jonathan turley, "fox news" contributor, and constitutional law expert. jonathan, thank you for being here. i want to get your topline thoughts on the court ruling and what you think it might signal as far as the likelihood of this appeal and where that goes. >> well, this is obviously up a buzz kill for governor newsom. it interrupted his narrative that he is defending against the tyranny. the court is saying actually, you are on the other side of the rule of law in this one. the statute gives the president this authority. he has discretion to make that decision. that any violation of the statute was highly technical when that would not justify what the district court did here. it also freezes the district court's decision, which was really problematic for many. this is a district court judge that suggested president trump was acting like king george. the opinion was sort of fool talking points that we have seen out of some of the democratic politicians. all of that has been set aside by the ninth circuit that says the president has this authority. he is

griff jenkins live in d.c. >> dana: let's bring in constitutional law attorney jonathan turley. just from housekeeping perspective. because of the immigration case or the birthright citizenship case on appeal it might not come out today at the end of the session. it might come out today. if it doesn't, why is that? >> well, this was really an outlier. the court added it very late. fairly irregular for that to happen. it is an important if not momentous decision that the court has to make. what president trump is objecting to has been a point of objection from democratic and republican presidents. even justice kagan during this obama administration said it was really crazy that individual judges could essentially freeze the entire federal government. the court is going to have to make a decision whether they want to impose some limits on that. one is that if you want to stop everything nationwide, you need to have a nationwide class action. you need to establish you represent people nationwide. that's one of the options. >> bill: the trump administration has been incredibly frust
