marijuana clinics will open soon. fox 5's bob barnard starts off the edge. >> it's been a long time coming. medical marijuana was given a thumbs up by district voters 15 years ago, but now it's about to become reality, but only if you live in the district and get a doctor's order. occupying that distinguished looking bright blue storefront on north capitol street just off new york avenue is a company called capital city care getting ready to open its doors in a matter of weeks what should be the first of four businesses in the city to begin legally selling marijuana. >> some of them will be open by early spring and the rest of them will open throughout the rest of the year, at which point qualified patients who have a doctor's recommendation will be able to purchase marijuana from these stores and take it directly home and use it in their homes. >> reporter: but only if you live in the district and only if you have any one of the four qualifying conditions,

glaucoma, hiv aids, cancer and multiple sclerosis. >> we really thought look and hard about this, but there's so many people out there who have chronic illness and we thought this was a good thing for the residents of the district of columbia. they convinced us that this is working in other states. so we're going to give it a try in the district of columbia. >> reporter: marijuana is still outlawed by the federal government but now legal for medical purposes in 18 states, approved by 69% of district voters in a referendum 15 years ago but delayed by congressional concerns and the need for tight restrictions. morgan fox is with the d.c.- based marijuana policy project. >> so it had to be very, very tightly structured in order to make sure that it did not draw the ire of congress, but now that it's going into effect i think it provides an excellent example to show how well these systems can work. >> reporter: the program will be monitored by the d.c. department of health, four dispensaries and six cultivation centers where the marijuana will be grown are to

be licensed by the city. ward 7 council member yvette alexander is chairman of the council's health committee. >> it's not a step towards the legalization of marijuana. it's solely for medicinal purposes. >> something that was not unanimously applauded during public hearings before the d.c. council. some who live in the district expressed great concern about having marijuana sold legally in their neighborhoods. a long and bizarre crime spree in northern virginia is over. arlington police arrested three teenagers for shooting the windows out of hundreds of cars. oneome of the vandalism on a security camera in november. you can see someone drive by the house in fairfax county, stop, back up and fire right into the rear windshield of a parked car. police say this happened at least 250 times all over northern virginia over the course of several months. 19-year-old alexander chase, 18- year-old ricardo reynoso jr.

and 18-year-old william romero from arlington face charges. the news edge in virginia, a once convicted killer scheduled for release this afternoon from prison will remain behind bars. a federal appeals court ruled justin wolfe should stay in prison and the court ordered a new hearing. wolfe was convicted of arranging the murder of his marijuana supplier in 2001, but the case was overturned in 2011 by a district judge who said prince william county prosecutors held important information and evidence from defense lawyers. the judge ordered prosecutors to retry wolfe in four months or release him. last month a judge ruled prosecutors didn't meet the deadline and ordered him free, but the appeals court stayed the ruling. >> we would have preferred for it to not be stayed, but we have of reason to be hopeful. we believe judge jackson's order was correct and we're confident that that ultimately will be the decision of the court of appeals as well. >> tonight fox 5 spoke with the father of the murder victim,

danny petrole. dan petrole sr. says he believes justin bowl was involved in his son's -- wolfe was involved in his son's murder. a former fbi agent will be sentenced tomorrow for killing a maryland teenager while driving drunk. last fall adrian johnson from prince george's county was convicted of homicide by motor vehicle while intoxicated along with several other charges for crashing into 18-year-old lawrence garner's vehicle killing him and seriously injuring his best friend. johnson faces up to 13 years in prison. for the 113th congress it is the time to rise. >> changing of the guard on capitol hill today as a new congress was ushered in. john boehner reelected speaker of the most diverse congress in american history that includes 101 women, a new record. the house and senate holds 43 african american members, 31 hispanic members and 21 asian members.

the house tomorrow will vote on sandy relief money and consider the rest of the relief bill in two weeks. as the top political leaders were sworn in today, there was a changing of the guard in virginia. democrat tim kaine replaced democrat jim webb in the senate. fox 5's john henrehan was there. >> reporter: former virginia governor tim kaine walked toward the u.s. capitol flanked by current u.s. senator mark warner and by outgoing senator jim webb who chose to serve only one six-year term. on the steps of the capitol kaine joined the lawmakers who assembled to offer an emotional welcome to illinois senator mark kirk who suffered a severe stroke nearly a year ago. vice president joe biden and west virginia's joe manchin helped senator kirk slowly ascend the 45 steps of the ceremonial staircase that leads to the senate floor. [ applause ] >> reporter: the assembled

legislators spontaneously broke into applause several times at the return of senator kirk. inside the chamber the vice president administered the oath of office to small groups of the newly elected senators including virginia's tim kaine. >> and that you will faithfully discharge the duties of your office upon which you're about to enter so help you god. >> i do. >> congratulations, senators. >> thank you. [ applause ] >> reporter: later virginia's newest senator mingled with supporters in a reception. tim kaine who worked with a republican dominated legislature as governor of virginia says he's coming to the congress to build bipartisan bridges but with his eyes wide open. >> that means over the next 60 days with a ticking clock on sequester and on the debt ceiling we've got to continue to talk about budget and physical soundness. >> reporter: during the campaign you expressed confidence you could reach across the aisle, but a majority of republicans on the house side did not vote for the compromise. >> it is true a majority didn't, but 80 did and we

seems photographers will do anything these days to get a picture of a celebrity. those photos bring in a lot of cash but can also bring a lot of trouble. fox's adam housley explains. >> get that shot no matter. what. >> reporter: in hollywood a picture these days isn't worth a thousand words, but potentially hundreds of thousands of dollars. famous faces are big business and the paparazzi is willing to do almost anything to get these shots. following the recent death of a photographer killed by a car while taking a picture of justin bieber's white ferrari, the director of a new documentary called celebrity about the relationship between stars and photographers wondered how far is too far? >> why does somebody have to die for everybody to all of a sudden be aware of how bad something is? i don't know if it's going to get better. what do we need, another really bad tragedy to have some laws put on the books? >> reporter: the film includes impassioned opinions from some of hollywood's biggest stars.

>> someone jumping over your wall, this is your life. >> when all of a sudden you're hearing rumors that are not true on a cnn crawl, you sort of go this is cnn. >> it's a scary feeling. >> technology has changed the business and the landscape of celebrity and fame. they can't get it quick enough now. we are so obsessed with celebrities. celebrities are sort of like the disease of our culture right now. they can't get enough of it. they want it on their phones and on the internet and instantly. >> reporter: although a paparazzi law is in place in california it's being challenged in the courts meaning it's basically pictures as usual. >> i certainly think that being a celebrity, a public person that people are interested in, means that they're going to want to know all about you and the minutia of your daily life is sort of up for public consumption. that being said i've been witness to personally people seeking that information in a way that goes against the laws

of 25 reported falling asleep while driving in the month prior to the survey. no. 3, a heads up, subaru recalling 634,000 vehicles due to a lighting issue that could result in smoke or fire. the recall affects some 2009 to 2012 foresters, all 2010 to 2012 legacy and outbacks and some 2006 to 2012 tribecas. no. 2, 150 years ago this week president abraham lincoln signed the emancipation proclamation freeing the country's slaves. you can see the first draft of that historic document at the library of congress. it's on display there through february 18th. no. 1 tonight, 600 to 800,000 people are expected to fill the national mall to witness president obama's second inauguration later this month. organizers say that's fewer people than the 1.8 million in 2009, but some of those people who were simply overwhelmed by the 2009 crowds will see 2013

as a second chance to witness history and brian, that's a look at tonight's fox 5 top five. got a nice dry stretch if you want to wash the car. >> you can absolutely do it. there will probably be a long line, but temperatures will be on the cool side the next couple days. maybe next week we can push our way toward 50 degrees, not bad at all for january. let's look at what's going on out there tonight. what's going on out there is a big drop in temperatures as we did last night. we're likely going to see some places bottoming out in the upper teens. we certainly had a cold start today, too. we didn't hit 40 degrees in the district. 38 degrees was our high. it was only 25 for the high temperature in boston. so real cold up here through the northeast, buffalo coming in at 31, chicago only 29 for the high temperature today and 19 in international falls. so much of the country really seeing this cold, but the worst of it definitely locked up

through the northern plains where we would expect. it get to phoenix, 63, san diego 67 degrees. so the warmest spots no doubt florida once again with tampa at 74 degrees, but most of the country pretty chilly and tonight we've got a lot of that chill right over the district. 32 degrees is where we're at now, looking at 21 for manassas and culpeper, gaithersburg down to 28 degrees, baltimore 29 and it looks like we'll be in similar territory to last night. thought i'd widen out the picture to show you we have some of the coldest temperatures around, pittsburgh 28, binghamton 24, new york city 21 and chicago 20 degrees, very cold. we'll have a cold start overnight because of the temperatures that will drop into the upper teens and low 20s. in the district 29 degrees and tomorrow is another nice great day, probably a little warmer getting up to 42 degrees. we add in a little breeze from the west 10 to 15. that can feel chilly when your temperature is only 42 degrees.

i have a feeling there will be a bit more sunshine tomorrow than today. check out the planner for friday, chitter 1 degrees at 8 a.m. -- 31 degrees at 8 a.m., but some of the suburban areas will still be in the low and mid- 20s, by the noon hour 39 degrees and 4:00 40 degrees with plenty of sunshine. temperaturessed an the region tomorrow, 42 dulles, 38 for martinsburg and 36 in hagerstown, 33 for cumberland, 37 winchester and playing a bit of a breeze, not a wind, but a noticeable west breeze. check out futurecast because we'll roll through friday on the dry side and the only thing that will change saturday, notice the deck of clouds that starts coming through in the late evening and into the overnight hours. so that will protect us from getting real cold overnight, a little mountain snow trying to develop sunday, but it looks like our sunday will be dry. that's great news for the skins and their fans. it looks like that temperature will be fairly comfortable as well. your fox 5 accuweather seven-

day forecast, a couple more days in the low 40s and real cold nights. check this out for sunday, 46 degrees. i think kickoff temperature will be 45 for the skins and seahawks, monday about 44 degrees, still thinking we keep it dry and close to 50 tuesday and wednesday, but i would not be surprised if some showers tried to work their way into the forecast wednesday and we expect a few around thursday as well. we'll keep an eye on the middle part of next week and lindsay murphy is here to keep an eye on what's going on as we get ready for that big playoff game sunday. here's her report. >> thank you. the seahawks defense knows they'll have -- the seahawks defense knows they'll have their hands full on sunday. skins defense has a huge task ahead, russell wilson drafted in the 3rd round out of wisconsin was thought to be bakeup to matt given, but wilson was -- gwynn, but wilson

a d.c. woman says she's the most extreme redskins fan in town and if you don't believe her, just look at her hands. pepper cox has been growing out her fingernails for 11 years and every year she paints them burgundy and gold. pepper and her names have supported the skins even through hard times. this sunday she'll be watching them play the seahawks from her friend's house.
