trace gallagher in our west coast newsroom this afternoon. hinckley is considered insane still, right? >> yeah. the psychiatrist says that he is still insane but she also testified today, shep, that he has a low level of mental health disease. she says that his psychotic disorder and depressive disorder is actually in remission though he still needs his medication. right now, john hinckley jr. spends about 10 days a month at his mother's home in williamsburg, virginia. the hospital wants to increase that to 17 days a month at first and then if that goes well up to 26 days a month and eventually he would live with his mom full time and, of course, the prosecutors say they do not want john hinckley jr. to have any more freedom at all, shep. >> shepard: what happens if, well, if something happens to his mom? where would he go then? >> that's what the prosecutors keep asking in court. and the answer seems to be that nobody knows. his mother is 85 years old. and though she appears to be in pretty good health, she is 85. john hinckley is 65 years o

trace gallagher with the news live in our west coast newsroom. part of the thing here, whatever you think of the regulation. the ntsb which investigates plane crashes and the like has no power to regulate like this. >>. no you are exactly right, shep. the ntsb only makes recommendations to the feds and states and to locals. you have got to remember the ntsb wields a grade deal of power and if the ntsb sis to do something, the odds are most times it gets done. a lot of recommendations by states may not be followed in that some states still allow full cell phone use sages. some have higher speed limits. here is the other thing. if at some point in time the state decides not to follow the ntsb the feds can then threaten things like pulling away some of your highway funds. the ntsb is very full aware this will get some push back. listen. >> our recommendations are not always poplar. and we know that this recommendation is going to be very unpoplar with some people. but we're not here to win a popularity contest. we're here to do the right thing. >> t

trace gallagher is following this story. how does this burning suv fit into the mystery here, trace? >> well, shep, the burning lexus was found on the north end on tuesday night. the bodies much john and geraldine mcgee were found in their home on wednesday morning. it appears they we shot and killed sometime on tuesday night. the killer then apparently stole their suv. drove to boston and tried to destroy the evidence. police say there were no signs of a break-in to the home. they will not tell us if there were signs of a struggle or if the couple was robbed. listen now to police. >> the incident appears to be an isolated act and the circumstances lead us to believe that there is no further threat to the andover community. >> in other words, they believe this was a targeted killing. right now there is no motive for the crime. shep. >> shepard: when that's the think rg, what investigators almost always do start looking for enemies, obviously. >> they are doing that as well. wealthy couple real estate developers in andover. t

trace gallagher is live tonight. what do we know about specifics here, trace. >> his spokesman says he was in the hospital with some congestion, some coughing, that he had run a slight fever. the doctor says even before he examined the reverend graham he already decided he was going to keep him overnight for observation, at least one night to make sure he is okay. the doctor also says his symptoms this time around are not nearly as bad as they were last time. remember back in may he was in the hospital for five days with pneumonia. we are told that his spirits are good. he came into the hospital. he was waiving and smiling and right now he he is stable but at 93 years old, even mild pneumonia is a very big concern, shep. >> shepard: he has other ailments on top of that, trace. >> he he has had park -- park sans for 15 years. stints put into his brain because of that. admitted to the hospital with internal bleeding. 2008 he fell over one of his dogs and was admitted to the hospital with bumps and bruises, luckily no b
