it's grainy ... and graphic. the family has said they want the public to see this video. but we do want to warn you, it is disturbing this is what transpired between the officer and jay anderson.you are looking at just released dash cam video. this is back in june.. officer joseph men-sah was checking on a suspicious vehicle around three in the morning in madison park in wausa found jay anderson sleeping... a gun next to him. he radioed that information to dispatch -- asking for backup. a minute after that jay anderson would be dead. officer mensah says during that time -- he told anderson to put his hands up and at first anderson listned. but then the officer says he dropped his right hand three times. in the video you see his right hand go down then back up and then back down ... and that is when the officer

anderson 5 times in the head and once in the shoulder. the medical examiner found anderson was legally drunk and had marijuana in his system. under that statue -- the district attorney found officer mensah acted in self defense and cleared him of any wrong doing.mensah is expected to return to active duty soon. jay anderson's family is in disbelief over this decision. they say anderson was groggy and was not reaching for the gun. officer joseph mensah has been with tosa p-d since january of 2015. last july ... he was cleared in another deadly shooting. he was one of two officers who shot and killed a man armed with a sword. mensah returned to work in august and remained on duty until the shooting of jay anderson this past june. he has been on administrative leave since then.

story since june. you can find all of our stories on our website ... tmj four dot com. right now.investigators say the deadly warehouse fire in oakland could turn into a murder investigation. the question still stands: who is responsible. federal agencies are sifting through the warehouse for clues.the warehouse acted as an art collective which hosted a dance party the night the fire broke out... killing 36 people. the include individuals, like the building owner and founder of the art collective, as well entities, such as the city of oakland, charged with enforcing the building and safety codes that many claim were violated before the fire. we're also learning this morning that oakland planning officials opened an investigation last month after repeated complaints about the warehouse. state election officials begin another day of recounts this

far there has been no significant issues ..both milwaukee and waukesha county officials said they expect to finish their recount before monday's deadline. the milwaukee county district attorney is reviewing one case of possible voter fraud -- where someone allegedly voted both by absentee and in person. the state republican party issued a statement about the recount, saying, in part"as the recount continues and the margin doesn't change, hillary clinton and her allies are running out of excuses ... through their empty rhetoric and pathetic stunts once before ... ... and the recount will be no different." this month marks six years since wisconsin's law banning texting and driving went into effect. pete zervakis is live with more on how local teens are being encouraged to follow that law... according to at&t... research shows seven in 10 people use their smart phones while

our little taste of snow is mostly melted off already this morning... but out west they're getting pounded.take a look at this live picture from the airport near seattle.... where dozens of flights are cancled becuase of a winter mix that hit the area over night. right now drivers are dealing with icy roads.... and below freezing temperatures. it is expected to clear up by later this morning. nothing worse than driving in snow... and feeling your car sliding out of control. it's something we here in wisconsin appreciate all too well. here's the scene in montreal.

department of transportation's budget request... which right now is about 1-billion dollars more than what the state says it can afford. to make the case for more g towards roads... assembly speaker robin vos released this video. it shows vos riding - in a burlington rescue squad ambulance bouncing along on the streets of racine county. vos's cousin works for the ambulance squad and invihi the speaker and other republican leaders in the assembly have called for at least considering an increase in the gas tax to help plug the hole in the transportation budget. but yesterday... republican state senators duey stroebel and chris kapenga came out strongly against any type of tax increase. they say there are other ways to increase funding towards roads. the governor released a statement coming out strongly against a gas tax increase. saying he and other republicans were elected in
