it happened near 76th and glenbrook. cbs 58's julie parise is live this morning with the latest on the investigation. police have identified a suspect in this shooting -- we're told police are looking for that person this morning. the shooting happened last night around 9:30 near ridgewood apartments, a senior living facility. police say they responded to the call and found that a 30 year old woman and a 57-year-woman had both been shot. the younger victim died while the older woman was taken to the hospital where she is expected to make a full recovery. police tell us the circumstances leading up the shooting aren't yet clear but the investigation is ongoing. live in milwaukee im jp cbs 58 3 now to a developing story... brendan dassey could be released from prison as early as this week. week.a judge has ruled... he should be ?free? while the state decides whether to re-try him for the murder of teresa halbach.cbs 58's kyle aevermann joins us live in studio with a ?closer look? at the case. 3

avery were the subjects of the netflix series making a murderer. and now have an international following.for last decade- dassey, who is now 27 years old, sat in prison - a sentence that could come to an end any day now. dassey's convicon was overturn in august- after a federal juruled dassey's confession was involuntary becaushe was 16, had diminished mental capacity and didn't have an attorney or adult present during questioning. monday, that same judge said dassey should be free during the appeal in part because the state does not have a "likelihood of success on appeal." the der also estho that confession "retrial, re- conviction and re- incarceration are unlikely" the judge says the state "failed to demonstrate that dassey represents a present danger to the community" citing no other criminal record and an almost flawless prison record. 3 in my opinion, a 16 year old kid with no crimnal record, which are things they talk about. a benin record while he has been in prison for almost

through around midnight then becoming partly cloudy. lows in the upper 20s. sunday...mostly sunny. highs in the upper 30s. 3 our top story this morning ... after ?almost a decade? behind bars.... brendan dassey... could back home in just a matter of days. dassey and his uncle... steven avery were made famous by the netflix documentary "making a murderer." a judge ruled yesterday...he should be free while the state figures out if it will re-try him... for the murder of teresa halbach.dassey was just a teenager when he was convicted back in 2007. even though the judge ordered his release--you can expect dassey to stay in prison for a while longer. cbs58 spoke with a prominent defense attorney who says... by law-- the judge had no other option but to order

either re-try him or let him go... when the federal judge overturned dassey's conviction based on his confession. aevermann joins us live in the newsroom with a closer look at when dassey could be free. defense attorney alex flynn- is not working this case-but theres still a number of hurdles to overcome...before dassey could actually be "free" flynn says-this is just a fight to get brendan dassey out of prison-awaiting the decision of the states appeal. but the state has every reason to release him. hes not a flight risk criminal and his family and support system are all in the area. its going to take time though-days-or even weeks- before they let him go. he has to register as a sex offender and the court has to check out where he's living...and who hes lving with. ???4220 there are conditions you must comply with while youre out. and he has a laudnry list. must be monitored by probation office, a social worker he'll be working with on a daily basis.
