leaked document already sparking outrage across the country. those four and against abortion rights were outside the supreme court last night fighting for the side, they believe is right. here in the bay area, a small group of abortion rights advocates started gathering in front of the federal building in oakland after that document was leaked. ktvu is jana katsuyama has more on the decision and the local response. hours after the news broke, a group of abortion rights activists joined together at the oakland federal building to protest we're not shocked, but we're outraged. this shows how far the court is willing to go. to actually eliminate abortion rights in this country. the supreme court has not issued a ruling on a mississippi law seeking to ban abortions after 15 weeks of pregnancy. but monday a stunning leak of a 98 page draft opinion suggests a majority of supreme court justices is prepared to strike down the landmark roe versus

wade. which legalized abortion in 1973 and the 1992 planned parenthood versus casey that reaffirmed abortion rights. justice samuel alito writing for the majority says in the draft opinion document quote. we hold that row in casey must be overruled. the constitution makes no reference to abortion and no such right is implicitly protected by any constitutional provisions. justice samuel alito also states quote row was egregiously wrong from the start , its reasoning was exceptionally weak and the decision has had damaging consequences. experts say the leak of a draft document is unprecedented and the drafts often differ from final opinions . everybody has the opportunity to weigh in to say i don't agree with this or that. can you change certain things? um so undoubtedly the details in this draft? uh well look different when we ultimately see an opinion, probably in june, but the core of it is probably what

we will see when it comes out officially decision that reflected largely. what is in that draft would be a glorious thing for the united states of america. abortion opponents celebrated the draft document some gathering outside the supreme court building monday night. also outside were abortion rights advocates who vowed to fight any threat to abortion access for women. but we need to do right now is we need to be on the streets? we need to speak with our feet. we need to be out there saying this is not right. we need to stop sitting back and hoping everything will be ok, because it's not okay. and there could be many more rallies like this one if the supreme court does overrule the two decisions, roe and casey. that's because then it will be up to state and federal lawmakers to decide about abortion access reporting from oakland. jana katsuyama ktvu, fox two news. all right. thank you, janna. and we want to take you out live to the u. s supreme court. there are barriers in place around the cord, so that any people protesting or there cannot get onto the steps of the court.

today, matt heaney will be sworn in as california's newest member of the state assembly. the san francisco supervisor, one last month special election to complete the term for the assembly's district 17 seat that was vacated by david chu, who is now san francisco's city attorney. haney swearing in ceremony will take place this morning at 10 o'clock at the state capital. in oakland school board member has decided to resign with a scathing letter criticizing the oakland teachers union. shanti gonzalez supports the oakland school closure and mergers and she says opponents have protested outside her home , calling her racist anti black and a white supremacist. the oakland school board president called gonzalez dedicated and thanked her for her seven years on the board. now the oakland education association president released this statement. reading quote director gonzalez will not be missed. we hope the next director will listen to and keep their commitments. to district

happening today. former arizona congresswoman gabby giffords will bring her national campaign against gun violence to san francisco. she will appear at a ceremony in the city's financial district that will remember that thousands of americans who lose their lives to gun violence every year. giffords is calling on federal, state and local lawmakers to approve tougher gun

laws. she was severely injured in a mass shooting while speaking outside a mall in tucson, arizona, in 2011. the calls are getting stronger for increased police patrols near oakland's lake merritt after the fourth death in that area in the last six months, all four deaths happened along a stretch of lakeshore avenue in the coldest sack near the lake. one man was stabbed and killed there at about three o'clock sunday morning. now the city council members who represent that area , say loitering is a big problem , and police need to do more to crack down. they can use a bullhorn to tell people to leave. the park is closed. and if people don't leave, then they can take action. she says, cutting down on late night activity in the spot could be the key to reducing crime. police in fremont are asking for your help to find the missing teenage girl. they tell us that they are looking for 15 year old magaly marquez, who is a student at washington high school. there's a photo she was last

mount diablo is up to 44 miles an hour after that, you're saying look at that. right oakland hills there. oakland, berkeley hills, 10 to 20. or so, so i mean, mainly, it's a northerly breeze in place. same can be set up towards sonoma county airport. fairfield oakland. i mean, it's 5 to 10, not crazy, windy or anything, but that's that's a warmer direction. as you know, forties and fifties. you're seeing some member mid fifties in the city. they have a northeast breeze there. 45 fremont 45. livermore napa airport says hey, so are we in 44 in mill valley, 45 palo alto. east bay. tips from 55 alameda, piedmont's 53 degrees hercules 53. then you can drop in 10 for lafayette and castro valley in 43 mid forties for most, until you get out to pittsburgh. and brentwood. they benefit from that northerly breeze as well. so one system kicks out the highs and like building in for two days, then it's going to get knocked out of here in a big way that will start thursday and probably continue all the way into. i'd say about at least maybe tuesday or wednesday next week. the biggest drop will be on sunday that sunday and the monday is

easy after learning the new budget for the transportation agency ensures that they will not be a fare increase. ktvu s christian captain tells us that the sf mta is also promising passengers a cleaner and safer system. san francisco's municipal transportation agency passed its latest two year budget money anticipating cost to run the transit agency between 1.3 and $1.4 billion for each of the next two years. the agency receiving an infusion of cash from the federal government to help recover from the pandemic, meaning uni will not have to increase the cost to ride thanks to the generosity of the federal government, and we've been able to hold fairs flat for two years. keep free money for all youth while retaining for immunity for seniors and people with disabilities. writers say improving reliability and speed are critical to get them to regularly ride. the agency is pointing to system wide improvements, including the new van s bus rapid transit project as proof they're working hard to make the busses and trains run

let's go back to the headlines. thank you. sal house speaker nancy pelosi is back at the us capitol after leading a congressional delegation on a surprise visit to ukraine and poland over the weekend. now her first order of business was to sign the ukraine democracy defense lend lease act of 2022. it's a bill that was passed by both houses of congress and will now go to the president's desk. it's really hot assistant cooperation in the fight for democracy. now the us originally created lend lease programs back in 1941 after the president signs the bill, the u. s government will be able to streamline the process of lending or leasing military equipment to ukraine. new reports suggest russia plans to annex large areas of eastern ukraine. the us says it believes russia could make that move in just a couple of weeks. russia has also resumed bombardment of a steel plant in the southern

invented a right that has no mention in the u. s constitution. i don't think it's a valid argument, but it is a commonly heard argument the right to choose roe versus wade has been embedded in the right to privacy. and although the word privacy doesn't appear in the constitution, it is almost universally acknowledged that that we do possess a right to privacy that the constitution protects. our political experts say if the supreme court strikes down roe v. wade, the issue of abortion rights would either go back to the state or to congress, which means abortion rights will likely be front and center in the midterm elections this november. it's going to be about the swings states the swing districts where members of congress will have to have to have a position on this. governor gavin newsom and leaders of the state senate and assembly released a statement saying in part quote california

be back at work this morning after approving a new contract that ended a week long strike roughly 5000 nurses at stanford and lucile packard children's hospitals walked off the job last monday. the nurses union says the new contract provides pay raises an additional week of vacation, more mental health support and safer staffing for patients. california health agencies are reporting a nearly 30% increase in covid-19 cases in the state in the week. those numbers reflect a national trend now, the cdc reports. the u. s is now averaging more than 58,000 new covid cases every day . that's about double the number from just a month ago, and at least 43 states are reporting a surge in new cases largely driven by new sub variants of the highly transmissible omicron strain. we have immunity that wanes and a virus that, in fact , does not, uh, stay stable.

here in california. there have been about 5600 covid-19 cases a day over the past week. that's the highest case rate in the state since early march. also today, the california assembly will consider a bill that would allow social media companies to be held responsible for harming children. if passed, the bill would allow parents and guardians to sue social media platforms that they believe addict children throughout through advertising, push notifications and design features. basically we're focusing on addiction and the fact that social media platforms in particular are addictive to kids, and it will impose financial liability financial accountability on the major platforms who continued to design products that addict children. the legislation is retroactive, which would put the company's at legal risk for any past damage their products caused for teens and younger children. south bay. congressman ro khanna wants president biden

to intervene laws and policies across the country. as we found communities are now calling for accountability officers simply stand by. okay what started as a traffic stop led to a car chase , ohio, no traffic ending here on south eighth street in richmond back in 2018. the car was reported stolen, which came as a surprise to a group of friends in the back seat, says ricardo hernandez, who was one of them. do you feel that you did anything wrong that night? um no. i don't feel like it didn't side with your hands up. he was the last one called out of the car face away from us. stop that's the voice of richmond police officer brandon hodges, whose body camera video captured contra costa county sheriff's deputies, restraining hernandez. one of them put him in a sleeper hold. he's out

warning. what happens next is hard to watch. give me your hand , struck several times by a flashlight at the hands of deputy brandon battles who then pulled out his gun and pressed it to hernandez's head. deputies charged hernandez with resisting arrest. that charge was later dropped. there's no way to whitewash this. what deputy battles did was wrong and egregious and the fact that no one including officers from richard p. d did anything to stop him. also shows that they're liable for this conduct . civil rights lawyers sued the law enforcement agencies claiming excessive force and failing to intervene, court records show contra costa county settled for $260,000, but the city of richmond fought it and they know what they did. in this case. hernandez in his attorney , say officer hodges did nothing to stop excessive force. department policy. states and

officer shall intercede to prevent the use of unreasonable force and report observations to a supervisor in march, a jury ruled that didn't happen and the officers conduct cause hernandez injury and harm thanks to god, i'm still alive. he's the one that he was there with me and protected me because in my perspective, i would have been dead. all officers are trains that they have a federal constitutional duty. to intervene when they are observing another officer, using what they know to be excessive. force attorney josh parker with the policing project at new york university, says strides have been made to revise use of force policies and strengthen requirements to intervene, according to the national conference of state legislatures . at least 18 states, including california. now have laws on the books. only time will tell if they have teeth. it's vital that agencies follow the law and have

this policy. but also that they adhere to it consistently imposing serious discipline, including potentially terminating the employment of officers who failed to intervene when they are obliged to do so. still, research shows that's only part of the solution. police culture, anti retaliation and training has to change to nonpartisan think tank council on criminal justice officers are more likely to step in when encouraged by a supervisor, seeing fellow officers intervening in similar cases or witnessing peers rewarded for stopping unnecessary force. calling into question incidents like this hard for hernandez to watch. even now, jurors clear in their view, officer hodges should have done something i did tell him that i forgive him. from now intervening. um i told him that africa but retired police officer in long time law enforcement trainer don cameron says hodges didn't have the knowledge or enough time to act

without all the facts of what's going on. and you've got a lot of officers. you've got the guy who obviously fighting don't know whether he's armed or not, you know? would i want to step in and say, hey, stop that and pull the guy away and then have the guy come up with a gun and shoot both of us. just something that you you can't do it. you can't second guess what's going on. i don't think the city of richmond would not provide an interview and said it could not comment, but court documents argue officer hodges is entitled to qualified immunity. giving him breathing room to make reasonable but mistaken judgments and saying he wasn't aware of the need to intervene or didn't have a realistic opportunity to do so. you see them at the end of the video. they're just nonchalant about everything, man. how are you another day at the office, and that's the thing. this jury sent out a message. it's no longer another day at the office. the jury wants to award hernandez more than a half million dollars in total damages for the harm caused by hodges conduct. the

underway to raise funds for the restoration of a mural and cultural asset in san francisco's castro neighborhood , the hope for the world cure mural at 16th and market. was painted back in 1998 but was defaced by graffiti last year. this past weekend a go fund me campaign was launched by san francisco supervisor rafael man delman to raise $55,000 to pay for the mural's restoration. so far, it has raised close to $4000. the santa cruz county office of education is celebrating its second annual rainbow flag raising ceremony to ensure gay rights icon harvey milk. now he was the state's first openly gay elected official. there will be events all month long in santa cruz county to recognize milk's work and the importance of the rainbow flag. many schools and district offices in the county will also hold their own flag raising ceremonies. when harvey milk was working with gilbert baker to design the rainbow flag , he said that this symbol was

reaction from california lawmakers. good morning to you, james. good morning, claudia. let's talk about some context to when it comes to the history of abortion rights. the decision of roe v. wade, legalizing abortion happened back in 1973. then about 20 years later, 1992 we see the case of planned parenthood versus casey, which reaffirmed those abortion rights. after questions rose from the pennsylvania state legislature in just the last year, several states across the country have looked to impose even more strict abortion laws, including outlawing abortions. 15 weeks into a woman's pregnancy at states like mississippi, florida and texas. the elite opinion reveals writings from supreme court justice samuel alito, who says in part the cases should be overruled because the constitution makes no reference to abortion. and no such right is implicitly protected by any congressional provisions. we asked some local political science experts about that. i don't think it's a valid argument, but it is a commonly heard argument the right to choose row versus wade has been

treatments. it's open to workers who travel more than 100 miles from their home. amazon made that announcement before the leak of that possible supreme court decision. happening today . former arizona congresswoman gabby giffords will bring her national campaign against gun violence to san francisco. she will appear at a ceremony in the city's financial district that will remember the thousands of americans who lose their lives to gun violence every year, giffords is calling on federal, state and local lawmakers to approve tougher gun laws. she was severely injured in a mass shooting while speaking outside of mall in tucson, arizona, in 2011. the calls are getting stronger for increased police patrols near oakland's lake merritt after the fourth death in that area in the last six months, all four deaths happened along a stretch of lakeshore avenue and ecole de sac near the lake. one man was stabbed and killed there at about three o'clock sunday morning. now the city council member who represents that area, says loitering is a big problem and says police need to do more to

bodies may be found as the water recedes. the home that once belonged to scotland, lacy peterson has been sold, according to zillow, the three bedroom, two bath home on covina avenue in modesto, was listed for just shy of $460,000 on march 31st. it was sold three weeks later for 510,000. that's where the couple lived in 2000 and two when scott peterson was accused of murdering lacey and their unborn son. he was arrested a year later and remains in san quentin with life without possibility of parole for their murders. a new report found evidence of officer bias and some of california's largest police departments. that report by the california state auditor's office looked into several law enforcement groups, including the san jose police department. state auditors say they found evidence of officer bias against women. people of color immigrants and lgbtq people and found that none of the departments had a clear plan to address the bias. the report

front of the federal building in oakland. after that news was released. ktvu is james torres joins us now live with more on the latest developments in this long battle over abortion. and james, you have reaction from california lawmakers. that's right, pam. good morning to lead document is just a draft document, but it does give us a good idea about what is to come. the supreme court expected to officially rule on a case coming out of mississippi, the state they're looking at ban abortions 15 weeks into a woman's pregnancy. similar laws already in place in places like texas and florida. the 98 page. leaked opinion draft reveals writings from supreme court justice samuel alito, who calls cases supporting abortion, abortion rights, egregious and invented, right, not mentioned in the constitution. experts say, reversing the ruling of roe versus wade eliminates a federal right to an abortion. right to abortion would be returned to the states and each statement, uh, decide in their state legislature or through a vote of the people what their states view on abortion would be. that's what took place here.

with states having their own, say california lawmakers say they will take action. a joint statement from letters of the leaders of the assembly as well as gavin newsom says in part, california is proposing an amendment to enshrine the right to choose and our state constitution. so that there is no doubt as to the right to abortion in this state. we know we can't trust the supreme court to protect reproductive rights, so california will build a firewall around this right in our state constitution. the federal constitution says. if a right isn't spelled out in an amendment, it is up to the states to interpret. but some political experts say, are the ones we spoke to say. congress can go as far to limit that power right now. there are 13 states in the country with abortion trigger laws, meaning if roe v. wade is overturned, abortions would immediately become illegal there, california. is not one of them. claudine alright, thanks, james . we'll leak of a draft ruling from the supreme court is a rare occurrence in a message to staff. political leaders say

little bit slower on one. oh one happily for you to 80 and 85 are pretty decent alternates to that. 6 31, let's go back to the headlines. good life pictures now from the supreme court, and you can see out there very active at this hour. protests are being planned today. this all of course, follows a leaked draft of opinion published by politico that showed the court is planning to strike down roe v. wade draft is in response to the mississippi case, which bans most abortions after 15 weeks of pregnancy. now in that opinion, justice samuel alito rights row was egregiously wrong from the start, its reasoning was exceptionally weak and the decision has had damaging consequences. we asked political experts about their thoughts on alito's argument that roe v. wade invented a right that has no mention in the u. s constitution. i don't think it's a valid argument, but it is a commonly heard argument the

california is proposing an amendment to enshrine the right to choose in our state constitution so that there is no doubt as to the right to abortion in this state. in san francisco today, abortion rights supporters are planning to rally in response to that leaked draft from the supreme court. ktvu sally rasmus joins us now from san francisco with the details. sally obama and claudine later this afternoon. around five. there are several groups that are planning to have rallies to express their outrage over that draft leaked report of the supreme court. they're planning these rallies in san francisco. details are still being finalized, but we are hearing that some of those rallies may be happening at the federal buildings like this one behind us and golden gate, possibly the federal courthouse and at federal buildings throughout the bay area. also another rally planned, possibly for powell and market streets in downtown san francisco. now this sense of urgency comes on the heels of that least draft opinion from the supreme court late last night within hours of the news coming out about that. a small

group of people gathered in oakland in front of the federal building there that draft opinion, obviously not a final decision, but it does give an early clue about how the supreme court could decide on the issue of legalized abortion versus wade as soon as this summer, abortion rights advocates spoke out about what they'd like to see happen next in response. be visible. things are being organized right now for people to get their to get out on the streets and speak their minds. that is the only thing that will make that could possibly make some supreme court back down if they saw that the people do not support this. at least one of the rallies here in san francisco is being organized by a group called the national mobilization for economic justice, whether organizations across the country including the organizers of the national women's march, are urging abortion rights supporters to gather at federal courthouses and buildings in their home towns and cities across the country later this evening and again the plans for san francisco those rallies we
