[crowd murmurs] >> a little bit of background on the american constitution society that is hosting this event. it is called the american constitution society for law and policy. the group calls itself a progressive legal org

on the radio and generating performance in come from radio play. if the jets synchronized to a commercial, or forgets synchronize and a film or television show, there will be different ways that performance in come can be earned from that. we have some challenges. currently, one of our big issues is that when you download a piece of music in the u.s., like other territories around the world, there isn't performance income for download. you get a mechanical if you download a song, but if you download a tv show or a film, the composer does not get a mechanical, and the composer does not get any performance. the blood made their living composing for film and tv are really very concerned about this. this is one of the legislative priorities as both the performing rights organizations collect performance and come in the u.s.. they're very concerned about it. they're going to be looking for potentially legislative solutions, and there is also on appeal because this is the result of a court ruling. >> can you very briefly describe the business model of th

after that, president obama is remarks at the radio and television correspondents dinner on friday. then on america and the courts, supreme court justice anthony kennedy delivers the commencement address at stanford university. this week on c. spence "newsmakers," california congressman pete sparked discuss this legislation working its way through congress. he talks about one proposal that would establish a public health insurance plan to compete with private plans. >> at the end of the day, if you choose to have competition and you choose to have a plan that is dependable and affordable, you cannot do it without having a public plan there. that creates the competition for the private plans. so yes, there will be a public plan in the bill. will people vote for it? i don't know who wants to go home in next year's primary and say i voted against the plan that is going to provide 30,000 people in my district, most of whom are nonwhite, ports, working, do not have a way now to get insurance. i vote against giving them away to pay their doctor and hospital bills. i don't think that is a

performing right in the sound recording, and radio stations in europe, for instance, do have to pay a royalty to the, for the recording and then that's shared by the artist and -- who performs on the record, and the record company. so this is something that the record companies would like to see instituted and many artists as well would like to see instituted in the u.s., and legislation has been proposed. and that legislation as well has language in it that would protect songwriters so that as radio stations negotiate their blanket licenses with ascap and bmi, for instance, that songwriters' income wouldn't be diminished by this performing right. and the truth is, you know, for artists who do perform in some cases artists are not the songwriter, the songwriter does get paid, the artist, you know, doesn't enjoy a performing right in that sound recording. and so i think the debate has become, well, you know, the nab, the broadcasters probably mostly in terms of being vocally opposed to it are basically have framed the argument as, well, we don't feel like we should have to pay. we pr
