the city of san jose staff will study an aerial track instead of a tunnel through downtown san jose. we're talking about an elevated rail that could soar as high as six stories into the air. the stretch is likely to be between highway 87 and alma street and extend to where highway 87 connects with interstate 280. some people say that's going to be an eyesore but it could really be a money saver as well. because it will run up and down the state, the high speed rail authority has to sign off on the design and has to agree to let san jose consider that option. that decision is likely to come in the next two weeks. the city of san jose voted last night, a day after the city of palo alto asked them to refocus their environmental studies. it may decide next week to sue the agency over those same studies. still a lot of decisions ahead for this project, which has right now a $43 billion price tag. live in san jose, chris sanchez, today in the bay. >> thanks, chris. >>> tens of thousands of schoolchildren across the bay area are giddy with excitement, all because of new school supplies. ele

north first street, a major intersection here in san jose. it's central to one of the redevelopment districts for the city. cisco and samsung had the locations here and the vta has the station and pg&e has a presence here underground and it's not very reassuring. the city of san jose confirms with us that they learned that one of pg&e's pipelines runs near the intersection, one of two within the city limits and the other further north with the border. later this afternoon, the utility will release the risk with the 100 riskiest pipelines throughout the state in response to a gas pipeline explosion with san brown bruno. they notified them of two lines that run west of 880 through the city limits. that city is supposed to meet sometime this week to figure out how to move forward. as for san jose, the gas pipeline located here underground at north first, pg&e is supposed to be upgrading this in 2012. live in san jose, rob redell, today in the bay. >> 680 express lanes are slow. that's what it is south of highway 84. this is the express lane here

theresa garcia's live in san jose with more on this story. theresa? >> this all unfolded last month when the officer found out that the 15-year-old boy had had sex with his 14-year-old stepdaughter. now, the officer is saying through his lawyer that he never pretended to arrest the young boy but rather was invited to use scare tactics or scare straight tactics to keep the boy from heading down the wrong path. even so, the san jose veteran motorcycle cop is now on administrative leave and being investigated by the district attorney's office to see whether he committed a criminal false imprisonment. the boy's parents feel the officer abused his authority. the parents say the officer pulled up to their house in full uniform after their shift ended, berated and warned the boy to stay away from his daughter and handcuffed and told him he could face sexual assault charges. later he unlocked the cuffs telling his parents he just wanted to scare the boy. legal analyst dean johnson calls the officer's actions an unwise move. >> anytime a police officer is pers

a san jose police suppose person told me the driver of the car is 19-year-old jose antonio hernandez. he was treated for minor injuries at the hospital and then booked into the santa clara county jail on several charges, including two counts of vehicular manslaughter. the two passengers in his backseat of the green ford explorer died in this horrific crash. the passenger in the front seat suffered moderate injuries and is at a local hospital. the chp is not commenting yet on whether this was an actual pursuit or chase but police say a chp unit did make contact with the driver of the explorer at st. james and notre dame which is about eight blocks from here. the driver took off and lost control of hills car here at st. james and fifth street slamming into a parked jeep cherokee and then careened forward. >> after colliding with that vehicle, it continued eastbound and struck a utility trailer, a little box trailer travels attached to a pickup truck, i believe a ford pickup truck. with that, with the impact being so great, the trailer continued forward and it actually pushed the pickup

park over the past few months athe san jose city council is recommending a proposed high-speed rail crossing downtown be put aboveground. the council voted 9-2 in favor of the aboveground plan with the stipulation they have some control over the design. the below ground proposal would have cost five times that much. the mayor fears the rail authority could ultimately insist on an elevated station and thinks san jose should put language in now to give the city some leverage. >> we're looking at perhaps putting right of way into the project, in the southern part of san jose. they want that. and so i think we can negotiate for some additional control over what they build in the city. >> in some places the tracks will be 90 feet in the air. it will take between 3 to 5 years to build and is expected to cost a half billion dollars. >> this morning craigslist will break its silence to remove its adult services section. the explanation will come in a very public forum. >> eric, in just a few hours
