. >> i'm eric thomas. topping our news, this morning san jose is poised to become the largest city in california to ban disposable plastic bags. not only that, the ordinance being voted on could go even further. terry mcsweeney is live at a safeway with details. terry, i can see eventually the lawyers are going to get involved in this. >> yeah. the lawyers are going to be making a whole lot more than a bag fee on this. we're talking about banning plastic bags and slapping a fee on paper bags up to 25 cents per bag. the whole idea behind this is to get people to use their bags again and again and again. this ordinance would go into effect on january 1st, 2012. it would ban single-use carry out plastic bags and prohibit the free distribution of paper bags. it's had a full environmental review. the san jose city attorney feels very confident this is going to withstand any lawsuits but they are coming. stores could offer paper but they have to be made of 40% recycled material and stores would have to charge at

eric? >> all right, megan. thank you very much. it's 4:37. police have identified the three men killed during a shooting in south san francisco last week. that shooting happened on 8th lane at linden last wednesday. three more people, including at least one minor were shot and injured. the gang intelligence unit is assisting with investigation. the coroner's office identified those killed as 20-year-old hector flores, 18-year-old omar cortez and a 19-year-old. police have stepped up patrols and they say they do believe the shooting was gang-related. a set of strange circumstances found a fire at a marijuana dispensary in san francisco yesterday. police say the north cal urban relief center is licensed but they're not sure if they're licensed to grow the large amount of pot discovered in the back room. the building's electric meter had also been bypassed and the grow lights were on stolen electricity. the fire was quickly put out. no one was hurt. bay area drunk driving arrests are up slightly compared with last year. the california highway pa

i'm eric thomas. we begin in oakland where a fire devours an apartment building on 82nd avenue. there are injuries. some of them are severe. terry mcsweeney is live at the scene with details. terry? >> yeah, three people are in what fire officials are calling critical condition and two others injured after they jumped out the second floor before trying find safety out here. pictures from the scene, again three people in very critical condition. according to firefighters this began 2:00 this morning, and by the time they arrived here, the apartment building, the front of it was fully involved. people in the upstairs in back jumped to safety but they have leg injuries. but three people in a front unit upstairs were trapped by the fire. firefighters got in, searched, found them. we are told that it was a man, a woman, and a little girl. all were taken to a hospital and those are the three in very critical condition. there was also in the building a single mother of four in that house. they had arrived ju
