theresa garcia's live in san jose with more on this story. theresa? >> this all unfolded last month when the officer found out that the 15-year-old boy had had sex with his 14-year-old stepdaughter. now, the officer is saying through his lawyer that he never pretended to arrest the young boy but rather was invited to use scare tactics or scare straight tactics to keep the boy from heading down the wrong path. even so, the san jose veteran motorcycle cop is now on administrative leave and being investigated by the district attorney's office to see whether he committed a criminal false imprisonment. the boy's parents feel the officer abused his authority. the parents say the officer pulled up to their house in full uniform after their shift ended, berated and warned the boy to stay away from his daughter and handcuffed and told him he could face sexual assault charges. later he unlocked the cuffs telling his parents he just wanted to scare the boy. legal analyst dean johnson calls the officer's actions an unwise move. >> anytime a police officer is pers

park over the past few months athe san jose city council is recommending a proposed high-speed rail crossing downtown be put aboveground. the council voted 9-2 in favor of the aboveground plan with the stipulation they have some control over the design. the below ground proposal would have cost five times that much. the mayor fears the rail authority could ultimately insist on an elevated station and thinks san jose should put language in now to give the city some leverage. >> we're looking at perhaps putting right of way into the project, in the southern part of san jose. they want that. and so i think we can negotiate for some additional control over what they build in the city. >> in some places the tracks will be 90 feet in the air. it will take between 3 to 5 years to build and is expected to cost a half billion dollars. >> this morning craigslist will break its silence to remove its adult services section. the explanation will come in a very public forum. >> eric, in just a few hours
