when he was fatally shot by officer timothy loehmann in november of 20-14. loehmann said he thought the gun was real and that the boy looked older. rice's mother asked her city councilman that the gazebo be removed. the family's attorney says it will be taken apart and stored to eventually be part of an art exhibit. a tree will be planted in the new space with a memorial plaque in memory of tamir. the man who jumped the white house fence last thanksgiving.... pleads guilty to a charge of entering restricted grounds. a secret service officer spotted wearing an american flag. caputo made it onto the north lawn before being stopped. the 23-year-old displayed strange behavior, had reportedly written a suicide note, and was sent to a psychiatric facility after his arrest. he will be sentenced december sixth. the government agreed to recommend probation with several conditions... including that caputo stay away from washington and any people or buildings under secret service protection. a pocket dial to 9-1-1... lands two guys behind bars.

northwestern mutual will announce how many jobs it's cutting in "a few more weeks." executives say they still don't know how many jobs will be cut yet. employees say they were sent a video message at the beginning of the month -- warning them of the potential layoffs to come. the company cited the current low investment rates for customers, as a factor in the cuts. northwestern mutual employs roughly 59-hundred people loc and franklin. the company's goal: decreasing the size of the waistband... not the size of its profits. the big upheaval coming to a popular health company... coming up. and speaking of dieting... burger king is adding some flavor to one of its most popular items. and it's that time of year again - we'll tell you when olive garden's pasta

also happening today: testimony continues for the man charged in connection with a fire that killed two young children. opening statements were made yesterday in michael morgan's trial. prosecutors say the fire was intentionally set by morgan in milwaukee had been suspended since last week-- after a witness for the prosecution never showed up. the witness was eventually found -- and he's being held in the milwaukee county jail on unrelated charges. morgan is facing numerous charges including two counts of reckless homicide. meanwhile... a court hearing will be held this morning regarding the future of a troubled smoke shop in milwaukee. police say they've been called to this tobacco shop at 27th and kilbourn more than 400 times in two and a half-years... and according to court documents... the city wants to get rid of

now... alexia dailey is fighting in memory of her daughter... to protect others from domestic violence. ruben garcia is serving 2 life sentences for killing 5 month k-eye-ree kairii .. and family friend-- paul koo- har-check kucharczyk. but he has a chance to be released after 60 years... that's one of the reasons kairii's mom says she's working on 'kairii's law'--- something she hopes will change sentencing in domestic violence cases going forward. it just makes me feel really proud, and its not like i want to boast about it or anything its just like it even the tiniest little difference she's also working to get kairii's last name changed. the request for the name change has been filed. dailey's attorney says they need to focus on that first, before shifting their focus to kairii's law. there's still a long road ahead.. and it might not be an easy one.. but dailey says it's one she's willing to take on. developing now - a judge has

wisconsin - after steven avery's request for extensive testing in his homicide case. avery claims manitowoc county officials framed him for teresa halbach's death in 2005. court documents show a judge is replacing manitowoc's district attorney because of a conflict of interest. the new attorney is norman gahn -- a former milwaukee county assistant district attorney. the news comes the same day steven avery's former attorney speaks at marquette university. dean strang reacted to the wisconsin attorney general's decision to keep brendan dassey in prisn fox6's jonathon gregg has more reaction from strang. in august a federal judge ruled the confession of a 16 year old brendan dassey was inadmissible because it was coerced by investigators. "whether he came to the right or the wrong conclusion, i think all those things are true about it, it was good judicial handy-work." brenden dassey would be set free within 90 days unless the state attorney general filed an appeal, which brad schimel did

momentum preserve the status quo.." strang says he was not surprised by the schimel's decision to appeal the decision to free dassey. "the state often is very interested in preserving the status quo and the status quo right now is that brendan dassey is convicted, he is in prison and this sort of inexorable pressure to keep him there i think makes it no surprise the attorney general's office sought to appeal." strang never represented dassey..and hasnt represented steven avery for a decade but says theres a dasseys conviction or any other conviction for that matter. "it means acknowledging a significant wrong or a mistake, which is hard. it means potentially putting a victim's through another trial." the u.s. circuit court of appeals will have the next say. "in the end you come down one way or another and that's always contestable a higher court or different court may see it differently or may

dash cam video was made public. police superintendent eddie johnson has moved to fire 4 officers and a sergeant involved in the case. the wells fargo executive who oversaw the division accused of creating fake accounts... is set to retire with millions of dollars. 53-hundred employees were fired for creating millions of unauthorized accounts in customers' names. the executive in charge of that division... carrie tolstedt... is retiring later this year with 124 million dollars. wells fargo is being fined 185 million the company won't comment on whether the bank is planning to take away any of tolstedts bonuses. investigators now say they are investigating a fire at a florida mosque as a possible hate crime. a fire broke out early yesterday morning at the mosque formerly attended by the orlando nightclub shooter. investigators say video surveillance shows someone approaching the islamic center of "fort pierce"

officials say given that the attack happened around the 9-11 anniversary and the start of a muslim holiday... eid al- adha they believe it could have been a hate crime. hillary clinton now says she "got dizzy but didn't lose consciousness" on the way out of a 9/11 memorial sunday. she was diagnosed with pneumonia last friday, but that wasn't made public until sunday's episode. and now she says the reason for that: she "didn't think it was going to be that big of a deal." but as fox6's theo keith reports -- it's still causing issues for her campaign. monday explaining what you're seeing in this video.it shows clinton unsteady on her feet. aides had to help her into a campaign van. a spokesman says she became "overheated,"at a september 11th memorial. hours passed, before the campaign said that clinton had been diagnosed with pneumonia two days before. david axelrod, a former aide to president obama, tweeted, "antibiotics can take care of pneumonia. what's the cure for an unhealthy penchant for privacy that repeatedly
