smith. and all sorts of visitors to the capitol know mr. smith goes to washington. even non-american visitors who have seen the movie. and they think that's the way the u.s. senate operates and they think that's particularly the way fill busters operate. and so we have to explain to them that it's a movie. and while some phil busters might resemble that most don't and most aren't quite that dramatic. but it's a wonderful film in the sense that they created a set in hollywood that looks just like the senate chamber at that time and they created the atmosphere, i think they used jim preston who was the super attendant of the press gallery and i think he helped to capture that it's not totally accurate. and senator byrd who once gave a speech and he had never seen mr. smith and we got him a video and he went home over the weekend and came back on a monday with a parliamentry procedures critique saying that's nots the way the senate does business. he took it very literally in that sense. but he also appreciated that it was a movie and that hollywood takes some license.

christie smith joins us live from oakland with one of the people forced to leave. the image burned into the minds of so many people. seeing people stuck on the roofs of their home, hoping just for a bit of help. you actually talked to one of these people. >> reporter: he was stranded on a roof top for three long days on day two he knew he wasn't getting help, so he had to dive into the murky water and try to find food for his family. he said it was awful, filled with oil. he finally found some food in a store that was flooded about a quarter of a mile away. along the way he says he saw people stuck on roof tops begging for help. eric butler was stuck there with 17 families. he said he got down finally when the water receded. a rescue crew eventually got the family out of oakland, a place they had never been before. a day after katrina, he said it was partly sunny, and then he looked outside, saw his dire under water, in no time the levees broke, that's when the first floor of his apartment complex was flooded. they had no time to move. here in the bay area he descr

christie smith is live in oakland this morning. what is planned for today? >> reporter: good morning to you. hasani campbell was reported missing behind that shoe store that you see there across the street. this afternoon there is a rally planned. it's being organized by a woman who never met the little boy. there ises a a planned meeting with the district attorney in alameda county. sherry lynn miller owns a print shop out of san leandro. and she searches for missing people. she distributed flyers, t-shirts, organized ground searches for the 5-year-old over this past year. today she says that she and a county supervisor will meet with the d.a. to try to get direction on any new searches or if there's anything new that may lead to an arrest. there will be a rally before that meeting, she says, at 2:00 outside of the d.a.'s office. the foster father and his then fiancee were initially arrested but then released due to lack of evidence. oakland police say the case is still open but there is nothing new. the lead investigator will be discussing the case this mo

christie smith has a possible new location for the trial. >> good morning. defense attorneys are suggesting one possibility is to move the trying trial down to las vegas where a survey of potential jurors shows down there only about 20% of them have heard about the trial compared with about 83% of potential jurors here in alameda county. the defense represents yusef bay iv and codefense antwaan mackey. they say massive news coverage has prevented a fair murder trial here locally. prosecutors are saying that the change of venue issue is really premature and the media coverage angle is being overstated. regardless, the judge who will decide is the same one that decided if the trial of b.a.r.t. officer mehserle moved. >>> with just 71 days to go until election day, polls show california proposition 19, the movement to legalize marijuana is gaining momentum. in july, a sales poll showed voters split on the issue. but a new poll from the survey showed 50% of likely voters in favor of allowing anyone to cultivate a small argument of marijuana for personal use. >>>
