our chris gordon spoke with levy's mother today. chris? >> well, chandra levy's disappearance was at the center of local and national news for years. then it became a murder mystery. throughout it all, chandra's parents, susan and bob levy, appeared before cameras saying they wanted justice. now they face the prospect of a new trial for the man accused of killing her. today the leviesy s reacted to the news of the retliel from their home in modesto, california. ingmar guandique was convicted of murdering chandra levy, the intern from california who disappeared in 2001. police searched for her more than a year until her remains were discovered in rock creek park. >> but no matter how many trials you have, you'll never have your daughter back. it should not have happened. >> reporter: in 2010 ingmar guandique was put on trial for murdering chandra levy. he was convicted and sentenced to 60 years. the conviction was based primarily on the testimony of guandique's one-time cell mate morales who guandique told him was responsible for levy's dea

chris gordon spoke to the victim's family today. >> reporter: the accident happened on montrose road near rockville pike. it was december 17, 2004. police say the hit and run driver, wilfred owe lal low was drunk. the victim, retired d.c. police inspector joseph o'brien died five days later. it was montgomery police officer john powell's case. he arrested owe lal low who pleaded guilty to 2006 but before he could be sentenced, he ran leaving the u.s. >> i figured that once he fled the country and had gone wherever, that no, we probably wouldn't catch him. >> reporter: owe lal low hid in kenya, but ten years after the fatal accident he was caught and arrested. today in montgomery circuit court he was sentenced to the maximum the law allows. >> when you got three years and 60 days for the offense of you know killing someone while driving while impaired. >> reporter: the family of d.c. police inspector o'brien says owe lal low caused them so much pain and suffering. >> he was my grandfather and i really lost my best friend and my mentor. >> reporter: the family says the sentence given o

news4's chris gordon is in rockville tonight with the plea from the victim's mother who says her daughter never really knew the man she dated. chris? >> reporter: well today here in court prosecutors called donald bricker a danger to the community, and the judge ordered him to remain in jail. and today, for the first time, the victim's mother spoke publicly. i spoke with her at her germantown home about bricker and her daughter. >> i never met the guy. i almost did, but it never happened. when they broke up she came to me and she told me that it was all over. >> reporter: cassandra atken said the last time she spoke to her daughter was monday morning, but shade adebayo didn't tell her mother that evening she was going to go to target in germantown at the request of her ex-boyfriend donald bricker jr. bricker is charged with first degree murder for allegedly shooting adebayo in the parking lot. in court today, bricker was denied bond. he has a rape conviction from 2008 and is a reblged sex offender. cassandra atken said her daughter didn't know fw his past. >> i just want everybody to know

chris gordon has more on how her death limb pact this criminal case. >> reporter: people find it shocking that it happened in public view. >> it's just unfortunate. i feel so bad for her family though. it's sad. >> reporter: the movie had just ended at the regal theater in rockville last friday night. they walked around the corner, getting as far as the montgomery county circuit courthouse. 16-year-old marquis turner is charged with second degree rape of his 19-year-old date. the police report says it happened right in front of the courthouse, giving this account. turner pushed her up against this wall, which is concrete and embedded stone and very rough. she pushed back and said no, but he forced himself on her. meanwhile, the whole time, through this security camera, montgomery county sheriff deputies inside were watching the whole thing realtime. the 19-year-old woman with him was transported to a local hospital for a sexual assault exam but she stopped breathing in the ambulance and died on the way there. i asked if prosecutors are considering adding a homicide charge. >> we are leavi

chris gordon live with what we have learned about this case. >> reporter: it is an unusual case occurred out here in open public view, anybody along maryland avenue. it occurred right against that wall in front of the montgomery county courthouse. after it was over that young woman, the alleged victim was being taken for a medical exam but she died on the way to the hospital. their movie had just ended at the regal theater in rockville last friday night. they backed around the corner, getting as far as the montgomery county circuit courthouse. 16-year-old marquis turner is charged with second degree rape of his 19-year-old date. the police report says it happened right in front of the courthouse giving this account. turner pushed her up against this wall, which is concrete and embedded stone and very rough. she pushed back and said no, but he forced himself on her. meanwhile, the whole time, through this security camera montgomery county sheriff deputies inside were watching the whole thing realtime. >> these cameras are high-resolution cameras thank goodness, they are installed here. we

news4's chris gordon spoke with her mother after she learned this case is far from over. >> reporter: ingmar guandique was convicted of murdering chandra levy, the intern from california who disappeared in 2001. police searched for her more than a year until her remains were discovered in rock creek park. today i spoke by phone with chandra levy's mother susan who lives in modesto, california, asking her reaction to the news of the retrial. >> my heart cries because my daughter had been murdered in the first place. and if they have to retry it that's fine. i just want to know that they have the right person who did what they did. and i want the truth to come out. >> reporter: in 2010 ingmar guandique was put on trial for murdering chandra levy. he was convicted and sentenced to 60 years. the conviction was based primarily on the testimony of guandique's one-time cell mate armando morales who said guandique told him he was responsible for levy's death. but guandique's defense lawyers argued morales' testimony was unreliable that there was no corroboration, no physical evidence linking
