roberts as opposed to this nominee, you've got more than ten times as many cases to look at with judge sotomayor as you had with justice roberts. that takes a lot of time. and even with 20-some staffers reading these 4,000-plus decisions, it's not just a matter of reading the cases. it's a matter of then looking to see what the precedence cited were to determine whether or not you think the judge was right in the decision that was rendered, to look at the other references in the case to see how closely this followed the existing law and whether it appears the judge might be trying to make law as opposed to deciding law. that's important in this particular case because of the standard that the president has laid down for his nominees which strongly suggests something beyond deciding the law. in 5% of the cases, as he said, there's no precedent, no legal mechanism for deciding how the case should come out. you have to base it on other factors. everybody is well aware of some of the factors that this particular nominee has talked about. and the president has talked about. the empathy, the

>> well, this may sound like a dodge, john, but as we go through these deliberations, i mean, it's a very significant and fundamental decision that you have to make. and we are going through that now looking at what is the right way to try to divine that characterization, if you will, of what we're going to need in the future? and i believe part of the success of the qdr is to go into the process and to look at the analysis with an open mind. if i went in and said, you know, this is, you know, what i strongly believe and shut off all of the good analytical work and the serious discussion that's taking place, i'm not sure that that would be in the best interest of what we're trying to achieve. the qdr allows us to go in and challenge some of our assumptions and question that, what we're doing. and that's not easy. that's a hard thing to do particularly in a large bureaucratic organization that has a lot of inertia behind it where there's interest in specific programs. but if you do this right, you begin to question, and you should question, you know, are we doing the right thing? yes,

the last speaker pointed out if you compare the record of the now chief justice john roberts as opposed to this nominee, you have more than 10 times as many cases to look at with judge sotomayor as you had with justice roberts. that takes a lot of time. even with 20-some staffers reading these 4,000-plus decisions, it is not just a matter of reading these cases, it is worth realeding to see if you think the judge was right in the decision rendered. to look at the other references in the case to see how closely this followed the existing law, and whether it appears the judge might be trying to make law as opposed to deciding the law. and that is important in this case which the president has cladelade down which strongly suggests something stronger than deciding the law. he said there is no legal mechanism for deciding how the case should come out, you have to base it on other factors. and everybody is well aware of some of the other factors this particular nominee has talked about. the empathy, the background, the experience in other matters. so the question is, in reading these opinion

as well they should. give some doctor or patient that has been proven -- doctor or patient wants to treatment that has been proven ineffective, that makes sense to deny it. we are fairly ill informed anon what works and what does not. there are currently no institutions that have the ability to do comparative and constructive comparisons. it makes common sense for the government and the private sector to do this, not said that they can dictate doctors and their procedures, but simply to provide information about what is an effective and what does not, putting rules on the system. there is huge savings to be had from that kind of work. host: bruce, illinois. democratic line. caller: thank you for taking my call. i would like to offer some solutions on how to pay for health care. i think we are 27 in the world as far as how we pay for this. let's take a look at the united kingdom, canada, switzerland. let's look at what works and what does not work. on how to pay for it, why not raise the gap on social secu
