elizabeth: congresswoman, how does in terms of your contacts in new york state and also in d.c. how does cuomo politically survive this? the allegation of one of the accusers, a former aide to cuomo, that he globed her under her blouse, it was sent to the albany police department earlier this year, the police spokesperson at that time, congresswoman said this may have risen to the level of a crime. so how can he hang on here? >> well i don't think he does. i was on your show a couple months ago saying he should resigned over the nursing home scandal. now you have every single member of congress representing new york state, plus the president of the united states, plus a little while ago, even own the political side his state democratic chairman saying he should resign. 82 members about the state assembly which will vote to impeach. you only need 76 votes, a majority. i don't believe the governor does survive this. i said all along he was going to go whether by resignation, criminal conviction, impeachment or at the ballot box next year but i think his days are certainly numbered

new york state assembly speaker carl heastie shut down the request saying he's not cutting a deal. the federal action filed by virginia giuffre accuses prince andrew of sexually abusing her when she was 17 years old. according to nbc news reports, the suit claims that 20 years ago epstein and his longtime associate maxwell engaged sexual encounters with prince andrew and knew she was a sex trafficking victim at the time. it was filed under the act. representatives for prince andrew declined to comment though he has previously denied the allegations. maxwell's attorneys did not immediately respond to the request for comment.

more than 15,000 people died in new york state nursing homes. what do you view as happening next here? this is not a man who is conditioned to giving up to walking away, governor cuomo often believes that he can just walk through the fire and come out the other side. what happens from here? >> there's potentially several things that could happen civilly, and politically. you have the civil implications because he engaged in misconduct, particularly with two women where he touched their intimate parts, that is a violation of criminal laws in new york. there's civil implications, so when you engage in that sex-based pervasive and severe workplace harassment, unwelcome misconduct, and touching, that is a violation of title 7 and a violation of federal and state laws in new york. in addition to that, and i think this is the most egregious part, too, and it really belies what he said in his response, is the failure to follow the old governor's policy, in the one case as pointed out in the investigative report, one lady actually did make a report, and

state troopers, occurred at the governor's former home with his ex-girlfriend in mount kisco, new york. that's in westchester county, rocca's purview. so everything's changed but nothing's changed going forward. the timeline here today, chuck, first received word from a senior law enforcement official approximately 9:15 this morning that the governor was in his helicopter en route to new york city and would make a statement around 10:30. then that kind of changed as rita glavin as you suggested came forward and offered up some claims about the attorney general's report. you see her there on screen. a number of those claims we were able to fact-check in real time as either not being consistent with her prior statements or not being consistent with the record. the governor himself for the first time addressed the allegations brought by trooper number 1 who has still not been publicly identified talking about his inappropriate touching of her though he suggested the efforts to get her on his protective detail were an effort to diversify the state police. that does not bear out according t

. >> joining us new york state senator todd kaminsky, a former federal prosecutor and former acting deputy chief at the u.s. attorney's office for the eastern district of new york. he is now running for district attorney in long island's nassau county. first of all, is the governor's team likely to get access to trans scripts as the process plays out? if so, how soon? do they have a point? >> it is important to remember this isn't a court of law. this is a process that is now headed toward a vote by the assembly of impeachment. i think the problem with the governor's position with his attorneys is, you know, you can certainly try to poke holes in a given story. you can say you weren't treated fairly, but the evidence that the attorney general presented and the picture that her investigators painted was really overwhelming. we are talking about 11 victims, corroborating witnesses, other types of evidence, and it all really painted a damming picture. i think you are asking

for more on this i want to bring in new york state assemblywoman catalina cruz. thank you so much for your time. impeachment for any government body is a long and often expensive process. the governor, he's going to resign in 13 days. do you believe it is still necessary now that governor cuomo has resigned that he still be impeached during that window? >> i do think the important question sheer what do the people of new york need? we'll be meeting as a committee on monday to discuss what steps to take next. there's still an investigation in process by our judiciary committee. there's a report that needs to come out, and what do we do with it? do we move forward with an impeachment and then all it does him from ever running again and we're spending money and time and resources, or do we end this now and allow our state to heal? i think it's a decision that we have to make as a group. >> susan del percey who served as an adviser to governor cuomo, she warned that this might not

now, let's look at new york state law. the law that seems most applicable here is forcible touching. it's a crime under new york state law to touch intimate parts of another person for the purpose of degrading or abusing such person or for the purpose of gratifying the actor's sexual desire. a couple important things to know about this law. first of all, it's a misdemeanor. people with no prior offenses do not go to prison. the statute of limitations here is two years which brings us back to august of 2019. most or all of the conduct set forth in the report has happened within those two years. finally, this is so important to keep in mind, talking about a criminal charge, the prosecutor has to show proof beyond a reasonable doubt not just it's likely, not just it's very likely, beyond a reasonable doubt. >> a lot is intuitive. you can't touch people where they shouldn't be touched. bottom line. what incidents in this report then fall under these potential crimes? >> yeah. so there are 11 complainants in the report. three g

it has been flying over the new york state capital of albany. andrew cuomo remains holed up in the governor's mansion trying to figure out how to stop an impeachment probe bearing down and impeachment is possibly coming within weeks. also four separate criminal probes into sexual harassment charges and allegations brought by the new york state ag. polls show the majority of new yorkers including democrats say he should leave. joining us congresswoman claudia tenney, and a member of the new york state assembly, jared gandolfo. thanks for joining us. what is the update on the news that we broke last night that the legislature will impeach cuomo? there is a deadline he has to respond by august 13th. what is the update now? >> so that was reported today that the assembly judiciary impeachment committee did set a hard deadline for the governor and his team to provide documents to their defense. which is a little frustrating because a lot of us felt like this impeachment committee was a way to buy the governor more time. they said it would take longer

and joining us now is jay jacobs, new york state democratic party chairman. thank you very much for joining us tonight, mr. chairman. really appreciate it. have you spoken to governor cuomo about this? >> yes, i did. i spoke with him today. i would not have issued that statement without talking to him first. >> and how long was that conversation? what did you say? what did he say? >> i would say it was somewhere in the neighborhood of about 15 minutes. and i will give you a brief on it rather than going into the detail of who said what. but i just stressed to the governor i thought it was time for him to resign. i thought that his legacy was too important to allow us to go through this protracted impeachment process, which i think would damage it. and i think it would be bad for the state and bad for the party. so i thought now was the time. and i didn't see any other possible way for him to overcome this. >> you've worked in democratic party politics in the state a long time. i don't know anyone with your experience who knows the governor who could imagine w

new york state democratic party chair j.j. cubs told lawrence last week that he called cuomo and delivered that message directly to him. >> i just stress to the governor that i thought that it was time for him to resign, his legacy was too important to allow us to go through this retracted impeachment process which would damage it. >> does he have the same information about these vote counts? >> i've told him that, i was very direct with the governor us to where support was and that he didn't have the support anywhere that he needed it. i was very clear about that. >> that gentlemen used to be a supporter of cuomo, today he denied the allegations. >> in my mind, i've never crossed the line with anyone. but, i didn't realize the extent to which the line has been redrawn. we're wasting energy on distractions, this is the last thing that state government should be doing. and i cannot be the cause of that. >> a lawyer for two of the women said that her clients quote feel both vindicated and relieved that he will no longer be in a

calls for resignation echoed across the state of new york, the u.s. congress and the white house with president biden joining those urging him to get gone. new york state assembly was plunging ahead with impeachment indictments. push came to shove and it came really fast. and so with cuomo's departure, in two weeks kathy hochul will be the first woman to serve as government of new york state. cuomo did not do himself any favors either. today a damning new report in the new yorker details the heavy-handed tactics cuomo has used in the past, suggesting he even tried to quash a federal investigation. we will have more on that coming up and it points to cuomo's pattern of defiance when facing legal scrutiny and even his resignation speech, attending to discount the report that brought the incredible allegations into the sunlight. the most serious allegations against me have no place in the report. there are many agendas and many motivations at play. if anyone thought otherwise they would be naiive. i truly believe it is politically motivated and unfair an

york state history. even in new york she is not a household name. here is new york magazine writer ben jacobs. good to see you. thanks for joining us on this simple question, who is kathy hochul. give us her story. >> kathy hochul comes out of buffalo, which already makes her unique in new york. no governor has come from buffalo since grover cleveland. she is a long time local politician who rose up in 2011 to win a special election that no one expected democrats to when at the midpoint of barack obama's political fortunes. in 2014 she was picked by cuomo to be his running mate because he needed someone who was popular in western new york, but not someone he viewed as inherently politically threatening to him. now the longest serving lieutenant governor right now in the united states as cuomo's number two focusing on economic development, traveling the state without playing a key role in actually everything cuomo was doing, which is a net plus and a net minus at this point. >> i'm hearing the first test

there is a crime under new york state law for forcible touching. forcibly touching a person without consent for sexual purposes. of the 11 complainants, the three of them made allegations that if true could meet the definition of forcible touching and we know five district attorneys are looking at these complaints. if you're going to bring a criminal charge, you have to be able to prove it beyond a reasonable doubt. that's the highest burden of proof. then we have potential civil claims. any of all of these complainants could sue the state of new york for harassment, retaliation, hostile work environment. that's a lower standard. there, all you have to do is prove your case by the prepon preponderance. 50% plus one and then potential for impeachment. there's no particular legal standard. it's really whatever the state assembly and senate feels is necessary and appropriate in order to remove the governor from power. he's got some major legal problems they'll have to deal with in the weeks and months ahead. >> certainly. another viewer wants to know
