program, michael. >> michael: that's right, catherine. i have been perusing it over the last several minutes. even got you an extra copy, that's how good of friend i am to you here. i know a lot of people are excited about first night here, fortieth first night here at copley square. they are still getting their preparations underway. i want to show you the ice sculpture once again. he didn't walk away on live tv this time. i'm pretty sure he will stay here the whole report and continue to work. there will be a large police presence here throughout the day as all of the law enforcement agencies across the city and region aim to keep all the revellers safe on this new year's eve. as you first heard, boston police commissioner evans says in a live studio interview on fox25 morning news yesterday, the city believes it has a good security plan in place. he says to expect uniformed and undercover officers saturating the streets and "t" stations and for bomb sniffing dog to be working as well, and i spoke just a few minutes ago as i

quiet compared to tonight's streets around times square are closed this morning to set up barricades and police checkpoints. hundreds of thousands of people are expected to see the annual ball drop alongside 5,000 police officers. sara: we do have some breaking news overseas right now about the investigation into the paris terror attacks. belgian prosecutors say a tenth suspect has been arrested this morning. the man was born in belgium and in his 20s. police arrested him in the same neighborhood of brussels where lived. prosecutors say they are investigating numerous cell phones that were found during the seven. the suspect will appear before a judge within the next five days. sara: and also overseas, brussels has canceled its new year's eve five works display because of threats of extremist attack. the mayor of belgium's capital made the decision after meeting with law enforcement and decided it is just not worth the risk.

last year's festivities and the mayor says there's no way to check everyone. >> catherine: bill cosby is out on $1 million bail this morning and here is his mugshot after charged with assault. he was charged for a crime that took place a decade ago. what has chaned since the charges first made. >> reporter: after years of denial claims it was consensual bill cosby for the first time faces federal charges for the alleged assault of a pennsylvania woman. the charges coming after andrea constand, a former temple university employee, accused cosby of drugging, then assaulting her in 2004 when she visited the man she considered a friend and mentor at his pennsylvania home. >> mr. cosby made two sexual advances at her that were rejected. on the evening in question

pills that he provided to her and to drink wine. the effect of which rendered her unable to move, respond to his advances. >> reporter: though constand came forward in 2005, the district attorney at the time did not file charges. that same year constand sued cosby. the comedian then settling for an undisclosed amount. legal documents in that case were unsealed for the first time this past july and the deposition made public. in it cosby admits giving women quaaludes but never without their knowledge. that deposition and other evidence unsealed in the civil case paved the way for a new district attorney to reinvestigate the allegations. >> what we know is pills were provided. we then go to the reaction of the victim. you know, frozen, paralyzed, unable to -- unable to move. >> reporter: constand was the first woman publicly come

since then 50 women have alleged similar sexual assaults over a period of four decades. most involving the use of drugs. >> catherine: cosby maintains he is innocent. he faces up to ten years in prison if convicted. the comedian lives in western massachusetts and several of his accusers are from new england. christina ruly of windham, new hampshire claims the comedian drugged and assaulted her in 1965. she calls the arrest a significant day for her. seven other women have filed a federal lawsuit against cosby in massachusetts. their attorney tells fox25 the criminal case will provide evidence to support their civil suit. catherine: a popular streaming service says it will keep every episode of the cosby show available for customers to watch. hulu will not remove the show from the play list. several networks have stopped showing reruns of any program featuring cosby. netflix and amazon prime do not stream the cosby show but offer other ways to watch it. >> sara: new this morning the

to avoid going to prison is now back in the u.s. 18-year-old ethan couch and his mom were arrested earlier this week. u.s. marshall brought her into the airport in los angeles earlier this morning. her son filed a motion to remain in mexico for a few more days. new surveillance video shows the pair casually shopping before they were arrested. couch fled to mexico after violating his probation. he was convicted of killing four people in drunk driving crash but only received probation because he said he was spoiled by his rich parents. >> catherine: happening today a man who drove a car into a pond in hamilton will be in court. this was breaking on the fox25 morning news yesterday. our cameras were there as james chase walked out of a hamilton police station. police say he was drunk, speeding and did not have headlights on when the car plunged into the water. chase was not hurt and the car was pulled from the pond a short time later. roads in the area were slick when that crash happened. catherine: happening this morning the police on the cape

yarmouth man that was reported missing 11 days ago. william fleming's family was last known to be driving a pickup truck. they found the truck secluded eight days later and have been aggressively searching the area ever since. >> sara: more than 100 people on board a flight to maine are rhode island. the pilot of an allegiant airlines plane from bangor was forced to make an emergency night. some passengers say they smelled smoke in the cabin before the flight was diverted. >> girls sitting in the back and they said it was really really hot and smelled like smoke behind their seats. >> sara: firefighters were waiting for the plane when it touched down. the passengers have been rebooked on another flight which leaves in a few hours at 11:00 this morning. >> catherine: new this morning federal investigators say the mbta is not properly maintaining the subway and trolley tracks and it is becoming a big safety

fox25 jessica reyes has a look at new point for commuters especially as we gear up another winter, jess. >> jessica: that's right. the report was done by the federal transit administration. it cites a number of maintenance problems and the named the oak grove by name for not having enough services for disabled riders and many of them have not much has changed since last winters. with the worst of winter still ahead, a brand-new report is out saying the "t" still has a long way to go on a number of safety issues. >> i don't see any difference. i mean, the summer, the last few weeks. they are having always a problem everyday. >> jessica: the report was done by the federal transit administration and it found a number of problems with the mbta specifically its maintenance plan and service providers with disabilities. riders we spoke to say they are nervous ahead of the next few months.

good samaritan that helped her family after a car accident. maria lost control of her car on interstate 495. the car skidded off the road and crashed into a tree. a nursing student saw the accident and stopped to help. she called 911 and kept children calm. >> i'm freaking out and i have the kids in the back and trying to calm the kids down and having another person who understands because she is a mom is really like -- really just amazing what she did for me. >> catherine: she used facebook to find the woman and plan to reunite in the coming days. to beeping sound yesterday morning. he said he knew it was the carbon monoxide alarm because of state-funded fire safety program that he did at school.

bilk ebill cosby now officially been charged with felony assault actor and comedian out on $1 million bail yesterday. he was charged yesterday filed by this woman andrea constand. she was the first woman to come forward and accuse cosby of sexual assault. 50 women have accused him over a period of decades. preliminary hearing is set for january 14th. cobb bees lives in the western massachusetts town of shelburne falls. neighbors know him for years trying to understand what has happened to the entertainer. >> all the allegations doesn't seem like the person they are talking about. >> awful. i feel sorry for the women. >> sara: cosby first moved to shelburne falls in the 1970's

over the weekend i got a lot of lower 40s, couple spots end up stuck in the 30s like worcester, nashua and orange, but i think lower 40s pretty typical if not this time of the year and 34 on monday when more flurries and snow showers, tuesday morning you will wake up to the teens, even around the boston area we only get up to 34 , a little more sunshine though for your tuesday and wednesday forecast. back to you guys. >> sara: all right, shiri. severe floods continue across the midwest this morning. crews in central illinois are searching flood waters right now for two 18-year-old boys who haven't been seen since monday. officials say finding them will be difficult and they may have to wait for water levels to go down to get a better look at the area. seven people have died in illinois since flooding began last week. sara: take look at this scene in missouri. that's a house right there you see floating down the river. watch as it slams into the bridge.
