and from the white house, there is breaking news tonight. the president telling cnn's kaitlan collins that those who refuse subpoenas should be prosecuted by the department of justice. and we'll talk to kaitlan, in a moment. before we do, more news about january 6th. for the first time, we learned today capitol police officer is facing criminal charges in connection to the insurrection and its aftermath. u.s. capitol police officer michael riley appeared in federal court this afternoon on obstruction of justice charges. prosecutors say that riley, who is a 25-year veteran of the force, told a rioter to delete incriminating social media posts. according to the indictment, riley exchanged several facebook messages with this rioter following the attack. including this one, saying quote, i'm a capitol police officer who agrees with your political stance. take down the part about being in the building. they are currently investigating, and everyone who was in the building is going to be charged. just looking out. cnn's jessica schneider joins us

executive privilege is not limited to white house officials. bannon wasn't in the white house. people point this out a lot. but the justice department in a 2007 office of legal counsel opinion said the whole point is for presidents to get candid advice from anybody, so it's not limited to just white house officials. although it's clearly strongest for people around the president's official advisers. and there's the other fact that the justice department has never before prosecuted a case of contempt of congress when someone has asserted executive privilege. to be clear most of those assertions in the past, if not all of them, have been from people in the government. this is somebody outside the government, doubly so, mr. trump and mr. bannon. but it would be setting something of a precedent. and, you know, the justice department always is worried about well what if the tables are turned here and things are going the other way? do we want to buy in future justice departments on this sort of thing. so, those are all the sort of things they have to take into account. >> barbara, c

there was a formal blocking of these initial documents by the biden white house, what is the thinking behind this? nancy: we know they are thinking because the white house counsel said point-blank the president leaves that president trump tried to exert executive privilege here is not in the best interest of the united states. they called it unique and extraordinary circumstances. they say president trump does not have any basis to hide visitor logs, call logs from january 6. there are a lot of people in his orbit, republicans on capitol hill who do not want those cold logs to be made public at this is the biden white house doing what it has been signposted for weeks, saying we would love nothing more than for that information to get to the public because we think have -- but what happened generally six was terrible and needed to be prevented. yamiche: they have been saying it is a stain on american democracy. katie, the select committee threatened to criminally charge steve bannon, former president trump's chief strategist. he is not wanting to comply with a subpoena by the committee

how is that playing in the white house? >> he set the standard for himself that coming here without an agreement from democrats on his domestic agenda was going to affect him in these meetings with world leaders. that's not something critics of the white house said. house speaker pelosi said that and his top aides were saying that. he is working on this global minimum tax, which is what white house officials say will be the main takeaway from this summit. a very important iran meeting is happening right now, but this is going to be something that they think can be really significant if they can prevent this race to the bottom of corporations trying to move their profits overseas, they think that can be something the united states brings in tens of billions of dollars and could potentially help with the president's domestic agenda. we'll see, of course, how that actually works out when he gets back to washington. but it is notable that it is something you can get done here while he's struggling with a similar issue at home.

the white house reminding mr. bannon today that only the sitting president can assert executive privilege and in this case president biden is not doing so. ahead of tonight's vote, the january 6th committee released a report outlining the ways in which bannon is delinquent in his response to their subpoena and also why it's in the public interest that he reply. it says in part, mr. bannon's testimony and document production are critical to the select committee's investigation. among other topics, the committee seeks facts that explain why the events of january 6th turned violent. statements publicly made by mr. bannon on january 5th suggest that he had some foreknowledge about extreme events that would occur the next day. information in bannon's possession is essential to putting other witnesses' testimony in context and ensuring the select committee with fully and expeditiously complete its work. so the committee recommends that steve bannon shall be in contempt much congress for failing to comply with a federal

was there coordination with the white house? and what was happening in the larger conversation on line. a lot of the conversations that i have had with lawmakers who were part of the committee, it's not just about who knew what when along with the characters and major players that you and i spent time talking to over the four years in the trump administration. it's also what was happening on social media all of which culminated on that january 6th day on capitol hill. >> i want to bring in justice correspondent pete williams who is also back with us on this. it is not entirely unexpected that the select committee would move to try to find out more information from these particular individuals and groups. >> there are some questions here. one is why did the capitol police approve these permits if they knew the backgrounds of at least one of the organizers advocated violence in the past. there is something here to suggest the capitol police couldn't do that, couldn't deny it because it would be a violation of the first amendment.

>> well, you know, when i was in the white house and out of the white house, i try to separate the jobs numbers from what the president is doing. because the white house is not in control of the economy. i've been saying, as you know, jake, from the beginning, the overwhelming thing that drives how the economy is doing and how the job market performs is what is happening with the virus. the virus really is the boss in the half of this year, we started getting great control over the spread of the virus. and you saw the economy come booming back. really at a speed that was virtually unparalleled and now that you've had a resurgence of the virus, i think that part of what president biden said is exactly right. you see the job numbers start to deteriorate, you're going to see the rebound of the economy slow down, that is likely to show up in the next gdp numbers. and we've got to get control of the spread of that virus. the good news is unlike a regular recession, people have money. they want to go out and spend. you got to get safe conditions. but if we get those safe conditions, i think e

, i think much to the surprise of some people in the white house. this moment feels different though to some degree because of how close they are and how divided they are on certain issues. >> right. and i think what policies do you remove? how do those numbers change if some of the policies that are popular start falling away? and that, and because of how congress is divided both in the house and the senate, all of these, while we tend to focus on sinema and manchin, there are kind of some moderate democrats w who might have tough re-elections coming up in the future. and the progressive caucus effectively made it so the infrastructure bill couldn't go to the floor. so they are trying to please a lot of people, and every single one of those members of congress, usually you can count on good soldiers to sign right up and march right on. and some of them will. but if you decide you want to take a stand and you're a democratic member of congress, the white house has to listen to you right now. >> i think this is really interesting is they try and figu

house promises to bring truth and science back to the white house. >> the valuing that youth. >> against that backdrop, it hurt a reporting for more blade are talking about the number of statements the white house is addressing the president made last night. also this comes from some fact checking that was also done on with the president said last night and we will just let that be up there for people to see. they talk about all kinds of different claims in context or they just actually weren't true. would you make of that because we were told lots of transparency lots of truth, and last night, there was a lot of head scratching. >> this has been nothing like the trump administration. we have gasoline at the highest price that most people have see in almost a generation. we have inflation running rampant. we have a creation of an artificial attack on employment that is worse than what happene with the obama care employer mandate. we are actually making people move from the towns and states that they live to places that aren't as direct an en and the vaccine mandate and the passports asso

from the white house's perspective, in what ways has manchin compromised? jen: we'll let senator manchin speak for himself. what i would note here, it's not the president giving up or taking anything. the president is trying to unify a path forward between a range of members in congress. senators and house members. and what they are for or against or what they can support or what they're against. that's part of the role he's playing in this negotiating process. so we'll point you to senator manchin on what he feels he's given up or what he's for. he can speak for himself. reporter: secondly, the president is going to glass cow and hoping -- glasgow and hoping -- [indiscernible] comments are coming from. absent a complete deal on any framework, is there any effort from the white house to achieve just the climate portion so he can go to glasgow with a framework within a framework? jen: i would just go back to what jake sullivan said yesterday which is that global leaders are quite sophisticated. they are watching and following and understand the fact that the

we saw urgency from the white house. the president invited lawmakers over. there's a momentum and now that they are on the vernal of the dole there's still some major unresolved issues here and what role can the president now play? can he bring back that same momentum and sense of urgency that we saw last week to close this deal out? >> and just adding real quick, the notion in -- if you are bernie sanders initially pushing the $7 trillion that's pie in the skies, let's be honest and the notion of not expanding medicare to include hearing for seniors, to include dental, to include vision, the notion that you will not have something in there that al lourts for negotiating the price of prescription drugs, which is wildly popular, but because joe manchin is saying it is just too expensive right now. it will cost too much and it will deplete the medicare trust fund unimore than it is, that's the reason that you saw a very angry bernie sanders talking to manu rajus, earlier. >> he came up short two times and got millions of votes in two campaigns, campaigning on

i'm just going to let the white house negotiate. i'm just saying we should reform the tax system and make corporations pay their fair share. >> and that, wolf, is a critical point here because if they do change the way they're going to pay for this, that is going to be one of the most popular points. raising taxes on corporations. you've heard the president say it time and time again. that is something they believe should happen. if they change that, one of the most popular components, that will be another question facing the white house, but tonight while the president is here in baltimore, one thing that white house officials say he will focus on is what is still in this bill and what is something they have not taken off the table and they still want to include when they have the final framework they're hoping to get for tomorrow. that includes billions for climate change, universal pre-k and the expansion of medicare that senator bernie sanders has talked about so much. though there are still big questions about what exactly it's

for an update for things from the white house, the white house end of pennsylvania avenue, we are joined by bloomberg's justin sink, white house correspondent, good morning. guest: thanks so much for having me. host: we were just hearing about the house, potential meeting of democrats. what do we expect from the white house today in terms of the negotiations over the budget reconciliation measure? guest: the white house is sort of just kind of a bump in the road. they still think they can make progress and move forward. i would expect the same cadre of aides led by domestic policy advisor susan rice, brian, the national economic director, steve, senior advisor to the president will be on capitol hill today meeting with whether it's joe manchin or kristen sinema, whoever they need to get to the table to iron out this deal. kind of get the sense from the white house that they are at least trying to portray this. it's still possibly in line to both put together a framework package and get the vote that they want on the infrastructure bill. as we saw last night, as much optimism she might ha

how does the white house explain the calculus made in this speech? >> a framework is certainly not a deal and lawmakers have made that clear ever since the president visited house democrats this morning. first saying they wanted to see a text, then saying they wanted to make sure they had assurances of course of the two critical moderate senators who have been at the center of the negotiations, senator manchin and senator sinema. the president was projecting confidence before he left the white house today talking about the negotiating that they've been doing on this which he of course noted had gone on for hours and hours over months and months and saying that this is an agreement where no one is getting everything they want but essentially making the argument that everyone is getting something. what the president announced in the framework from the white house is far from complete because there were several parts not in the white house framework, things democrats have said they'd like to have in there. so the question of how it ultimately ends up wh

i'm in very close touch with the white house. they are obviously really working hard to, with the senators, and i'm keeping in touch with my caucus obviously to make sure i know what the temperature is of everybody and we're doing everything we can to get quickly to an agreement. listen, we are going to pass these two things. you all know capitol hill. it is a strange place. things -- i've only been here four and a half years. i still find it strange. things only happen here when there is urgency and, you know, some reason for people to be at the table. we've seen more progress in the last 48 hours than we have seen in a long time on reconciliation, on the build back better act. >> what about manchin and sinema? are you talking to them? >> i'm not -- i'd be happy to but right now those negotiations are with the white house. >> you said that things only get done on capitol hill when there is a sense of urgency, a deadline. we all know that is how it happens. when it comes to this there really isn't one. there is no deadline. this
