >> scott carve out in this budget is going to help them live longer and do their jobs and serve the public and keep the citizens of this great city safe. >> the san francisco firefighters union says the city lost hundreds of first responders to cancer of the years. and this program will make a profound impact on members lives. well, earlier this evening, crews in the east bank put out a 5 acre fire before it spread any further. the flames broke out at the old pittsburgh golf course. crews with the contra costa county fire department say they planned to be on scene for the next several hours, of course, to put out any hot spots that may pop up.

sunrise, we still see a lot of blanket of clouds, low clouds, fog right along the coastline, stretching right to the golden gate, even into the east bay. will it be foggy at the game tomorrow? and oracle park? >> i think not because the clouds and the fog start to pull away. and by the time we have the first pitch at 105, we've got breezes. all right. but we don't have any clouds. so that's good news 67 degrees at 06:45pm. it's going to be obviously beautiful. the wind, not a big factor. it's out of the west-southwest at 13 miles per hour. so should be fabulous. wind is a factor, though, in our weather tomorrow. and the next number of days is very, very gusty, especially right along the coast side. i think we'll be just fine at oracle park. now, on the other hand, the wind is not the big concern in the sacramento valley. it is the temperatures 101. the forecast high tomorrow in sacramento. how hot will it be at 705, a sizzling 94 degrees. when they first start the game and sun

hasn't even set yet right 8. 33 34 that sunset tomorrow and we'll start to see temperatures cool a little bit. maybe 91 degrees at 8 o'clock fun in the sun sets. maybe about 80 degrees. when we get to about 8 o'clock. so we're definitely going to see warm temperatures, but they will cool down nicely enough. not a big pattern and at least we're not 109 degrees as they are in las vegas, right? it could be worse. it could much worse. we will definitely take it. >> thanks, kathy. >> the oakland roots making themselves right at home in the coliseum. up next, how a new coach is bringing a new energy to the team.
