been shot inside a car. a 34-year-old man died. a 24-year-old year old was taken to the hospital in serious condition...and died this morning. so far no suspects are in custody. police are investigating. the fence around sherman park will stay down.... and a milwaukee county judge has extended a restraining order against sheriff david clarke. it all goes back to sunday. the county executive ordered the fence be taken down. but by the afternoon....the sheriff ordered it back up. that lead to a rare sunday night court hearing. and yesterday -- the pres the dispute clearly runs deep. this is not so much a matter of a fence- this is a matter of a power struggle- let's call it what it is! ... and the sherif that don't like each other.... the debate is not over. there is another hearing scheduled at the end of the month. still to come on wake up --- a celebrity couple not getting divorced. we check in with t-m-z for the latest hollywood headlines.

a beaver dam man also in court today. prosecutors in dodge county say "adam raney" was "considered very dangerous and desperate" when he entered the watertown bank back in july. he was allegedly armed with what looked like a real gun -- but it was actually an airsoft weapon. he also left a backpack on the floor-- claiming it was a bomb. investigators say raney robbed the bank to fuel a drug addiction. he was later arrested in milwaukee. raney faces about 25 charges...and his preliminary hearing is also set to start at 8:30 this morning. some of the highlights of the frank mots kite festival each year are the giant kites that fill the skies. carl is getting a look at those

king, was arrested on campus at arizona state university wednesday afternoon, and cops describe him as a transient. police say they found him with the briefcase which contained all of the jewelry. he's been booked for felony burglary. as we first reported ... cops say the loot -- which belonged to drake's dj, future the prince -- was lifted from one of drake's tour buses parked outside the talking stick arena in downtown phoenix. we're told king has worked for the arena in the past for working during tuesday night's drake-future show. we got video of drizzy going off on someone on his security team after he learned about the heist. ryan lochte suspended for 10 months ryan lochte just got his punishment for his rio gas station hijinks, and we're told the u.s. olympic committee was tough, but not career-ending. usoc-connected sources tell tmz

10 months. there are additional sanctions. we're told the punishment was handed down not just by the usoc but by the ioc and usa swimming as well. the punishment is harsher than michael phelps' 6 month suspension for his 2 duis. the punishment was debated within the usoc, because phelps put people's lives at risk and lochte arguably didn't lie about a material fact. we're told some of the usoc decision makers felt lochte's punishment was too severe. the other 3 swimmers involved in the rio incident were also suspended, but for less time. at least one of them got a 4 month suspension. halle berry divorce put on hold halle berry and olivier martinez raced to the courthose to the punch in filing divorce papers, yet a year later they are poised to dismiss the case and stay married. we found a legal doc in which the clerk in divorce court sent a notice to both halle and olivier, saying they've been asleep at the wheel and done nothing to make the divorce final. the clerk issued an ultimatum ... either do something or the case will be dismissed. we've spoken with multiple sources, on both halle and olivier's side, and they say the same thing. neither is in a rush to make the divorce final, and they're fine with staying

the flooding also forcing a school in mayville to be closed this morning. today crews are cleaning up after rising waters caused saint john's lutheran school to be evacuated yesterday morning around nine. and at the nearby parkview school classrooms were emptied around one o'clock. students were taken to a park pavilion for parents to come pick them up. volunteers and first responders spent many hours filling and piling up both schools from the oncoming water. you can take a look at all of the flooding in our area. just log on to fox six now dot com or download the fox six news app. while you're there you can also send us your pictures of the flooding. we area learning new information about a murder investigation in oconomowoc. 34-year-old christina schuster - was shot in the head in her apartment. her brother found her monday night. now police say

for a friend of hers that they consider a person of interest. investigators don't believe the public is at risk. the trial has been delayed for a man accused of setting a house fire that killed two kids. police say michael morgan set a home near 36th and silver spring on fire back in october. six kids were insid the homee --- two of them didn't make it out alive. the trial was supposed to start yesterday-- but the state's witness didn't show. the judge ruled everyone will reconvene on monday to decide where to go from there. democratic presidential no nominee "donald trump" take part in a "commander-in-chief" forum in new york. angelica joins us from the newsroom with details. and while the two candidates weren't face to face -- they did get to address the issues. both candidates were asked questions in front of an audience made up mainly of military veterans and active service members. they were asked about the most important characteristic people should look for in a commander- in-chief.
