we start at eleven with breaking news... president-elect donald trump supporters have filed a federal lawsuit to stop the election recount in the lawsuit was filed last night in madison by the great america pac, the "stop hillary pac" and wisconsin voter ron johnson. they argue that the recount threatens the due process rights of johnson and others who voted for mr. trump. the lawsuit also says that errors are likely to happen, since election officials are rushing to meet the december 13th deadline. meanwhile, the election recount has already started statewide. day two of the recount is

a slow start in some locations. and the clock is ticking... for election officials to get the job done. our deandra corinthios has more from the elections commission warehouse. ballot counting begins at 8 am 8 absentee ballots in milwaukee county were rejected due to errors. and...one of the voting machines had to be fixed. thursday elections commissioners decided to publicly test only two of the 30 voting machines being green party candidate jill stein objected. milwaukee county commissioners then decided to test all 30. one of them was broken, and had to be fixed that's why they didn't start counting votes until three hours past the original start time. the first city of milwaukee ballots finally got fed through the machines just after noon. suburban ballots, two hours later. besides 130 inspectors, representatives from the republican, democratic and green parties were also here to challenge questionable ballots. improperly filed " hillary clinton trails donald trump by over 22,000 votes. there is no indication the numbers have shifted very much after the recount's first day. the deadline to finish the recount is december 12 reporting in milwaukee deandra corinthios fox6 news. meanwhile, workers in waukesha county stayed until midnight feeding ballots through the machines. workers spent most of the day yesterday validating absentee ballots, and the election day-- making sure everything is filled out correctly. the county clerk says she hopes by solving problems early in the process, they won't be repeated later. i think kind of just getting the steps understood among the board of canvassers, its a very complicated process. i think as we resolve issues early in the process, they will not occur again and the timing and speed will pick up. waukesha county workers continued the process this

new at eleven... police are investigating a sexual assault on the city's south side. officials say a woman was reportedly sexually assaulted near clement avenue and warnimont avenue. it happened around 5-30 last night. few other details are being released at this time. police continue to investigate. this morning...to discuss new documents that show milwaukee county paid 11- million dollars in pension payments to retirees last month. it was to make up for underpayments made to county employees who have already retired. and they're due another 6 million. county chairman theo lipscomb says county executive chris abele acted too slowly. abele says ...he could only act once the i-

supervisor is calling for the resignation of milwaukee county sheriff david clarke. in a statement, supervisor "supreme moore omo-kunde" says it needs to happen before quote "more people die". he says four people have died in the milwaukee county jail in the last six months-- including a newborn baby. the child's mother has sued the sheriff's office. omokunde claims clarke has "abdicated his responsibility to hold his officers accountable." in response the sheriff released supervisor's name to a comic book character -- and saying the supervisor is upset that clarke helped donald trump get elected president. in other news-- he spent time behind bars nearly 6 years ago. now a milwaukee police officer could be getting a promotion. the officer was arrested for o-w-i with a child in the car. fox 6's ashley sears reports it's up to the fire and police commission to decide

county-- in november of 2010--- milwaukee police officer john corbett--is seen on dash cam-- only this time, he is not the one in uniform. corbett was pulled over for drunk driving. his 13-year-old daughter was also in the car. a police report says she had been driving only minutes earlier. corbett was suspended from the milwaukee police department. he pleaded guilty to o-w-i charges--lost his license for 15 months and served 30 days in jail with work release. now, 6 years later--saergent he is up for a promotion with the milwaukee police department. in a letter written to the fire and police commission--chief ed flynn says those up for a promotion "were put through a timely internal vetting process and "the members' entire record was reviewed..." in a statement to fox 6, an m-p-d spokesman said sgt. corbett has not been in trouble since 2011--where he served a 60 day suspension from

and " as a result of the suspension, he lost approximately $17,000 in pay. " adding since completing the suspension and criminal punishment: "... he is relieved from further sanctions related to this incident." now, it's up to the fire and police commission--to determine what his past means for his future. the fire and police commission will decide on the promotion at a meeting monday morning. to prevent her sons child abuse... is now dead from a suspected drug overdose. 25-year old megan scott was the mother of three- year- old "aiden archer". scott and her then boyfriend, 28-year old maurice snyder faced multiple charges for aidens death. the boy died last year in june, after significant trauma to his head and body. when police were called to this house, officials say needles were found inside. the child-abuse awareness group 'guardians of the children' has

police say joe mcknight died in an apparent road rage incident. witnesses saw mcknight and another man arguing... before the other man fired at mcknight. that man has been identified as ronald gasser. mcknight... who was 28 years old.... played in the n-f-l from 2010 to 2014 for the jets and chiefs... and played for u-s-c in college. for the first time in nearly two decades... chicago has hit 700 homicides compare that to 2015... when there were 468 murders in the windy city. the number of murders in november alone doubled from last november. police superintendent eddie johnson says poor education and lack of opportunities are a big part of the problem. most of the crime... occurred in districts on chicago's south and west sides. ...eleven people-- now confirmed dead following raging wildfires in

rescue crews have been working around the clock, putting out brush fires and searching for survivors. alice hagler was one of those people killed in the fire. her family says it all happened so quickly. lyle wood, mother was killed in wildfire: "things went from the winds picking up to the last phone call she made to my brother was the fact that she was really scared and frantic because the house was actually on fire at that point. more than 700 buildings are destroyed or damaged. evacuated monday... many with just the clothes on their backs. the mayor of sevier county says some businesses in the area have reopened. adlib to weather december is bringing us a burst of some cooler and more seasonable air. highs today will stay in the 30s

wisconsin voter ronald johnson. they argue that the recount threatens the due process rights of johnson and others who voted for mr. trump. the lawsuit also says that errors are likely to happen, since election officials are rushing to meet the december 13th deadline. meanwhile, day two of the election recount is happening right now statewide. counting is underway in milwaukee county and election lost time. the first ballots from the city of milwaukee werent counted for more than three hours yesterday. our deandra corinthios has more from the election commission warehouse with the details. in milwaukee county, a petition by the green party to test every voting machine slowed the process. once on track-- almost no problems with ballots were found. in the city of milwaukee, workers recounted 30-thousand ballots and found one or two errors. in the suburbs, the election

finding errors. that means the most the margin could have changed so far is eight. far from the 22,177 that president-elect donald trump won by. this all came after all the milwaukee county voting machines were tested. a jill stein supporter objected to the election commissioners decision to only publicly test two of the voting machines being used in the recount commissioners came back and decided to test them all. one of them was broken and had to be fixed. "theres nothing like a 100 percent quality check. if youre in a factory and theres a problem, everything " the recount starts back up again at 8 am. the deadline to finish is dec 12....and they plan to work every day except sunday leading up to that date in milw dc fox6 news each county... going at its own pace... when it comes to counting votes. the recount got off to a late start in waukesha county... where the first ballot wasn't fed through until

"ready, here goes the first one... yay... woo hoo!" workers took a break for the night around midnight. the group returned to work about 9 this morning. county clerk kathleen no-vack says she hopes by solving problems early in the process... they won't be repeated later. in dodge county... paid volunteers counted ballots by hand... completing 18 first day. workers found three absentee ballots that were not in proper envelopes. those will not be included in the recount. overall, dodge county clerk, karen gibson, says things are going well. she says the response from volunteers was outstanding. but she still thinks she will need until the deadline - december 12th - to finish counting. in our area -- as we mentioned-- milwaukee and waukesha counties are machine- counting votes.

says his 13 -year-old daughter was in the car and she had been driving earlier. corbett was suspended from m- p-d for 60 days. he served 30 days in jail with work release-- lost his license for 15 months-- and lost 17-thousand dollars because of the incident. the fire and police commission will meet next week to determine whether corbett receives a promotion to lieutenant. a little boy died in a horrific now, aiden archers mother is dead of a suspected heroin overdose. she was charged in his case-- with failure to prevent the abuse. fox6s bret lemoine with the latest chapter in a story that enraged south east wisconsin. kp 'we knew that they were on heroin. but we were still surprised.' the milwaukee county medical examiner confirms 25 year old megan scott died wednesday of a probable drug overdose. members of the group, 'guardians of the children,' who aim to combat

archers story every step of the way. kp 'we want justice for aiden - and im not sure thats the type of justice were talking about.' scott, and her then boyfriend, 28-year old maurice snyder faced multiple charges for the death of scotts son, 3 year old aiden. the boy died in june of 2015 after significant trauma to his head and body. aiden was also non-verbal and was diagnosed with mild autism. sa 'i hope that they dont let this guy back out into society... or his mom .' we spoke exclusively with steven archer, in april. investigators say aiden suffered a skull fracture... appeared to have strangulation marks around his neck... and at least 11 distinct human bite marks on his arm, hands, shoulder, groin and buttocks. sa 'i will never forgive them. i will never forgive them. theres a lot of anger - rage. i do my best to control myself.' when police were called to this house, officials say needles were found inside. prosecutors said both scott and snyder were heroin users. court records show scott posted a 500-dollar cash bond a week ago and was released from jail. she had
