so far most of the activity has been in the north bay where we saw some cells cross earlier in richmond out towards concord and we have got a couple more headed our way out there this evening. we are seeing a bit of a change in our position in this pattern if you will. the river of warm moisture has moved off to the south and as we take a look at the satellite image here which we will go to right now you see that that extensive band extends 1000 miles wide and within that band there is definitely heavy rain which has been wandering around the bay area on and off through the week. we got hit with it this morning, left an inch or two in its wake. now we are kind of on the northern edge of it as that river of moisture sinks to the south leaving us in the cold air mass behind it which in this kind of an unstable pattern is where you tend to see the scattered showers and isolated thunderstorm pattern. that will be tonight into tomorrow. then come wednesday we will see moisture move our way with steadier rain expected. as i said earlier we will hang on to the scattered activity. could be mode

the judge in the richmond high gang rape case ordered the youngest released from custody. he had harsh words for cody smith. the prosecutor accuses seven people for taking part in the rape of a 16-year-old girl outside the richmond high school homecoming dance last october. when police found her, they say she was in a coma and nearly dead. the prosecutor said it was the most difficult case of her 25 year career. >> the forensic evidence was extremely complicated and then the fact the witnesses were so very uncooperative. >> they downgraded charges against a 23-year-old. five other defendants could face life in prison. >> a major setback to tell you about for the city of oakland and its plan to issue permits for four large pot farms. under pressure from the u.s. justice department, the city council voted last night to suspend the permit process. the move comes after oakland city attorney warned the council the law allowing the pot farms probably violates state and federal laws. they expect to make changes to the ordinance and reexamine the issue in early february. >> govern

rodriguez told him he, along with defendants cody smith, man well ortega and torrentes were outside richmond high at a table drinking when the victim came over. rodriguez described lots of physical touching between the men, and the victim. smith said rodriguez admitted touching her vagina. he says elvis placed his hands on her breast and cody smith took part in the touching. he said throughout this time, the victim did not object to any of the touching. but at a certain point, smith says rodriguez described the victim walking away, vomiting and collapsing. at this point, rodriguez says elvis leaves the scene, and two hispanic men described as the peacoat mafia arrived. he said the victim was naked and screaming when the two hispanic men, as well as ortega had sex with her and urinated on her. rodriguez told detective smith, the way it looked, they were raping her. at this point, rodriguez says he decided to leave, because he didn't want to be part of it. detective smith admitted that rodriguez's story changed several times, and that he didn't believe that he was always telling the truth. it'

a judge is expected to decide the fate of seven men and boys accused in a brutal gang rape at richmond high school. christie smith is live in martinez. the judge will weigh in on whether they will stand trial. good morning. >> good morning. attorneys are expected to present oral arguments in the case and as you said, the judge will decide which of the seven defendants will stand trial and on what charges. judge gregory expressed concern about two of the defendants and concern about evidence on a 23-year-old richmond man involved. the oldest defendant is 44 years old. what's become a quite high profile case. police said it was october 2009 when a 16-year-old girl was raped, beaten and robbed outside of a richmond high school homecoming dance as a group of people watched. the judge seems most concerned about the 16-year-old. he ruled that his police interview is not even admissible as evident because he believes his rights were violated when police ignored the 16-year-old's request to remain silent. the defendants could face 26 years and all the rest up to life in prison if convicted. th
