theresa garcia is live there in san jose with more. theresa? >> well, certainly this single car crash woke up enough people that a san jose dispatcher tells me they were receiving multiple calls of reports that they heard a loud crash, they heard an explosion, saw a fire and eventually when the san jose emergency responders got out here, take a look behind me, this is what they found. you've got an intersection completely shut off right now. it was just after 3 a.m. a white 2001 ford explorer driving south hit a pole, then possibly a tree and became completely ungulfed in fire. this happened at the intersection with o'grady drive. the emergency responders found an 18-year-old male passenger dead in the car. the 18-year-old male driver was taken to the hospital with non-life-threatening injuries. the problem out here is we're getting mixed reports of other passengers involved, perhaps one that may have ran off or cannot be found at this time. that is what police are still working out the details here and will certainly bring that to us. there's

theresa garcia is live at the public utilities commission meeting in san francisco. theresa? >> well, the proposed plan is to require customers to pay any of the costs not recoupable by those utility companies. but this morning a pg&e spokesperson confirmed the utility company will not put the san bruno explosion and fire into this category that would require the cost to be paid by the customers. so this morning here in san francisco the state public utilities commission began its first hearing into a proposal that would require customers to pay all costs of wildfire damages that exceed a utility's insurance coverage. the proposal was introduced last year by the state's three major utility companies, southern california edison, pg&e and the san diego gas and electric company. it was submitted in response to the massive wild fires in san diego county in 2007. the utilities say it needs to be able to recoup costs from consumers because disaster insurance has become more expensive. premiums increased 300% after those 2007 fires. insurance companies are not willing to insure for

theresa garcia joins us live from trace elementary with a proposal to close a loophole. theresa? >> that's right. and yesterday here in san jose a whole group of state lawmakers were meeting at a community gathering yesterday discussing tougher safety laws. some are saying if they were already in place, the community here would have -- wouldn't have experienced such devastating damage. a lone pillar where a building once stood. >> response to the massive fire that des trayed parts of trace elementary in july. they are looking to close a loophole that exempts schools from installing automatic fire sprinklers and alarms in a remodelling project if it's locally funded. they applied for that exception. figures showed this district got such exceptions for 64 school remodels between 2004 and 2008. upset parents of trace students feel the district is playing russian roulette by using this loophole to reduce building costs and only meet the minimum costs for safety. many are saying that the district should just not use it and instead build with the highest safety standards possible. now,
