inaugural pride show. we'll hear from performers who will be part of the big celebration. and a federal judge says one of california's fair plan home insurance policies is illegal. >> the 11:00 news on ktvu fox two starts now. >> now, the judge says the plan does not offer the legally required coverage for smoke damage and is in violation of the state insurance code. good evening everyone. i'm mike mibach. many homeowners have long claimed this policy shortchanges them. ktvu tom vacar spoke with a homeowner who was denied coverage after january's fires in los angeles county, and now she's hoping this decision will bring some relief. >> with hoses, edda and her son save their altadena home in january's wildfire, but winds blew thick smoke, ash and debris all over the inside. that smoke often fills homes with all manner of lung damaging particulates, as well as blood

and brain threatening toxins. eta says she was too unkempt from cleaning up her home for months, choosing not to appear on camera but telling her sad tale of the california fair plans illegal unfairness. >> i was looking at somewhere between 80 and 100 grand to remediate my home. even though the hygienist report said that your home is filled with lead and should be remediated by a professional company. two days later, i got the denial in writing. >> family and friends put on hazmat protection and they've been working for months washing, scrubbing, scouring, painting, not knowing if the toxins will really be gone. >> unlawfully denying claims for smoke damage. denying them. delaying them. restricting reducing them. lowballing these claims. >> the fair plan has been caught at it many times. >> every insurance company has to follow the guidelines right, and the fair plan just doesn't seem to do it for some reason.

fair plan just thumbs their nose at the department and did nothing. >> but this time the court did. >> horrible heavy metals by dioxins, by asbestos by lead, by beryllium, by lithium. >> oakland homeowners attorney dan shaffer won the case and many others. >> california fair plan has denied thousands of claims and underpaid many more. >> incredibly, the insurance industry run california fair plan often gets customers from the very people they canceled or non-renewed favoring the ones they kept. >> you could be a state farm customer next door to a fair plan customer. the state farm customer gets the remediation and moves back in, and the fair plan customer gets nothing. >> it's completely unfair. the california insurance companies wanted to reduce their exposure to california, and this is the way they got it done. they basically didn't renew us, and this was their way to avoid having to pay for the larger expenses. >> the fair plan has always said

that it is fair, but the judge didn't buy it and consumers are still forced to deal with it. tom vacar, ktvu, fox two news. >> the california fair plan responded to the ruling today, saying here in part, all fair plan burn damage and smoke damage claims are handled consistent with california law. the fair plan is reviewing the decision, as the fair plan is in the process of updating its policy language to reflect the manner in which claims have been adjusted since last year, it is unlikely to pursue an appeal. new at 11, the trump administration must release billions of dollars in federal fund. president biden previously approved to build electric vehicle chargers. president trump blocked the $5 billion approved for 16 states, including california, earlier this year. now, the judge ruled the trump administration overstepped its constitutional authority when it froze the funding. the ruling will go into effect next wednesday unless the trump administration appeals.

nvidia shares closed at a record high today, and santa clara chipmaker regained its place as the world's most valuable company. this comes as investors are regaining confidence that china export controls won't hinder company growth. the company is now worth $3.77 trillion, making it the largest business in the world by market cap, slightly beating out microsoft. the san francisco board of supervisors budget committee is working to finalize revisions to mayor daniel lurie's proposed $16 billion budget. the proposal does include cuts to cover a projected $800 million shortfall. one of the programs facing elimination, project homeless connect, it has helped connect homeless people with critical services for more than 20 years now. and supervisor connie chan tonight hoping to forward a budget to the full board of supervisors that does include the program focused on the mayor's vision of street teams. >> could there be a way that he can actually take on project homeless connect and immerse

them into as part of the team, and realizing that this could be a bit more even dynamic than it already is. >> the budget committee is scheduled to finalize a budget proposal for the full board to vote on in two weeks. it would then be sent to the mayor. he needs to approve a budget before the end of next month. san mateo county supervisors approved a balanced $4.9 billion budget. they say the plan continues funding vital services, including public safety, health care and affordable housing. but they do say uncertainties remain projected shortfalls in the state budget and possible changes to federal priorities could mean the county will have to make some adjustments. the county also keeping an eye on inflation and the rising cost of labor, goods and services. an arraignment today for the san jose police officer suspected of child abuse and drunkenly firing his gun inside a home. officer timothy fay is a 22 year vet of the san jose police department. he was arrested last wednesday

for allegedly firing his gun inside the morgan hill home of his ex-girlfriend while he was drunk. now he's separately accused of abusing a child in monterey county during an incident involving his fiance and her eight year old daughter. now, as of tonight, no charges have been filed in that specific case. fay was one of two officers who shot and killed a man in san jose at a power plant in 2018. and tonight, he described his alcoholism as a way to cope. >> it's been traumatic and we all have coping mechanisms. i use alcohol as a coping mechanism, and i realized that that isn't the best for me, and i need to find what is best for me and move forward and make myself my best person to make the world a better place for everyone else. >> now, the judge agreed to release him on several conditions, including ankle monitoring and calling into the police department's internal

affairs office every day. he is scheduled to be back in the courtroom on august 20th. san francisco man is now in jail accused of operating an illegal gambling facility and selling contraband out of a liquor store. police in san francisco raided the store yesterday right near taylor and eddie. this is in the tenderloin. there they found illegal gambling machines, suspected narcotics and illegal weapons. the 21 year-old suspect was arrested and taken to the county jail. oakland police asking for help in solving a deadly shooting that happened earlier in the week. police say they received a shotspotter activation. 945 monday night on school street, right near 35th avenue. when they arrived, they found a man who had been shot. he was taken to the hospital in critical condition. he died from his injuries today. the victim's identity has not yet been released. anyone with information about the case is asked to contact police. oakland residents are taking matters into their own hands as illegal dumping continues to be a problem. as ktvu crystal bailey

reports tonight, the group urban compassion project is now working to turn the tide against the trash. >> the trash just piles up again. >> eric lee says his neighborhood in west oakland has been littered with trash for weeks. >> we can't walk down this sidewalk most weeks because it's literally packed with trash. >> that trash being picked up by urban compassion project on wednesday. >> we reported this dumping two weeks ago to the city. we've been calling. we wanted to help to get this cleaned up, and urban compassion project came out here sooner than the city did. >> urban compassion project, or ucp, is an entirely volunteer based community group started by oakland native vincent williams, who spent more than two decades living on the streets. >> we've created something that we've given to the community a way to be involved in a bigger solution than just complaining to our local city government. >> since it was established in 2021, the founders tell us the nonprofit has organized about 3000 volunteers to clean up more than 2300 tons of waste, from dumping fees to supplies.

cleanups cost them anywhere from 1 to $8000. each time. >> we pay for the entire process end to end from the accumulation, putting them in the dump trailers to actual disposal. >> and it's happening in oakland at least twice a week. >> it's really cool because you see people from all walks of life just cleaning up trash together, and there's just no barriers between them. >> there's so much news and so many issues in the world that are so big, and you just feel it just feels overwhelming and you feel like you can't do anything about it. and then i look at something like this and i think, like, i can do something about that. >> we cleared all of this. >> they say about 85% of their cleanups stay clean thanks to their homeless ambassador program, which incentivizes unhoused people by paying them $100 a week to report dumping. and one recent instance, ucp was able to send the city a video catching people in the act. >> they ran the plate, they identified who the individual was, and now we're working with them to have that person held accountable. >> oakland public works has issued more than 2300 citations

in a walmart parking lot in los angeles county is now speaking out. and the story does begin tonight's west coast rap. adrian martinez was taken into custody last wednesday in pico rivera. he says he was trying to help a man who was being detained by ice. u.s. customs and border patrol accused martinez of punching two officers. a federal judge found that video of the arrest did not show martinez hitting the officers, although it did show him trying to block

a federal vehicle with a trash can. >> i just started saying, like, you know, that's not right. like, you know, the poor man, like, he probably doesn't even understand what you're saying. all i remember is just try grabbing on to, like, not fall hard. and from there, i just remember trying to get back on my knees and they're all on top of me. >> martinez says he was taken to the immigration detention center and feared he might be deported. his mother, who arrived with his birth certificate, says she was told he was not there. >> you think that, you know, these people are supposed to protect, protect, you know, and that's not protecting. i mean, you don't even know who to believe. what, who to trust. >> martinez was freed on bond. he is being charged with felony conspiracy to impede officers. his attorneys say it's a trumped up charge to justify the agents treatment against him. prosecutors in sean diddy combs federal criminal trial are adjusting their charges just one

day before closing arguments. the team says, in order to, quote, streamline jury instructions, it's pulling back on the attempted kidnaping charge of former employee capricorn clark and former partner cassie, as well as a separate attempted arson. prosecutors are not dropping the sex trafficking charges altogether, just some specific elements of aiding and abetting. they're also adjusting language related to consent given by the women who gave testimony. >> there were times where they admitted, yeah, i wanted to do this or i did give consent. what they want to make sure they can relay to the jury is that just because one of these women or multiple women might have given consent at one point does not necessarily mean that they then gave consent across the board, right? it's not is not like blanket consent. and then diddy can do whatever he wants with these women. >> prosecutors also want jurors to consider that neither physical restraint nor commercial sexual acts are required to prove coercion in sex trafficking. a scary scene

over las vegas. images posted online show sparks and billowing smoke coming from an american airlines plane. this happened on flight 1665, shortly after takeoff from harry reid international. the plane, headed for charlotte, north carolina, returned to the airport there in vegas, landed safely. no one was hurt. american airlines did issue a statement saying the plane had a mechanical issue. you can hear about the west coast top stories every weekday right here on ktvu. west coast wrap with alex savage airing 7:00 monday through friday. or you can always find around the clock coverage at west coast rap.com. next at 11, caltrans hosted an open house in west oakland to get community input on the future of interstate 980. now, 980 currently runs about two miles from the mosswood neighborhood in the north, down south to jacqueline and square. tonight, after previous surveys, caltrans shared three main future scenarios, with the goal of reconnecting west oakland with the rest of the community,

as 980 does create that separation. the first is to enhance what's already there without changing infrastructure. the second is to cover it with a walkable park or third, remove 980 altogether. >> these are not project alternatives. these are scenarios that people can weigh in on, and we can mix and match different aspects that people like of each of these, to come up with the final vision for the corridor. >> caltrans hopes to have a preferred vision decided by the community this coming fall, so that they can start looking into the logistics and feasibility of that very scenario. san francisco has a has suspended a program that allows community members to request traffic calming design out there on their streets. now first reported by the chronicle, the program started back in 2013 and allowed the city to work with the community to install speed bumps, concrete islands and other designs to slow traffic, with the intention of making the

streets safer. but the increasing number of requests has amounted to a backlog of about 300 cases, putting the strain on the program. this also comes as sf mta faces a looming budget crisis. sf mta officials say the program could reopen in the future and will stop taking applications. on july 1st. san francisco pride has undergone many iterations over the years. coming up now, the san francisco opera house is putting together a show highlighting moments in lgbtq history and a group of teenagers rescued from a jetty in the north bay. video of the work by deputies to bring them to safety. and it was all caught on camera here. sonoma county sheriff's deputies got a report of people getting stranded out on a jetty in bodega bay sunday afternoon. the sheriff's chopper, henry one, flew the scene where it found four juveniles stuck. two people were airlifted off the rocks, while the other two were helped out by a boat. no injuries were reported. now to our chief meteorologist, mark bailey. and mark, you're talking about a bit of a warm up here over the next couple of days. >> yeah, that's right mike. just a minor warming for tomorrow, but then by friday and saturday, the hotspots will be getting close to a 94, 95 degrees. so, yeah, definitely a pronounced warm up as we do head into the weekend. highs from today, though some neighborhoods warmed up a little bit over yesterday's readings. san francisco 60 degrees, san jose 74. a bunch of 80s out toward concord, out toward santa rosa, and out toward livermore this afternoon. this was a time lapse earlier today, showing you the low clouds and fog out toward parts of the coast right around san francisco, but some sunshine up

above. as i mentioned, most areas just a touch warmer compared to yesterday as far as the plan for tomorrow. still keeping it cool for the coast. some patchy cloud cover there. clearing skies around the bay and the warming temperatures inland. lots of 80s and a few spots inching closer to 90. here's a look at the satellite for tonight. it's showing you some high clouds drifting into a southern oregon. and for us here in the bay area, right at the coast, right around the bay, the clouds have been making a comeback. so it's kind of been the same weather story each and every day. the clouds clearing back near the coast. they push back into the bay. and that's what's happening for tonight into tomorrow morning. as far as the wind reports, there's fairfield, still gusty, around 33 miles an hour. oakland airport winds out of the west at 13 and a few more spots out toward sfo. the winds have actually backed off right around ten miles an hour. here's our live camera. we're checking out the bay bridge for tonight. you get the sense here that we do have some cloud cover already back in the bay for this evening. current numbers across the board. in the 50s, you can see some kind of a cool evening out there with san francisco

checking in 53 overnight temperatures really not moving around too much, and the clouds will be coastside and right around parts of the bay. to start off your thursday morning at 7:00 into the afternoon hours, the clouds clearing back to near the beaches so the beach is still some patchy fog nearby, but lots of sunshine inland, close to 90 degrees. that's a headline for tomorrow. a little bit of a bump in the numbers, but the two warmest days of the stretch will be friday and saturday, and then some minor cooling into sunday and then more cooling into next week. but the numbers for tomorrow. san francisco, mid 60s. partly sunny into the afternoon hours. san jose 78 concord, upper 80s and antioch 90 degrees. here's a look ahead. we'll call it warm to hot for friday and saturday, especially away from the coastline. a little bit of a drop off the numbers by sunday, but still a fairly warm day. and that cooling will continue into early next week. >> all right mark, thank you. pride weekend is almost here in the san francisco opera is getting in on the fun. it's going to be holding its first pride concert on friday night. ktvu betty yu with us here in

studio. and betty, the show very personal for many of the performers. >> that's right mike, this concert is much more than just a performance for many of the artists. it's an expression of their identity. it's going to be a high energy night with the music and visuals coming together. in a way, the san francisco opera has never done before. the san francisco opera house is no stranger to drama and theater, but for the first time ever, it will be transformed into a high tech canvas dressed in immersive, colorful projections that reflect the spirit of the music and the lgbtq community it honors. the pride program blends classical music with pop songs for soloist nicola prince. the performance is deeply personal. >> i'm trans, non-binary, so i use they them pronouns and i kind of embody both masculine and feminine presentations, and i think i learned that from

opera because opera is so colorful when it comes to gender representation. >> prince says the stage is where they feel most free. >> i just want people to feel uplifted and excited and happy because right now it's a hard time to be queer in this country, and i want people to feel invigorated by seeing all of this. queer art. >> award winning, london based designer and director tal rosner created the immersive video projections. some of the visuals will include archival photos from san francisco pride marches dating back to the 1970s. >> i wanted each piece will have a little story, tell a little story. and then there's the kind of a bigger arc of all the stories being told, one after the other, and some of them are more colorful, some of them are more restrained. >> the concert will feature lgbtq composers and performers with themes of sorrow, authenticity and resilience.
