12:01 pm
blocked off an area near the palace of fine arts. police say they found a person dead inside a car just after 10 this morning. this happened in the area of baker and beech streets in the marina neighborhood. police say there is no evidence of foul play at this time. an investigation into this death is under way. officers still have streets blocked off and are asking people to please avoid this area. we have a reporter in this area and will share details as soon as we get them into our newsroom on air and online at kron 4 dot com. in the south bay, a brush fire that was burning in the san jose foothills is now fully contained this afternoon. now firefighters are working to determine how that fire started. kron four's will tran has the latest. fire continues to burn. but it is 100% contained which basically means they have corralled it. it's not moving forward. >> but it's still burning on the hillside, which is why you can see this fire truck right behind me at ranch place. this is where the fire least close
12:02 pm
to the epicenter where the fire started at around 4 o'clock yesterday afternoon. and it exploded to about 92 acres. by the time it was done. it got so frenetic that they actually had to call for aerial support. some neighborhoods had to be evacuated. in fact, they told us cool down the hill that you now our new emergency evacuation center. fortunately, they were able to save all the structures, no damage to them. no injuries. but i got a chance to talk to someone who lives in this neighborhood he said, boy, was it scary? >> we heard fire engines going up. the street, then more fire engines more fire. so came out to look at everybody is on the street looking up at the hill and you said your home a smoky this morning. yeah, it's a strange because it didn't snow smoky where we're standing there watching the fire. but late last night that started to seep in. and the really bad

12:04 pm
if we have enough of those factors, safety is our number one priority. and that's what we'll call a psps. if a power shut off is called the agent pg. e says they will set up community resource centers for people in their county pg. e also has a program called medical baseline. that lists residents with health issues who will be notified in advance of the shut-offs. >> welcome this afternoon. let's take a live look outside at the city of san francisco. the water looking so nice out there, kyla. yeah, absolutely. we are set to see the warmest day of the week, but i thought i would start with well, look outside first. you can see we still have some of that marine layer that's hanging out there over the golden gate bridge. and then i want to talk about the highs yesterday, which were pretty impressive, an above average in spots like santa rosa where we get up to 90 degrees, almost made there in concord. 87 in sandra fell. 84 in livermore, some upper 70's and san jose oakland, 72 and a pretty nice day in san francisco obviously little
12:05 pm
seasonal. if you are by the water. but if you are inland, that's where those above average temps were. and that's we're going to see again today. the real zoom of temperatures kind of heading into the afternoon. you can see that marine layer is slowly but surely starting to peel away a bit here. as we zoom out, you can see the state now pretty awash in sunshine all the way down into southern california and temperatures here. if we look at the difference from yesterday to today, notice that we just have a few spots here. san francisco, half moon bay mountain view that are running a little bit cooler than yesterday. that's certainly where that marine layer saying on everyone else starting to kind of head up there. you look at spot like fairfield already 4 degrees above where we were yesterday. so these temperatures to get very warm in the inner east bay particular notice fairfield pittsburgh, rd up their pittsburgh 86 right now. but we're at 82 in nevado in santa rosa. 75 in san jose and still hanging on to some 60's here in san francisco. but it should be an above average day for everyone across the board today, including san francisco. expecting a high of about 71 degrees, but it is my
12:06 pm
inner east bay that i have the most concerned about today because those numbers to get above 95 degrees. that is dangerous. this is just one day of heat. it's got some wind associated with that as well. things are going whole lot better for you tomorrow in these temperatures start to fall. talk about that when come back in just a bit. thanks so much. another top story for us. it's now up to 3 judges to decide if it was legal. >> for president trump to deploy the national guard to la during anti-ice protests and appeals court heard from attorneys for the trump administration and governor gavin newsom's office yesterday. a kron four's dan kerman has the latest on this. >> does it mean for the president to be unable with regular forces to execute the laws for a little over an hour, 3 judge panel with the 9th circuit court of appeals peppered attorneys for governor newsome and president trump with questions as the 2 attorneys argued whether or not the president has the legal authority to deploy the national guard to the streets of los angeles. know there is no rule for their court. >> to to play reviewing that

presented appointment here. >> the question for this court will be do they agree with a lower court decision that the president didn't have the right to deploy the guard or will they side with the trump administration? it's not clear where the panel's going to go. >> but the 2. trump appointed judges seem to be inclined to not support what the district court judge had ordered, which would mean they would rule in favor of trump's order. rory little is a constitutional law professor at uc law. san francisco. >> simply affirming the trump order at this point is going to suggest that it's not going to be so rare and that the president can call out the national guard almost whenever he wants. that's a very dangerous position. and one would hope that the 9th circuit won't say that whatever the ruling is, it will likely be appealed to the u.s. supreme court. in the meantime, the california national guard remains on the ground. >> in los angeles, dan kerman kron. 4 news.
