the headlines. thank you, sal. topping our news this morning, san francisco based twitter begins a new era this morning. elon musk is now taking control of the influential social media platform last night. musk posted this statement saying quote the bird is free, and he fired several top twitter executives as one of his first moves. musk's critics are concerned that twitter may become a platform for lies. and misinformation. concerned that there were risks to human rights and personal safety. any time any single person has complete unchecked control over policies affecting almost 400 million users. musk says he envisions turning twitter into what he calls a digital town hall, but he did not explain how we plans to deal with users who incite violence or promote hate. i would love it if they brought their international guidelines here to the u. s overseas. the hate speech is much more

monitored. um i guess other countries care more about that stuff. musk also did not explain why he immediately fired the company's top executives. there's been no official word from twitter, but stay with us here on mornings onto for updates throughout the morning businesses near the twitter building or hoping to change in ownership will help their bottom lines. some of them told us they're concerned about any job cuts to the twitter staff. others hope that elon musk might bring more workers back to work in person at the office. many businesses in downtown san francisco suffered during the pandemic. will employees were working from home. certainly like it more if there was more foot traffic in the area. twitter is one of the big offices in the neighborhood. and so the more people that are coming into the office, the better we do. and some businesses say they hope there will be be a boost to their businesses from holiday parties in the coming months. well, san jose police are busy searching

for a hit and run driver who had a grandmother while she pushed her grandson in the stroller. they were crossing the street in the crosswalk. ktvu is jesse gary says. neighbors called this crosswalk very dangerous. and we have to warn you. some of the video you're about to see may be hard to watch in seconds. jose street crossing becomes a crime scene. tuesday a grandmother pushing her three year old grandson and both run down on sierra road. i know her, she everyday she walk around this way and grandchildren to the high school track neighbor. young teens. home surveillance cameras captured the crime from two angles. the unidentified woman suffered broken ribs and a broken shoulder. the three year old boy suffered a cut and a bump on his head. his mother didn't want her face shown during retaliation from the hit and run driver. my first reaction was, i couldn't believe it happened. i mean, i mean, how could anything like that

happened? i cannot think of how anyone could drive like that. sierra road is a four lane street running from the east san jose foothills east capitol expressway. it is exactly who i thought it was. neighbors say drivers routinely speed and ignore both the blinking crosswalk lights and pedestrians . crossing history is by far one of the most hazardous things. people barrel down his road. some neighbors say more than a crosswalk is needed along this busy stretch of roadway installed here, i think it's better right, more safer options , obviously, after seeing this video, but jesse mince roth is with vision zero san jose, which works to end vehicle pedestrian collisions. we're facing an unprecedented year for traffic fatalities and pedestrians are making up the the victims in ths vision will live but seeing two people run down. lingers the driver didn't slow down before he hit the driver didn't slow

down after he hit late thursday , san jose police released an image of what they believe the suspect vehicle. maybe a newer dark gray hatchback similar to this 2012 mazda three. unfortunately this home surveillance cameras did not capture the license plate. however there are cameras at the next major intersection up from here, which is sierra and piedmont. those cameras may have captured the license plate. san jose police say if you have any information about this crime to give them a call piedmont hills section of san jose just to gary ktvu, fox two news. thank you, jesse. we do have some new details on another hit and run in castro valley. the chp released this photo and is asking for help identifying the driver who hit a six year old boy on tuesday, sending him to the hospital. the chp says the vehicle appears to be a white midsize suv possibly afford or nissan and probably has front end damage on the right hand

side blurry surveillance video released earlier shows the moment when the suv hit the child. fortunately the little boy was released from the hospital the next day. hundreds of people in berkeley turned out for a funeral mass for two brothers from berkeley high school who were shot and killed during a party in west oakland. family and friends gathered at berkeley church to honor the lives of 17 year old jz garcia and his 15 year old brother, angel, several teachers and administrators from berkeley high were also at the funeral mass. and we're just here this to honor their memory would love and light to be here for our students and to make sure that we can do our part to try and change the world. the teenagers were shot and killed earlier this month at a house party in west oakland. families say the mass provided some comfort. it's really beautiful and heartwarming to know and see that our boys were so loved. both in life and in death, and i'm seeing the outcome is just

beyond words. please say the brothers were targeted by the shooters because of a dispute linked to berkeley high school. so far, no arrests have been made in the case. time is 408. there will be classes this morning at santa cruz high school after a hoax phone call yesterday for a campus wide lockdown. the caller claimed that an active shooter was at the school yesterday morning, and police rushed to that school , while other nearby schools sheltered in place. please search that high school room by room while busses took students to depot park to be with their families. i want to thank the community support and participation in this particular call today. it was a heavy lift, but we were there for the kids, and we're always there for your students and 90. minutes later, police gave the all clear than the emergency was over place in fremont are warning people to be on the lookout for wandering bobcat. it was spotted shortly

after five o'clock yesterday evening near ohlone college and fremont's mission, san jose area , police and animal control officers are now telling students and hikers in the area don't approach the bobcat and contact authorities right away. if you spot it, a mountain lion that was running around the streets of one los angeles neighborhood for several hours, is in the custody of animal control officers this morning. quite a sight. that big cat was first spotted shortly after 10 o'clock yesterday morning near an elementary school in brentwood. he was laying down and couldn't you couldn't really see where he was until the first helicopter arrived, and then he raised his head up. that mountain lion sighting prompted a school lockdown and a shelter in place order and several street closures. it was tranquilized three times but kept running. that line was finally captured late yesterday afternoon right across the street from the brentwood country club. it went backyard to backyard is started in the front yard than just kept going back yard. as as you know, in

the community, all the backyards connect. this is the most excitement. thank god like there's nothing, you know, horrible happening, and it's kind of just interesting and fun. that's a big cat. yeah i don't know. fun is the word i would use, but animal control officers. they don't know exactly where the big cat came from. but brentwood is right near the santa monica mountains , which is the home of dozens of mountain lions. amazing pan. what happens when we you know our neighborhoods back up to open space, but look at oh, gosh. can you imagine seeing that face peeking out of a tree? i can't imagine steve paulson here with our friday forecast. good morning, steve. open space coyotes. that's right. cats here. some of that nature sometimes at night is going bonkers believe okay, get next week. we'll look ahead the next week early. looks like october ends on the dry note, but some hints of some rain colder for sure. next tuesday, wednesday thursday, let's hope it's not one and done there will be more.

i think in the way of snow than for rain for us. looks like tuesday evening is the earliest time frame so still four days away, plenty going on to the north will get us some higher clouds kind of drifting across here so mostly sunny. you can see some of that dragging across far north, maybe a little more out of my forecast zone. but temperatures aloft are pretty warm, though. sonoma mountains 55. diablo's 52 ben loman's 51 south winds south wind west wind so no north or northeast, but temperatures really in a fine line here, mostly in the sixties to low low seventies patchy fog, teeny bit has shown up. clear cold. mostly sunny, cool to nice temperatures well below average here for many forties and fifties currently on this panel, although 40 done up in sonoma county airport and 40 in sebastopol, 40 cent in selma, thirties up upper lake and also latent ville windsor and rohnert park have joined that party at 39 degrees. richmond's 42 little cool there for some 21 25 truckee, south lake south 42 to

44, monterey and also santa maria. so until we get to next week, it's pattern is not going to give us much in the way except for some higher clouds. more rain. more snow comes into the pacific northwest. now again, it depends on which forecast model you look at 11 run they up totals next run they down them. they bring them trending downwards still will get something out of it does not look like a wet system. but at least we'll get something here coming in early november now, hopefully there'll be another system behind that 50 60 seventies and the temps the weekend though it looks good, little warmer, especially sunday. then we start to cloud it up late monday. okay on monday, then tuesday cloudy with some rain, maybe by evening. thank you, steve. a vacant lot in the south bay has neighbors at odds with the city of san jose. coming up the reason. some people say the planted trees and flowers are illegal vandalism by the city. also in oakland, a pre concert and a celebration will tell you why a small group of people very special people were given the keys to the city.

15 week, hundreds of doctors in santa clara county plan to walk off the job and their union calls it an unprecedented multiday strike. the valley physicians group represents 450 doctors at valley medical center and other county health facilities. union officials say there's an impasse in negotiations over working conditions, including patient load and staffing levels. the four day strike is due to begin on tuesday. the union says ied n emergency and outpatient services that county hospitals and clinics. county officials did not immediately respond to our request for a comment.

protesters in oakland are calling on local lawmakers and city leaders to denounce financial backing of a proposed coal terminal in the city's west end. no coal in oakland is a grassroots coalition that contends developers of the proposed coal terminal are trying to influence the oakland mayor's race with more than half a million dollars in campaign contributions. during a demonstration at city hall last night, the group reaffirmed its longstanding commitment to stopping a cold terminal from being built, saying it's an attack on the community's health and quality of life. we're here today because cole has no business being in the west oakland. and oakland period. nowhere because the. but politics of coke of cold, there's nothing but a harm to everybody. and as part of a energy we why why are we using it at and based on greenhouse gasses, there's no need for it. it just adds to the heart to the environment to people's health.

we have no need for it. protesters tell ktvu that a los angeles based financier has contributed $550,000 in coal related money in an attempt to pressure candidates running for the mayor's office. our time is now for 16, some people who live in san jose's alviso neighborhood have been trying to create a park out of the city owned piece of land. however the city says what they're doing is illegal. mark espinosa is behind the project to convert that vacant lot into a neighborhood park after he says he waited eight years for the city to do it. he and other neighbors have cleaned up the lot. they planted trees and flowers. but the city says espinosa is trespassing and his efforts to create a park are illegal. i'm not gonna be deterred by their threats or by their threat of arrest or fines and fees. i'm just going to continue to do the work that i think should be done. so the community of visa can enjoy this

comes to that big bridge that traffic looks good getting into san francisco 4 31. let's go back to the headlines. thank you happening today. contra costa county district attorney dina beckton is expected to announce it this decision on whether to charge a former danville police officer for killing a man who was mentally ill at the d. a s announcement later this morning is expected to clear former officer andrew hall for the fatal shooting of tyrol wilson in march of last year. tyrell wilson, who dealt with homelessness and mental health problems, was allegedly seen throwing rocks from an overpass in danville down onto interstate 6 80 police officer andrew hall confronted him, wilson pulled out a pocket knife, and police say wilson refused to drop the knife. and that's when officer hall shot and killed wilson right now. andrew hall is serving a six year sentence in prison for a different deadly shooting involving a motorist who wouldn't pull over during an attempted traffic stuff. a jury

will now decide whether to find santa clara county sheriff laurie smith of guilty of corruption charges. closing arguments concluded in the civil trial yesterday, and the sheriff is accused of providing permits to carry concealed weapons to her political supporters, while largely ignoring ordinary citizens. smith is leaving office in january and denies the allegations. she refused to testify to the grand jury, invoking her fifth amendment rights now for 33 of former cook at the federal prison in dublin, pleaded guilty to charges of sexual abuse of an inmate enrique chavez, seen in the red shirt, entered his plea in federal court yesterday. chavez is the fifth officer to be charged with sexual abuse crimes at the prison in dublin. the most charges of this kind at any federal prison in the nation. each count carries a maximum sentence of two years in prison and a $250,000 fine. a record number of lgbtq candidates are

conducted by the nonpartisan public policy institute. it found 55% of likely california voters plan to vote for gavin newsom 36. said they plan to vote for republican brian dolly. the same survey found governor newsom strong opposition to proposition 30 appears to have an impact on california voters. 41% of likely voters say they plan to vote yes . on prop 30, which would raise taxes were various climate change initiative that is down from 55% just a month ago and 52% of those fold now say they will vote against him. former california governor arnold schwarzenegger is once again taking sides against his fellow republicans. he has filed a friend of the court brief in the supreme court case over redistricting. the court is set to hear arguments in december over congressional redistricting plan in north carolina that was struck down by that state supreme court. it could give more power to state legislatures

this morning with breaking news. oakland police have made two arrests in the killing of a dentist in oakland's little saigon neighborhood last summer . you're looking at video from last night of one of the suspects. the video was taken at oakland police headquarters and ktvu is henry lee is now reporting that this man being taken into custody is the victim's longtime partner, nelson chia. jail records show. he's in jail on suspicion of first degree murder. police haven't officially released the name of the suspect or the other suspect, who was taken into custody. 60 60 year old lilly sue were shot and killed as she got out of a parked car during a robbery that was back in august . the crime was captured on surveillance video. the sounds of gunfire and a scream can be heard on that surveillance video . police and alameda county prosecutors will give us details of the arrest during a news conference scheduled for 2 30

legalize sports betting here in california, the prop 26 would let you put money down at tribal casinos and four horse race tracks. prop 27 would clear the way for online and mobile sports , betting. the polls haven't been good for either one with several surveys showing both are probably going to fail. all of them huge operators with huge players with a nuclear arsenal of dollars. they go all in and most voters when they're faced with this kind of gamete or this type of choice, they opt out. they say, no. a pox on all your houses. this is known as counter initiatives. ktvu political reporter greg lee will go very in depth into these issues surrounding the ballot initiatives this coming sunday at six p.m. right here on ktvu, fox two. time is 5 24. millions of california voters are expected to fill out vote by mail ballots for the november election. but in every statewide

election registrars throw out and disqualify tens of thousands of those ballots. ktvu is brooks jarocz looks at new data on ballots that were not counted in the june primary. in alameda county and across california. vote by mail is well underway, but some ballots may get disqualified data shows in the june primary, nearly 106,000 were rejected by registrars. nearly 70,000 arrived late. others were missing a signature or had one that didn't match the signature on file. researchers say it disproportionately happens to first time voters and voters of color. we do know, for instance, young people are more likely if they get their ballot rejected. it's because it's late for latinos is more likely to be a signature issue. for new voters. it can be also a signature issue. it's critical balance are signed in postmarked by election day. in the end mail in ballot rejections are under the discretion of each county's

registrar. there is a reality, uh, that if you're in one county versus another, you will have a greater or less likelihood of getting your ballot rejected a report just released by the secretary of state's office. recaps challenged balance from the june primary in the bay area. most counties had between a one and 2% rejection rate. but the outlier is alameda county at 0.3% raising eyebrows. is there something that's being hidden? here is the concern. attorney jason basis represents the alameda county taxpayers association. he says. the statistics are off and accuses the registrar of counting link ballots. data shows. alameda county reported only 23 late ballots in june, but neighboring contra costa county had 3388 and sent a cleric county 3776. six there is a problem with the alameda county registrar voters. that needs to be diagnosed and treated. and if there's a problem with the data from the

prosecutors will give us more details of the arrest during a news conference at his set for 2 30 this afternoon. what today some new officers will join the oakland police department after graduating from the police academy ktvu sally rasmus joins us now the details of the police chief's plan to reduce violent crime. ali pam. it's part of what oakland police chief laurent armstrong has called his 30 day crime plan. the chief put it into effect after a particularly violent august and september in oakland, 17 people killed within the span of those two months. but now, opd says the violent crime rate is down since september, homicides are down 10. percent compared to this period last year, shootings down 25% compared to a year ago . the chief credits the decline to some of the changes he made as part of that 30 day plan includes assigning more officers to the violent crime investigations division. restarting the traffic enforcement unit of the department and focusing other departments on getting illegal guns off the street. earlier

the surveillance footage captured the moment the hit and run driver struck that 68 year old woman. you see it right there, launching her from the marked crosswalk into the intersection. the woman suffered broken ribs and a broken shoulder. her three year old grandson, suffering a cut and bump on his head. the child's mother did not want to show her face or reveal her identity, fearing retaliation from that hit and run driver. my first reaction was, i couldn't believe it happened. i mean, i mean, how could anything like that happened? i cannot think of how anyone could drive like that. zero road is a four lane street running from the east foothills of san jose to east capitol expressway. neighbors say drivers routinely speed and drive recklessly down the busy roadway. saying there's a traffic safety experts say tuesday's hit and run comes during one is already a very bad year on the streets across the entire city. we're facing an unprecedented year for traffic fatalities and pedestrians are

with homelessness and mental health problems, was allegedly seen throwing rocks from an overpass and danville down onto interstate 6 80 when police officer andrew hall confronted him, wilson pulled out a pocket. no. police say wilson refused to put down the knife, and that's when officer hall shot and killed wilson right now. andrew hall is serving a six year prison sentence for a different deadly shooting involving a motorist who refused to pull over during an attempted traffic stop. and also happening today. almost two dozen new officers will join the oakland police department after graduating from the oakland police academy this morning. the extra officers are part of the police chief's plan to reduce violent crime in the city. the chief put that plan into effect after a particularly violent august and september in oakland was 17 people killed within a span of two months.
