he rented the u-haul and drove into brooklyn the morning of the attack. he'll be formally advised of the charges today and at some point the judge will set bail but i can't imagine he'd be allowed out on bail while pending trial. >> there's so much video evidence that's been compiled. we know that camera wasn't working at the subway situation where the 35th street station, where exactly it happened, but look at all the other video evidence of him coming in, of him leaving and of him driving across the bridge earlier that day coming into new york. >> the video evidence is strong but the strongest of all is the evidence he left behind the enormous stash of material on the subway car, the bag of the fireworks and then the key to the u-haul, a credit card with his name on it but most critically the gun used in the shooting, he had apparently tried to obliterate the serial numbers, and the atf was able to use that serial number to trace the gun to him. that's the single most devastating evidence here. >> again, just another emphasis of the administration being

this subway, the n-train, was heading northbound out of brooklyn. to give you an idea, it was two stops away from lower manhattan, the canal street stop near wall street. you're talking about an interconnected system which is still very much in operation. a few of these subway stops are at a halt here, but looking at this video an individual took in the train here of folks that are covering up their faces, clearly disoriented, confused. there's another video that is now circulating that we here at nbc news have cleared and verified from the subway train apparently next to this one in which the gunman opened fire. and you hear multiple bangs, sounds of bangs. it's not clear whether those were gunshots or there's also part of a video in which an individual is clearly between the two trains. you know, there's a lot of questions as to the ability of an individual to move from one train to the other. to what extent was that potentially a situation at play here? because we still do not have any video or apparent photos of this individual from any of the s

tom: on the tragedy in new york, the east of brooklyn, you basically live there. the president will be asked today what you will do about violence, crime. i saw one statistic of the homicides over three years in chicago up 49%. whatever the numbers are, doesn't matter. someone will say, what are you going to do about it? how will he respond? annmarie: the president said he does think gun violence and crime, especially gun crime is endemic in american society. he recently spoke about this. two days ago he talked about ghost guns. you can print them off of 3d printers. they are incredibly difficult to track. at this same speech he put the onus on congress to act, to go after more expanding background checks, after assault weapon sank what he did in the 1990's -- he worked on legislation that was controversial but was needed in society. i'm sure he is going to talk about what the administration has already been doing. he is going to pivot and tell congress they need to do more. there are a number of bills the house has passed. the issue is, with a 50-50 split senate

this man is now being named a suspect in the shooting at a brooklyn subway station yesterday. frank james was originally a person of interest. his status was upgraded in morning. police recovered a gun at the scene as well as a key that led them to a nearby truck which investigate ears say that the 62-year-old had rented in philadelphia. authorities have been looking at his social media videos in which he slammed the united states as a racist place, awash in violence and railed against the new york city mayor. this attack of course happening about 24 hours ago during the morning rush hour with commuters trapped inside that subway car. a man in a gas mask detonated smoke bombs and unloaded 33 shots hitting seven men and three women. apparently his gun actually jammed like like preventing more carnage. police haven't said anything about an official motive in this case. they are offering a $50,000 reward for an arrest. we will watch it all and in the meantime a lot of questions about security on transit systems. we have justin andrews at bart. >> many of you may be preparing to u

i'm john berman live in brooklyn this morning. there is a manhunt under way for the person who opened fire on a crowded subway station yesterday, firing 33 times. 29 people injured, including five students. ten people shot. joining me now, jillian snyder, retired nypd officer and former supervisory special agent for the fbi and former lead tech for the fbi. jillian, i want to start with you. whoever did this, whoever fired a gun 33 times on the subway is still on the loose. what is being done to keep people safe? . >> the nypd launched a massive manhunt in collaboration with the feds and trying to ascertain the location on of this individual. they are talking to anyone who may have known the suspect or person of interest. he doesn't have ties to new york city. so they are trying to find out who he is from. >> frank james is the person listed as person of interested here. keys the a u-haul he was believed to have rented were found at the scene. person of interest. what's being done to find him? . >> what's being done is right now t

inside a car that was approaching the 36th nation on the n line in brooklyn. the fdny says 16 people were injured, at least 10 shot. five are in kcritical but stabl condition. investigators have recovered a gun and multiple high capacity magazines from the scene. >> a law enforcement source tells cnn, they believe the gun may have jammed as the suspect attempted to fire more rounds. the nypd says this is not being investigated as an act of terrorism for now. the police chief said that she wasn't ruling anything out when it comes to the motive -- the commissioner, i should say. last hour i spoke with one of the witnesses who captured some of the horrific video. he was on the train car. listen to what he told us. >> got up and i hid behind the little wooden side plank that's on the seats, between the seats and the door of the train. i stayed there while people who were at the farthest end of the car ran toward the front and jumped on top of each other, walked over each other, trying to get as far away from the drama as possible. during all this time, i'm thinkin
