breaking overnight --- one person is dead after being hit by a train in pewaukee. it happened around midnight near oakton avenue and clark street. we're expecting police to release more information later this morning. once again take up the issue of the fence at sherman park. right now...there is a restraining order against the sheriff...and the judge ordered the fence be taken down. deandra corinthios is live from the milwaukee county courthouse with more. county executive chris abele wanted the fence down...sheriff david clarke wanted to keep it up. the judge sided with abele in a special session on sunday on monday...parks employees and inmates from the house of

labor day at sherman park. but there was a lot of controversy leading up tot this. the orange fence was put up following the unrest in sherman park...to help close the park early, at 6 pm instead of 10 pm. sunday morning abele ordered it down... then the sheriff ordered it back up... the issue eventually ended up in front of milwaukee county judge david hanscher...who ruled the fence should come down immediately and upholding a restraining order filed against the sheriff. before all of this occured --county executive chris abele says for two weeks he sent requests to the sheriffs office ... to discuss didnt get a response. we sent him a legal opinion from corporation counsel which are the same lawyers who service the sheriffs department both had a written opinion saying, sheriff you dont have the authority on the curfew or the fence and that didnt get it done either. fox 6 has reached out to the sheriffs office for comment ... but has not heard back. the judge said the sheriff was contemptuous for not showing up

reporting live in milwaukee deandra corinthios fox6 news happening now --- opening statements begin today in the trial of a milwaukee man accused of setting a fire that killed two children. 27-year-old michael morgan faces charges of two counts of first degree reckless homicide. investigators say he used gasoline to intentionally set a fire near 36th and silver spring last october. 10-year-old kevin little, and two- year-old tae-najah morgan were killed. the trial minutes at 8-15. later today we're expecting to learn more about a murder investigation out of oconomowoc. police say the brother of a 34- year-old woman returned home to find his sister dead monday night. police believe whoever is responsible for the woman's death, knew her. at last check--- no one is in custody... but police do not believe there is a threat to the public. officials now say they are now trying to retrace the last 48 hours of the victim's life. it is extremely rare and and is usually someone who knows

we always get to the bottom of it. so we will. the waukesha county sheriff's office is helping with the investigation. i-t-t technical institute closes for good...leaving thousands of students and staff across the u-s without a school. angelica joins us now with more details on what's next. staff is expected to be available on campus today to talk to students about where they are supposed to go from here. last week the federal government told- standards to get federal aid-- so they said the school could no longer enroll new students who rely on it. instead of complying-- the school just shut down. i-t-t tech has been around for 50 years. about 40-thousand students who were taking classes on campus and online are impacted by this situation...as are about 8-thousand staff members who are without jobs. for corrine nimmer-- this is the second time in the same year her school has shut its doors.

26 credits that i just finished off and now i have to start all over again. all over again wisconsin's educational approval board says they've been watching i-t-t for a while now. they say they'll post advice for students on its website. we have a link on fox6 now-dot-com. bad news for fans of a popular milwaukee restaurant - a temporary closure is underway. sobelman's marquette location at 16th and wells has been told to cease operations because the license expired, august 31st. the owners admit -- they neglected to show-up for a mandatory common council committee meeting regarding their license, in july. now, theyll have to wait until the full council meets again september 20th to seek renewal of those licenses. but dave sobelman says, not so fast. i might not shut down. i might refuse. let the sheriffs come in, whatever, i dont know how does this work? they come in, they, if they shut down a restaurant, let em come in, shut us down, look at all my staff members, in the face and tell em, hey, you

we're following breaking news -- milwaukee police tell us they are investigating an armed robbery at the george webb restaurant on oakland and locust. police be related to two others in the city this morning. they say three suspects -- one female and two males were able to get away with cash. the other two robberies took place at the denny's near 27th and howard and at another denny's... near brown deer road and servite dr. a hearing is set for today ...on the fence that surrounded sherman park...in the weeks following the unrest sunday, a judge ruled the fence should be removed...after a dispute between the sheriff and

should find out if the fence will stay down. county executive chris abele said he'd been trying to discuss the fence with sheriff clarke for two weeks..and didn't get a response. there was some back and forth on sunday...the fence was up..then it came down...then it was up once more... but in a special session sunday...the judge sided with abele...saying the fence should be removed immediately...and upholding a temporary restraining order against the sheriff. but after the judge's ruling normal hours resumed at sherman park...and the fence came down on monday. the fence was put up following the unrest that ca involved shooting death of sylville smith... on august 13th judge david hanscher ruled the fence needed to come down to preserve the status quo...and prevent potential disturbances or protests. and judge hanscher was not happy the sheriff didn't show up to court sunday....saying he feels it was a quote "contemptuous act" " as of now there has been no good reason given by the sheriff for closing the park except by doing it by fiat and he isnt the law in milwaukee county. the law is

fox 6 has reached out to the sheriffs office for comment ... but has not heard back. happening today - a milwaukee man accused of sexually assaulting a teen at gunpoint is expected back in court. for about six years, jermarro dantzler ran a group home for troubled teens out of a northwest side house. the wisconsin department of children and the teenage residents after dantzler was arrested for allegedly sexually assaulting a 15-year-old boy in july. today's hearing revolves around perjury charges... for allegedly trying to get other people to testify providing him a fake alibi. the man accused of killing berit beck will be tried again. jurors failed to reach a verdict against 62-year-old dennis brantner earlier this year. now prosecutors say they'll try again. brantner is accused of killing beck back in 19-90.

four minors could face charges after allegedly trying to break into a car. milwaukee police credit an eagle-eyed resident on the citys east side for helping them catch the suspects. it happened around one yesterday morning in the riverview apartments parking lot. a resident says she saw four kids trying to get into several cars. she called 9-1-1 as the kids broke the drivers side door handle off a lincoln... and smashed the window. police say four kids ran away but were later arrested. investigators say they are all boys: a 16-year old, two 14-year olds and a1 sm 'you supposed to be in bed at 1:30, getting ready for school in the morning. but now they are downtown waiting to get let out of jail.' sm 'theyll probably just get a slap on the wrists and let back out to do it again.' milwaukee police say they will turn over this case to the milwaukee county district attorneys office for potential charges in the coming days.
