jeff we go to you and then we go to orrin hatch. go ahead, tom. >> if we're already spending money in that area, why should we spend more? so what this amendment says is anywhere we're actually doing it already, why spend $8 billion on doing it more? until we know it's making a difference. so if we're already building bike trails through the transportation program and through all these other areas, we shouldn't spend this money on bike trails. we're creating dual and triple streams of money to accomplish the same thing. this amendment says if we're spending the money already through another function of government, through another funding source, that we would not use that -- this money would not be used in that direction. which would mean we would use it in something else. still doesn't drop your amendment, it still doesn't keep us from doing it. but just says once we're doing this with a funding source, why come in with a second funding source to do the same thing where, in fact, there may be a point in time. how many bike trails d

guest: 62,000 figure was something that senator orrin hatch calculated out yesterday from the cbo analysis that was released late yesterday. the health committee bill in the senate would cost more than one trillion dollars. and that is a number that we will see repeated and thrown around a lot in the next few days, because republicans have been saying for a while now that we don't know what the president is trying to do, that is trying to spend so much money and whether or not he will accomplish his goals. if this was a look at the bill, but there were missing parts in it, missing some parts of the health reform program, and where mandates, a public insurance plan that would change the final calculations and there was left out how much medicaid expansion would cost. that would add a couple hundred million dollars to the bottom line. there are other aspects that the candy staff says will increase the number of people who will be able to be in short. 60 million people is all that would be taken off the rolls. that is falling short of where the president said he wanted to be. i am familiar wi

let me just say to my friend and orrin hatch is a friend of mine, we've worked together on a lot of ins. as you'll recall, having been the author of the class action reform bill and private litigation reform bill, i've certainly written legislation here that's not endeared me to certain constituencies when it comes to what i perceive to be in many cases frivolous lawsuits, so i don't take a back seat to anybody in that area. but the point that senator whitehouse and mikulski have made is this has been a subject of extensive discussion by the judiciary committee, it's a complicated area that is beyond -- >> not this matter. >> well, i understand-- >> litigation has been discussed but not this matter. >> i understand. but this is a matter here that really does go to the heart of judiciary committee jurisdiction for one. i just state that as a point, but secondly, any more that this is a decision by washington to preclude information, anymore by a decision by washington to exclude the information seems to me something we want to avoid and there's going to be, i'm certain, there will be at
