now to some news from overnight... one person is dead after being hit by a train in pewaukee. it happened near oakton avenue and clark street. police not releasing many details at this point. we'll bring you any updates as they a developing story out of oconomowoc -- police investigating a homicide. officials say the brother of a 34- year-old woman returned home to find his sister dead after ten on monday night. at last check--- no one is in custody. police believe whoever is responsible for the woman's death, knew her. they do not believe there is a threat to the public. police say they are now trying to retrace the last 48 hours of the victim's life. the waukesha county sheriff's office is assisting with the investigation. a milwaukee county judge will

sherman park. right now...there is a restraining order against the sheriff...and the judge ordered the fence be taken down. deandra corinthios is live from the milwaukee county courthouse with more. county executive chris abele wanted the fence down...sheriff david clarke wanted to keep it up. the judge sided with abele in a special session on sunday on monday...parks employees and inmates from the house of fence...while families enjoyed labor day at sherman park. but there was a lot of controversy leading up tot this. the orange fence was put up following the unrest in sherman park...to help close the park early, at 6 pm instead of 10 pm. sunday morning abele ordered it down... then the sheriff ordered it back up... the issue eventually ended up in front of milwaukee county judge david hanscher...who ruled the fence should come down immediately and upholding a restraining order

before all of this occured --county executive chris abele says for two weeks he sent requests to the sheriffs office ... to discuss removing the fence ... but didnt get a response. we sent him a legal opinion from corporation counsel which are the same lawyers who service the sheriffs department both had a written opinion saying, sheriff you dont have the authority on the curfew or the fence and that didnt get it done either. fox 6 has reached out to the sheriffs office for comment ... but has not heard was contemptuous for not showing up to sunday's hearing. today's hearing is at 2 pm. reporting live in milwaukee deandra corinthios fox6 news opening statements begin today in the trial of a milwaukee man accused of setting a fire that killed two children. 27-year-old michael morgan faces charges of two counts of first degree reckless homicide. investigators say he used gasoline to intentionally set a fire near 36th and silver spring last october.

year-old tae-najah morgan were killed. the trial gets underway at 8:15 this morning. i-t-t technical institute closes for good...leaving thousands of students and staff across the u-s without a school. staff is expected to be available on campus today to talk to students about where they are supposed to go from here. angelica joins us now with more. i-t-t tech has been around for 50 years. about 40-thousand students who were online are impacted by this situation...as are about 8-thousand staff members who are without jobs. last week the federal government told i-t-t it did not meet accreditation standards to get federal aid-- so they said the school could no longer enroll new students who rely on it. instead of complying-- the school just shut down. for corrine nimmer-- this is the second time in the same year her school has shut its doors.

wind: sw 5-15 mph it was a cold-case mystery that haunted the state of minnesota for nearly thirty years... a man has now admitted to abducting, sexually assaulting, and 1989. 53-year-old daniel james heinrich confessed yesterday..to taking wetterling near his home in central minnesota 27 years ago. heinrich says he confronted the boy with a gun...and told wetterling's brother and his friend - who were with him - to run away. wetterling's parents - finally faced with heartbreaking details of the little boy's violent death. wetterling says: "i would love to talk to you all. i'm just not ready, yet, because for us, jacob was alive until we found him, until we

as part of a plea deal authorities are not pursuing charges against heinrich in jacob's death... but heinrich did plead guilty to child porn possession and now faces at least twenty years in prison. a pennsylvania judge sets bill cosby's sexual assault trial for next june. cosby's attorney's were hoping to get the judge to throw out days of testimony cosby gave decades ago...during a civil lawsuit filed by his accuser. reportedly acknowledged he gave andrea constand several pills before what he called a consensual sexual encounter. the defense also hopes to suppress a secretly recorded 2005 phone call cosby had with gianna constand, when he described his encounter with her daughter. so far the judge has not made a ruling on the defense team's motions. cosby faces three counts of felony aggravated indecent assault. coming up -- apple unveiling the new iphone today...

the last remaining patient from the orlando nightclub massacre is finally home. the orlando regional medical center confirmed the news via twitter yesterday. in june, a gunman opened fire at the pulse nightclub killing 49 people and wounding dozens more. the orlando hospital says they've treated 35 patients from the shooting...and completed 76 operations. last month, officials at orl announced they will not bill survivors for any out-of- pocket medical expenses. a california man has admitted to murdering an l-a-x t-s-a agent -- almost three years after the shooting. paul anthony ciancia pleaded guilty to eleven federal charges on tuesday, including first-degree murder. the plea deal will spare ciancia's life, but the 26-year-old will spend the rest of his life in federal prison. residents in mexico's baja california peninsula are
