on www.ktvu.com, we posted the entire jailhouse interview. we have new developments on a rule that will affect the california right to die law. a judge overturned the law giving the state attorney general to file an appeal to keep the law in place. california's assisted suicide law went into effect in june 2016. it was enacted in part because of a barrier your -- bay area woman who had a terminal illness. she went to organs where she could legally end her life. this afternoon, dan diaz said he is disappointed in the ruling. >> i am proud that we were able to pass it and because of the story of britney.

said his office will retroactively include the record of anyone convicted for a misdemeanor marijuana offense dating back to 1975. the big question was how he was going to accomplish that? today, there appears to be an answer. >> reporter: since recreational marijuana was legalized in 2016, counties across the state have struggled how to reduce our clear the records of people convicted for possessing minor amounts of marijuana. that is because there is a lot of cases and a lot of redtape. prosecutors would have to go to thousands of cases one by one to clear those convictions. but today, it was announced the mayor is teaming up with eight nonprofit group called code for america. they said they will automatically identify convictions that are able to be cleared. uses -- it uses an algorithm to clear out the cases so the prosecutors can't file them with the court -- can file them

with the court. >> drug use in this country has been limited to the people -- has not been limited to the people of color. that when you look at the prisons, overwhelmingly the people who have been arrested and incarcerated for drug use in this country over and over again are people of color. >> the criminal justice system is one of those areas that is most failing the american people. we had the ability to use technology to create systemic change. >> reporter: nearly 5000 marijuana convictions were eligible for review. nearly 3000 convictions are eligible also. it is hope that the technology will be taken advantage of.

the monterey county sheriff's office said they have destroyed a large opium poppy field capable of producing several pounds of heroin each year. the field was growing just east of highway one. deputies cleared the field over the weekend and eradicated 27,000 growing plants and another 16,000 harvested plans. there was four tons of plants in all and the operation was capable of producing four pounds of heroin a year. >> most important, is there anymore is what we are trying to figure out. >> this is the first time the monterey county sheriff's office has had to deal with an open again grow -- opium grow operation. it was more of the same today and the temperatures were on the cool side. it would 72 degrees in fairfield as the warm spot. i expect 82 degrees in morgan

a high speed chase in the east bay was caught on camera following a -- an armed robbery. this video was recorded by a ktvu photographer. you can see a dark sedan go racing by, followed soon after by a motorcycle officer. then a chp patrol car went speeding by on the left. the chase went on until highway 13 in oakland. the chase was eventually called off and that suspect is still at large. uber is changing how they handle complaints of sexual misconduct from writers and employees. the san francisco ridesharing company said they will now allow complex to go to court rather than force people into arbitration.

this is new video taken today on the big island of hawaii. it shows lava shooting out of two of the 20 fissure's that it opened up -- fissure s that has opened up over the past few days. >> we have the latest now from the big island. >> reporter: a red alert on the big island of hawaii and it is not just about the lava. an air quality alert was issued known as condition red after a large amount of sulfur dioxide has been emitted. health authorities warned that paper

their rain in the summer in some cases. there are some strong thunderstorms out there as well as you had this tropical depression in the go. but let's get to the weather here and temperatures tomorrow will be a little bit warmer than these. tomorrow is essentially the same date with a little less fog and a little less wind. we have some thunderstorm activity to the north of us, and up around snow mountain here, in this area, there is some big storms. you look at the rotation on this and that is one of the lows that you will see spinning. that is one of the lows that has released the inversion and has allowed the fog to push well inland where we had low clouds. a few showers and thundershowers again today up around lake tahoe and the fog got lifted out. i suspect we will see some more low clouds tomorrow morning and maybe a little fog. the low
