anne makovec joins us from oakland to explain what happened. good morning, anne. >> reporter: good morning. she was just sleeping in her bed when this happened at around 2:15 this morning. a 6-year-old girl by the name of leslie ramirez, she is now here inside the oakland children's hospital being treated. taking ai look at the house where it happened, we counted about 20 bullet holes in the side of the house and in the window. that is the room where the little girl was sleeping. she was hit in the upper arm and the bullet then lodged in her chest according to the family members we spoke with. likely more than one shooter involved according to police. and they believe it was gang- related. >>> we were all sleeping and i heard like a lot of gunshots, and then i woke up and i -- i -- i hard my mom crying and screaming. and then she had my little sister. so i asked like if they were okay. and then i seen my little sister, she was bleeding from her arm. so i called 911. >> reporter: now this happened on the 16 block of seminary avenue just off inte

anne makovec is in orinda and joins us by phone where, ann, main street i understand in the downtown area is closed? >> two blocks of moraga way closed down right in downtown orinda and you can smell gas authorities of downtown. i'm at the bart station up the hill the smell of natural gas is in the air but fire officials have assured us that safety is not an issue. two blocks are affected, between camino pablo and brookwood. it was a 2" gas line broken around 11:30 last night as independent contractors working for the city hit the line with a backhoe. those contractors left their truck there and bolted out of the area apparently which cause some difficulty for pg&e trying to get to the area to fix the leak initially. those contractors were digging as part of a project to expand pedestrian walkways downtown. now, the situation is less dangerous than official first thought. at around midnight they thought it was a 6" pipe that was broken and started evacuating homes a little more than a dozen homes. then they realized that it was only a 2" pipe and that evacuations of homes were unnece

anne makovec is inry . where the city council voted late last night to help the schools. >>> anytime you're talking about closing schools you can expect a loud emotional response. they decided to help save the schools in question. grant and olinda elementary school as well as kennedy high in richmond. the campus has served more than 1600 students combined and when i was out here before the vote yesterday, several people commented that they feel like fighting for their school seems like an annual event. the richmond city council did vote last night to save the schools with a bailout of $1.5 million. the reprieve is through the next school year. the hope is the district will be able to fund its own schools likely asking taxpayers for money in 2011. if not, the same concerns will come up again. the possibility of closing schools and distributing the students to other area schools. >> gangs from 24 school don't this -- gangs from this school don't like gangs from other schools. therefore if you combine the two,

anne makovec is in oakland where police think one man is responsible for two attacks near lake merritt. anne, good morning. >> reporter: good morning. it looks like these attacks started out as robberies and quickly escalated to sexual assault. this is an area regarded as relatively safe here in oakland around lake merritt. but police are warning everybody to keep their guard up. they are not releasing a lot of details about these attacks, so we do know they happened sunday night within a few hours of each other. two women were assaulted in secluded areas on the way home from work. police believe it is the same attacker in both cases. they gave us a loose description. black man, in his 20s, dark clothing, with a weapon. that's describing a lot of people possibly. that's the information we have. women in the area are told to stay in well lighted areas with other people around. >> i wish i could find someplace else to walk. >> everybody especially people by themselves are all walking around with an ipod in their ear. >> reporter: that woman is absolutely right this. certainly puts your d

and our anne makovec is in concord where officers say the man flashed a gun at them. anne? >> reporter: yes. i'm standing at the intersection where this all began about 4 hours, clayton and ashbury, here in concord. you can see ashbury is still closed down. the actual shooting scene was at least a block away. but police have the whole area on lockdown. it's a residential area flanked by several businesses here in concord. police apparently recognized the man at around 2:30 walking down the street. they wanted him on robbery warrants and they told him to stop and he started running away. officers started chasing him down ashbury in their vehicle. he got halfway down ashbury when police say he pulled out a handgun. they can't say, though, whether or not he pointed that handgun at them. the officers got out of the car. he was shot and wounded and taken to john muir hospital with undisclosed injuries. at this point a police spokesman says he doesn't know if this man is even the robbery suspect they were looking for. >>> i think we are trying to get a handle on how somebody walk

anne makovec is in san bruno to explain. good morning. >> reporter: overpressurized lines are apparently a major cause of gas line explosion. and that is the cause that if it's true could place major liability on pg&e. and it is one of several aspects the ntsb has been investigating since last thursday. federal investigators visited a terminal in milpitas to check records and investigate employees. there are no results yet but pg&e says it always operated that line below the maximum pressure allowed. and the "mercury news" is reporting that pg&e has yet to comply with a state order to reduce pressure in the pipeline that exploded by 20% and that pg&e is apparently seeking more "clarity" on the issue before it does so. as the investigation continues, so does the mourning. there was a vigil last night for the mother and daughter killed in the explosion, meantime. people of gathered at saint cecilia catholic church to remember jacqueline grieg and her 13-year-old daughter janessa. the eighth grader was the student body presiden

anne makovec is in san bruno. federal officials are trying to find the cause of the blast. >> reporter: good morning. this investigation is going to take a long time. the good news for a lot of people who liver here, many returned home to their devastated neighborhood over the weekend. for the folks whose homes were destroyed in the fire, they will get an update this morning. pg&e is being ordered to inspect thousands of miles of its natural gas pipe lines so that no other neighborhoods end up like this. they are supposed to put a pry order on inspecting high pressure transmission lines in densely populated neighborhoods. the ntsb has been collecting evidence around the site, pieces of the pipe that exploded on thursday leaving a crater in the ground the ruptured segment in a high consequence area. that means it should get more stringent inspections. pg&e says the line was actually slated to be replaced. now pieces of it have become evidence instead including a 28- foot section ripped out of the ground by the blas

let's go to anne makovec. she's in san jose, where that officer is accused of falsely arresting a teenaged boy. anne, good morning. >> reporter: good morning. three people in hot water this morning. two teenagers for allegedly having underaged sex, and this officer accused of making a false arrest. he is on administrative leave right now. the officer is the father of the teenaged girl. she is 14 and reportedly had consensual sex with her 15-year- old boyfriend so the officer- father allegedly rode his motorcycle to the boy's house last month in full uniform to call him out. that's where the story splits. the boy's parents told the "mercury news" that the cop put handcuffs on the boy and the cop's lawyer says he just lectured him. the boy's parents then decided to report the incident to the san jose police wondering if that was maybe an abuse of power. that led to their son actually being cited for the sex and the cop's daughter was also cited, according to the "mercury news." and i'm here live now with steve c

anne makovec is in vallejo to sort it all out. ann. >> reporter: very confusing story. here's what we know right now. two bodies, the bodies two of women, were found inside this home on upland court here in vallejo overnight. mutilated, according to police. police have not confirmed yet if they are indeed two missing women in their 60s. one of those women lived here and both acquaintances of a man suspected of two other murders. here's that man, efren valdemoro, 38 years old, shot and killed by officers last night after leading them on a high-speed chase in richmond. he was killed in a store and his girlfriend was found dead in a car. valdemoro is also cluesed of beating to death 73-year-old richard sales last week inside this home in hercules. still missing this morning, salmonella's son frederick last seen inside the hercules home. he remains missing and here are the two women missing since last week. the accused murderer who is dead has person ties to them. rita allen and carol smart and they have been missing since last wednesday. valdemoro may have rented a home in

our anne makovec joins us now from walnut creek to explain that pg&e is urging conservation this morning. good morning, anne. >> reporter: good morning. here in downtown walnut creek, it is hanging around the lower 60s. you can see from this live time and temperature behind me. it's going to get up to 102 here in walnut creek. that creates two issues. number one, it's a "spare the air" day and the possibility of power outages so many people are running their air- conditioning it could lead to overload. that's what happened in castro valley this weekend. more than 30,000 pg&e customers lost power for almost three hours on saturday night. pg&e says it was a heat-related equipment failure issue. the mere thought of not having ac can have us sweating. but this may make things easier on the power grid. shut your windows and keep blinds closed in the morning, right now, to keep cool air trapped in the home. try to remember to turn off lights and appliances either right now or before the sun comes up. do your best to use them later in the evening when it's cool. and set that ac at 58 when you'r

anne makovec is in vallejo where explosive materials were found in the same house where two bodies were located. anne, good morning. >>> reporter: good morning. the big question that remains here in vallejo this morning is who killed the two women who were found dead in that home on upland court. a lot of fingers point toward efren valdemoro, who is already thought to have killed at least two other people before he was shot by police on tuesday. plus, he spent time living in the house where the bodies were found and was known to have loud arguments with one of the women, rita allen, who also lived in that same house. she and her friend carol smart were found dead there on tuesday. but police have not ruled out allen's husband, who lived in the house as well, and apparently lived there for several days with the decomposing bodies. one in a bedroom, the other in a shallow grave in the backyard. his name is charles rittenhouse, 72 years old. he told police his wife was missing on sunday, two days after she was last seen. police then followed up at their home and found those bodies. >> when

anne makovec is in richmond. that's where the city council is helping to pay to keep those classrooms in session. anne, good morning. >> reporter: good morning. they made this decision late last night after a very emotional city council meeting. but this reprieve is only for the 2011/2012 school year and will likely see this issue coming up in the future. here are the schools in question: grant and olinda elementary school and kennedy high in richmond. the campuses serve more than 1600 students. the west contra costa school board says its financial problems forced it to vote to close the three schools two years ago. the city of richmond already pledged $1.5 million for this school year. last night's vote dedicated another $1.5 million for next school year. a lot of that money will come from a tax settlement the city is getting from chevron. >> the city and the value of property in the city depend on schools. >> i'm not overly comfortable because we have a lot of other projects and programs this money can be used

>> anne makovec, live for us in san bruno. thank you. >>> a funeral today for a family killed in the explosion. the services are for gregory bullis, his mother lavonne and 17-year-old son william. they will be held this afternoon at first presbyterian church in burlingame. a reception will follow at mills high school in millbrae where william went to school. the bullis family were three of seven people killed two weeks ago when that pipeline exploded. their deaths were confirmed this week. >>> there will also be a funeral today for the 15-year- old novato high school student killed in a suspected drunk driving crash. he was one of three teenagers in the car when it hit a tractor-trailer. that was last friday. police found beer cans and alcohol bottles at this crash scene. the 16-year-old driver now faces manslaughter and felony dui charges. >>> california's budget is now a record-breaking 86 days overdue. but that stalemate could end soon. the governor's office says democrats and republicans have reached the framework of a bud

anne makovec is in san francisco, where there is a call for a sickout at the transit system. good morning, anne. >> reporter: good morning. the problem with the sickout, a we saw in the east bay last monday -- last month that it is just coincidental that drivers are calling in sick at the same time. muni management has seen flyers circulating calling for a four- day sickout to begin next tuesday, september 14. the union denies it is a sanctioned organized event. we do know that drivers do have some beefs with muni management right now, like new restrictions on sick leave and overtime pay, plus, a move to charge drivers 80 bucks a month to park their cars at the bus yards. >> it's just a lot of unfair things that are going on. people don't realize. but we can't really say anything. >> if your pay is taken back, how do you feel? >> reporter: muni says it will be prepared for any sickout that may occur. it also says the famed cable car bell ringing contest at union square will go on as planned even though there have been some rumors that operators may boycott that, as well. that

all right, anne, anne makovec thank you. >>> the clean-up effort is under way in san bruno. the first thing crews are doing is removing the burned-out cars on th streets to clear the way for construction equipment to move in to demolish and removed destroyed homes. chopper 5 also found crews hosing down dirt this morning trying to keep toxic dust from blowing around. county health official want the clean-up to be finished before the rainy season begins to prevent hazardous runoff. the county is sponsoring a health insurance resource event for all the victims of the disaster. >>> oakland police have now released a sketch of a suspect who attacked two women in lake merritt. this is who officers are looking for. the attacks happened late sunday night. both women were robbed and then sexually assaulted. women in the neighborhood are being told to be on alert, stay in well lighted areas and avoid using headphones or talking on cell phones. >>> and a second major water main break has shut down several streets in pleasant hill, officials saying it's part of the same water line that

anne makovec in san bruno, thanks. >>> as anne mentioned, it's an 18-year-old woman who is now the latest victim to be identified. so at this point, four people are confirmed dead. the other victims are jackie grieg and her 13-year-old daughter janessa. they are survived by her husband and her 16-year-old daughter. also killed, 20-year-old jessica morales. she was a student at the academy of art university in san francisco studying to be a fashion judgist. now, it's still not clear exactly how many people are still missing. there is one report that says four. but the city is telling us the number is actually three. investigators say that some of the confusion is because physical evidence is so hard to find. at least 8 people remain hospitalized, one of those in critical condition. >>> people whose homes survived that blast have been allowed to go home. but for those whose homes were red-tagged, the closest they got was on a bus. police escorted them on a tour yesterday and they were not allowed to get off of that bus. all they could do was look through the windows at what's left. >> i saw

anne makovec outside the courthouse in san francisco with the latest for us. anne. >> reporter: governor schwarzenegger versus state workers. this battle has been going on for two years and has big implications for state workers and the state budget. the california supreme court spent almost two hours listening to arguments this morning over whether or not governor schwarzenegger illegally furloughed more than 200,000 state workers. about 40 lawsuits have been filed on the issue and more than $1.2 million spent on state legal bills. the case will likely affect furlough lawsuits in lower courts around the state. the furloughed workers have lost nearly 50 workdays and close to a combined $3 billion in pay since february of 2009. if the union wins, those workers would get back pay with interest for hours they never worked. if governor schwarzenegger prevails, he may have cemented the power of the state's governor over organized labor for years to come. >> the governor's authority to furlough state authorities stems from his implied and inherent powers as the chie

anne makovec is in pittsburg, where investigators believe they may find his body. >> reporter: it is a dirty job for 20 people this morning and it's hot here in pittsburg, allen, not fun work. let's take a live look now from chopper 5 above the keller canyon landfill in pittsburg. two dozen people involved in the search today. police and volunteer search teams hoping for some sign of the missing man. >> very solemn event to be searching here. >> reporter: and there is no telling how long the search could last. 3,000 tons of trash some of which has been compacted is being dug up today. searchers watch the contents as it falls to the ground. they are also planning ongoing through it by hand. >> it is going to be a very extensive search. >> reporter: police have narrowed it down to an area of less than an acre. the area where yesterday's trash was dumped. >> it does take a massive amount of coordination to ensure that they are searching the correct area as well as searching thoroughly. >> reporter: they have honda in on yesterday's load because that's where last week's garbage from the

our anne makovec is in san rafael where the judge's ruling just came down just a short time ago. >> reporter: that's right. and will is another appeal on the way -- there is another appeal on the way. it is not certain he will be executed on wednesday but certainly much more likely after what we saw today, a judge denied the why -- the request to block the death sentence. and he is convicted of murdering a girl in 1982 and the marin county superior court judge blocked the execution set for 12:01 since there is a lawsuit pending challenging the state's lethal injection rule, concerned that the three drug cocktail that paralyzes the inmate and stops the heart could be cruel and unusual punishment and he was given a choice between that and a one drug sedative that would also kill him. he refused to choose. today the judge said brown's lawyers cannot prove he will suffer pain and cannot demonstrate any likelihood that he will legally prevail in an appeal's court. here is what the lawyers say. >> the death penalty is the law. and it is the grounds here under the california adjudication. and whate
