this is david and julie and's show. let's just say this is a serious book and the fact it has hilarious moments, genuinely laugh out loud moments how he deals with it. it makes it all the more serious. this is a portrait of a man and a hero. this is an uplifting book to read because it describes the genuinely great man. but there was also to be a disturbing book because we don't seem to have many men or women of his character and self discipline on the scene right now. he is a man-made of greater stuff than we seem to have now. from greeter times than we have now. perhaps we can use this book as a yardstick to measure present and future national leaders. if we do, i'm afraid they are going to look pretty puny. our satloff, but with a gift to have had general eisenhower. now i introduce you to too great friends and biographers, david and julie eisenhower. those notices went out around the 27th, 28th of july of this year. at that time, when staff did their research, the owner of record was in fact the bank of new york. the hearing notification went to the property owner. unbeknownst to the department, there was a pending sale. the bank never notified us of this. three days before the directors hearing on february 8, the title changed. staff did not know that but we have subsequently become aware of that and a copy of that deed is in your package. the property owner that was notified 10 days before and an order was issued on the property. what happens in these cases is we have access to the recorders information. we go online to see what they recorded documents are that exist. the problem is, when there is a new deed that is reported, it is not put into the system right away. so the system does not have, in real time, that information because there are things that are beyond our control, namely data entry from the reporters office. as you can see from your records, we did not know -- it did not show up

in the middle of july, july 13, we issued a notice of violation and penalty. that does carry with it a penalty of $250 a day. this board can come upon a pill -- can, upon appeal, reduce that to no less than $100 a day. the 15 day appeal period began on july 28, 2010. during this time and august, ike's was a fairly large story. it was in "the new york times" and the newspaper. they could not get the owners authorization. when they closed in september, there were roughly 40 days when they were operating in noncompliance. at the beginning of october, october 7, we sent a reminder, and administrative reminder. it was that which triggered the jurisdiction request, the filing on the 21st. in regards to whether or not there was proper service on that, all the notifications have been properly received by ike's place. the first notice, beginning with the enforcement notice sent out in april -- that describes the process. you are subject to penalties. you have an appeal right. and we do send certified letters out. you did receive a certified it receipt that ike's place

since then, last july we presented to the port commission two design options. a scheme a, which involves renovation of the existing pier shed. and then scheme b, to demolish and build a new facility. both schemes, a and b, assumed a facility of 80,000 square feet, and port staff assumed that the renovation scheme, scheme a, would be significantly cheaper, but it wasn't. after the port commission hearing in july, port staff presented schemes a and b to various schoirled groups. as a result, a third concept emerged, what we are now calling scheme b-2. the genesis is that both schemes included a minimally sized baggage area. that was a design compromise to reduce the overall construction cost despite it's adverse impact on operational efficiencies. for this minimally-sized baggage area to function adequately, the lay-down process would have to be divided into various cycles, which would increase the amount of time it takes to process the baggage. although the minimally sized baggage area would reduce up-front construction costs, it would result in an increase in o
