christie smith joins us live from oakland with one of the people forced to leave. the image burned into the minds of so many people. seeing people stuck on the roofs of their home, hoping just for a bit of help. you actually talked to one of these people. >> reporter: he was stranded on a roof top for three long days on day two he knew he wasn't getting help, so he had to dive into the murky water and try to find food for his family. he said it was awful, filled with oil. he finally found some food in a store that was flooded about a quarter of a mile away. along the way he says he saw people stuck on roof tops begging for help. eric butler was stuck there with 17 families. he said he got down finally when the water receded. a rescue crew eventually got the family out of oakland, a place they had never been before. a day after katrina, he said it was partly sunny, and then he looked outside, saw his dire under water, in no time the levees broke, that's when the first floor of his apartment complex was flooded. they had no time to move. here in the bay area he descr

christie smith is live in oakland this morning. what is planned for today? >> reporter: good morning to you. hasani campbell was reported missing behind that shoe store that you see there across the street. this afternoon there is a rally planned. it's being organized by a woman who never met the little boy. there ises a a planned meeting with the district attorney in alameda county. sherry lynn miller owns a print shop out of san leandro. and she searches for missing people. she distributed flyers, t-shirts, organized ground searches for the 5-year-old over this past year. today she says that she and a county supervisor will meet with the d.a. to try to get direction on any new searches or if there's anything new that may lead to an arrest. there will be a rally before that meeting, she says, at 2:00 outside of the d.a.'s office. the foster father and his then fiancee were initially arrested but then released due to lack of evidence. oakland police say the case is still open but there is nothing new. the lead investigator will be discussing the case this mo

reporting live from oakland, christie smith, nbc bay area news. >> all right. we'll follow the run for the new mayor of oakland coming up. >>> two teenage would-be robbers picked on the wrong woman. they tried to take on a federal agent. bob redell is live at marlon court where the shooting took place around midnight. was the suspect armed? >> reporter: that's what we are being told. this was a federal agent who works for the irs. we just confirmed new information, that agent is a woman who lives in this housing development at kirkwood and coral. around midnight, she was off-duty, came out to get something out of her car at this parking lot here, that's when two teenage men approached her. they were robbing her at gun point when she drew her own weapon and shot one of the teens in the stomach. it does not sound like the suspects were able to shoot back. here is one of those suspects being wheeled into sf general. last report had him in critical condition. the other teen took off, but was caught not far from here. he is in police custody. the agent was not hurt.

christie smith is live this morning in oakland. that decision could really effect service cuts which effects riders. riders have had a tough time lately. >> reporter: they have. you know, there's a couple of schools of thought on this. many people believe it's the union, and if they win in court this could ease some delays that riders have been dealing with in the east bay for nearly two weeks now since ac transit imposed a work contract that apparently includes some big changes to schedules and rules for bus drivers. the agency says about 20% of the drivers have been failing to show up for work in a sick-out. the union says those numbers are inflated and that some drivers may not be showing up because of safety issues or other concerns. now, on friday, an alameda county superior court judge listened to arguments on both sides of the issues. the union is asking for an injunction asking ac transit not to impose the contract. negotiations were stalled last month and arbitration is expected to start august 20th. reporting live in oakl

christie smith is live in oakland this morning. the decision could effect service for riders. >> that's right. this decision has to do with a contract that was imposed on ac transit bus drivers. we have been speaking with riders this morning, they are hoping whatever happens it will ease the delays they've been dealing with for almost two weeks now. today a judge will decide on the union's request for an injunction preventing the transit agency from continuing to impose a contract at least until an arbitrator can decide this whole dispute. ac transit imposed a contract when negotiations failed in mid-july, and since then about 20% of their drivers are not showing up each day. the union says that number is really too high. we spoke with one rider this morning who says he just wants to see it over and he doesn't have a lot of sympathy. >> because at least they got a job. you know, i think they just need to sit there and come to an agreement and just get on to wor work. >> it's getting old? >> yes. they got a job. i mean, can't sit th

christie smith live in redwood shores with new information. good morning. >> reporter: good morning to you. i spoke with a supervisor out here who tells me while the whole thing is not picked, they basically stopped the flow of raw sewage into the streets and garages here. what's happening it they have gotten five of these large trucks out here centrally working now as the sewage system because the water to the homes around here has not been turned off. what this means is if you use your toilet or garbage disposal, these trucks are sucking up the waste that would be working in the sewage system if it were working. the spill started yesterday around 3:00 near anchor circle. it was flooding the street and about six garages here. the sewage also spread redwood shores lagoon. there was a red code notice, warning people to stay away from the spill, to avoid potential health risk. so don't have any contact with the spill or the water in the lagoon. also depibd tbehind the homes h they're working on the main pumping station. they're telling me they'l

christie smith is live in richmond with more on how police will enforce this new law. >> reporter: a lot of this is up to the discretion of the specific patrol officer. if they find a student out during class time hours, they can opt to return that student to class or they can cite that student for violating the daytime curfew. police are saying on any given day in richmond about 100 students just fail to show up to class. they end up in parks, skate parks and often fall victim to crime. the last truancy sweep in march netted 425 kids who were not in school here in richmond. the curfew is for unsupervised minors who are not in school 30 minutes after school begins. basically instead of officers being tied up for an hour trying to find a parent or a place for the student to go if they were out in the past, two non-profits are serving as drop-offs. >> that will be a drop-off center for the officers to take the students to drop them off and they can get services they need at those two centers. >> reporter: the fines can go all the way up to 500 bucks. but $50 is more likely. there are e

christie smith is there live with a look at the progress. for you, a smell. >> reporter: good morning to you. i can tell you you can certainly still smell it. the good news is there is progress to worth. that leak appears to have been capped. we're not seeing any of the street flooding that was a problem here last night. it appears to have been capped. it was running into garages that you see across the street. about a half dozen of them. that's where the focus has been this morning. the raw sewage spill began yesterday, about 3:00 p.m. near anchor circle due to a broken valve. to make matters worse, the sewage was running into redwood shores lagoon which is behind these homes. the public works department put out a warning to residents in the area to stay away from the spill and don't have contact in the water in the lagoon to avoid potential health risks here. how much sewage was released is unclear. we're told someone from the public works department could be out here within the next hour. we have to bring an update for you. reporting live

nbc bay area's christie smith is live in contra costra county this morning with more on what you need to look out for to try to get this guy off the street. good morning. >> reporter: good morning to you. a lieutenant from the contra costra county sheriff's department is out here talking about common sense things that women can do. because this guy apparently keeps going to this complex behind me, but day don't know if he will move or not or if it is, indeed, the same person. they can tell us that there have been three sexual assaults or at least attempted sexual assaults within the last few weeks. this is happening at the park regency apartments here on oak road in unincorporated walnut creek. now, the latest incident happened at 8:30 in the morning just yesterday. a 25-year-old woman was woke up to find a man with his hand over her mouth. she was threatened, but she was able to struggle and get away. in that case, the front door, we know, was locked. it's possible this is tied to two other incidents here. a rape on july 6th. a woman woke up to find a man in her bedroom. in that case

christie smith is live now in oakland with more on the argument for and against the move. christy. >> good morning. the issue here is whether this trial should be moved out of alameda county altogether. can the accused killers get a fair trial here, given all the intense media publicity surrounding the killing of journalist chauncey bailey? consider this, that this hearing has been postponed at least four times and the case has been anything but straightforward with attorneys coming in and out of the case. lawyers, your black muskly becamery has been massive and pervasive news coverage. we were among the first news crews on the scene the day that chauncey bailey was shot and killed on his way to work near downtown oakland. bay is accused in ordering two other shootings. attorneys argued that a survey of 400 potential jurors argued that 70% of those who even recognize the case already think bay is guilty. prosecutors think that all of this is premature. there will be a brief hearing to arrange the hearing on the change of venue motion which is expected on tuesday and wednes

christie smith is live in berkeley this morning. she has a look at that new documentary called "a day late" in oakland. she has a look at what we can expect. >> reporter: good morning to you. this was and still is a huge story in the bay area, the broad daylight killing of journalist chauncey bailey in oakland. zachary stouffer was a masters student at uc berkeley at the time and made a 30-minute documentary about this. can you talk about what it's about? this is a story with a lot of legs and it goes in a lot of directions. >> this was a film i started after the murder of chauncey, a local story, one that i wanted to do. so i picked up on this one. it's not so much about the investigation of who committed the crime. the cops had their time. this is more of a story of two gu guys. we had chauncey bailey, a reporter who wanted to cover the bay yarea, and it follows those two paths until they intersecting. >> are there people in this that we have to the heard from before? those that followed the story? >> i have an interview with chau

nbc bay area news' christie smith shows us the mess and the work that's still ongoing. >> reporter: the rattle of heavy equipment drowned out the beauty of redwood shores lagoon, and the smell -- >> yucky stuff, yeah. right. who wants sewage all around your house, you know? >> reporter: or worse, inside six garages after an eight-foot sewer pipe broke yesterday flooding the lane. the flee is temporarily stopped, be, out front today a merry-go-round of vacuum trucks. >> what they do is they -- they sucked it out, suck the wet well down, and then they will go downstream, further downstream and put it back into the sewer system where it goes to the wastewater treatment plant. >> reporter: sort of a makeshift sewer as people continue to shower and flush. last night emergency calls went out to residents warning them to have no contact with the spill. tom fernandez came to see for himself because, he says, there was undergroundwork done here recently. >> it raises a question in my mind, is the failure related to recent work or something else? >> it should not have had anything to do with it.

christie smith is live in danville with what happened. good morning. >> reporter: good morning. danville police are calling this a tragedy and an unfortunate accident. they say a 19-year-old was somehow on the outside of an suv, fell off that suv and died. now, this morning, danville police are interviewing witnesses, so detailed are still coming in. but they tell me that -- the chief, i just got off the phone with him, he said alcohol does not appear to be a factor with the driver. they say there may be miscommunication here, that what appears to have happened is that this 19-year-old was outside of the car, when some acquaintances pulled up and then he made the decision to try to hurry up and get inside that car. rather than stunt riding, he was trying to hurry up and get in the car, he jumped on the car and that's when he fell and died. it was around 11:50 when this happened. at first police weren't sure if this was horse play or what. >> we are working off what statements were given to us by witnesses that he was holding on to the side of the car, maybe holding on to the roo

christie smith has more on how police plan to enforce these new rules. >> reporter: this whole issue stems from a big issue of truancy in the city of richmond. police say on any given day, about a hundred kids don't show up for class. a lot of them end up in the park, hanging out in broad daylight. a lot of them end up falling as victims of crime. and these new efforts are a noncriminal process, though the worst of the worst offenders could get a ticket and a fine passed along to their parents. the last truancy sweep netted 425 students not in class in march. in the past, police officers would spend about an hour documenting each case, calling parents, waiting for an adult to show up and pick up the student. with the new version, they will get help from two non-profit centers which will serve as drop-off centers for the students. technically the law starts today, but we're told there is a 30-day grace period. >> historically we have not had a lot of time to deal with truant minors. we have kind of -- haefeverythi has fallen on school resource officers to deal with this. now police ca
