chief of san jose. the official announcement is expected to come on tuesday. moore is a scholar, lawyer and 29-year veteran of the san jose police department. but despite those accolades the new chief is facing resistance from community groups throughout the city. "today in the bay's" bob redell is joining us live in san jose with a look at why some people are criticizing this pick. good morning, bob. >> reporter: good morning to you, scott. some advocacy groups argue that san jose police need to change the way it deals with minorities. and they argue that that can't happy sticking with an insider like acting police chief chris moore to run the department. that's why later today there will be groups representing asians, african-americans and latinos protesting over here where i'm at here asking the city council not to confirm moore has the city's police chief when the council meeting this upcoming tuesday. instead, they would like to see oakland's police chief anthony battz get the job. he would be the

he says he is not going to san jose and that san jose decided to go in a different direction. anthony bats has been very popular as chief. bats is one of two finalists for the chief's position with san jose police. late this afternoon, i learned from chief bats himself that the job prospect in san jose is no longer on the table. the upshot of all of this is that bats may not be staying in the long run here in oakland. the chief seems very upset with the way the city is running the police department. >> when i walked in the door, i said about the systems are shattered. not broken but shattered. you have hand helds that don't work properly, have cars that do not run well. they have high miles, the basics that a police officer needs to do his or her job are failing. when i walked in the door i was told that public safety was job one, was number one for the city. >> reporter: city council president larry reed told me a big source of frustration for him and chief bats is the dropping number of officers here. more than 800 when bats came here, now about 655 and still falling. live i

the police department from san jose, san jose pd, as well as the sheriff's department arrived almost simultaneously as far as we can tell. they encountered a man with a weapon, we are told. the reporting party said the man had a weapon of some sort. they are not saying what it was. so the sheriff's office deputies and the police arrived simultaneously. and shots ring out. several shots we're told. the man was shot dead at the scene. right now, police and the sheriff are trying to determine who or what agency, what officers, actually did the firing and hot person they shot and killed was. so very difficult situation right now. we're talking about two different things here, a remote location and a confusing call with very scant details in terms of what the deputies and police officers knew when they arrived. this area is buzzing with police as well as media, helicopters, neighbors up here. it's a very complete area up way up in the east foothills with a, you know, very large commanding view of the santa clara valley so very remote area for this type of situation to go on. >> len, just

nice sunrise around san jose. in the north and east bay valleys, we have temperatures in the low 40s. we do have patchy fog out there this morning, which will lead to temperatures this afternoon running cooler. let's say the rest of the bay area. san jose southward, it is going to be a mild day today. there, you see visibility in miles down to a quarter mile or less in parts of the north and east bay valley, especially for napa and solano county. fog will slow you down around the north and east bay valleys. for the rest of bait, as early as noon, we will see tches climbing xloes to 60 degrees. the wide pattern change we are seeing across the west coast is a large ridge of high pressure starting to build in to our west. you can see here the clouds arching off towards oregon state. it is going to miss us. this is what we sometimes refer to as a mid-winter dry spell. the calendar says january. when you get a ridge of high pressure this strong, it acts like a wall that's going to take all the incoming moisture and ste

san jose lingering showers to the south. 54 degrees. san francisco with late day sunshine and it is the wind direction which is helping to bring in the cooler and dry air to the bay area. as the rain heads out, we will see 30s in the forecast in a few spots as we roll into tonight. you can see the only action we're still seeing right now down around morgan hill and highway 101. still showers approaching gilroy. that's about it as we drive to the north. san francisco over towards the east bay, things have really dried out. you saw the north winds not only helping to shut down the showers but bringing in cooler, drier air aloft. in the wind protected valley, it is possible we could have mid-30s. no worries about rain but maybe patchy fog with the leftover moisture. you can see the lightning and thunder moving out towards fresno and bakersfield, a storm will pump big waves towards the coast. but that's the only effect we'll see from the system. high pressure builds in behind this departing weather system for tomorrow, patchy fog and kind o

this is near downtown san jose. what happened was there was a fire at a building housing a marijuana dispensary. you can see clearly here there's a couple at least one truck company and an engine. the building is down the street a little ways. little later in the show we'll show you exactly what happened. it started around 3:04 this morning. at 3:04 this morning they got a call that there was a fire at this dispensary. first crews arrived on the scene at 3:09. it was knocked down probably around3:35 in the morning. joining me now to talk more about this fire is captain of the san jose fire department. captain ward, i understand there was a station that was shut down that was closer to this fire, but because of budget cuts, a station further away had to respond. >> the station wasn't shut down but they moved the engine out of that station and moved the truck in with no water. the truck was here first at 3:09. the engine 4 got here at 3:10. >> reporter: what was the result? was it later response? could they have put o
