kris sanchez has details. pretty alarming, when you say that people perk up? >> you're not talking about regular inmates doing a misdemeanor bit of time. we're talking about prisoners from the state pen and that means that violent defenders. they're not going to be the first one release but they'll push others out the door. under the governor's plan he wants to send about 37,000 state prison inmates back to the jails in the counties where they're from. the problem is the governor may be sending them on their way without the money to pay for their keep. this is a move that would save the state about $1.4 billion a year. to make room for the more serious defenders, county law enforcement may have to set some of their own offenders free through early parole, house arrest or things lik that. there may not be enough room of money to pay for adequate staffing. >> over 50% of our sentenced population is already doing their time outside of jail. so we have long embraced alternatives to incarceration but there's a point at which we can't make any more room. >> we're fo

kris sanchez is in the news room with what workers are saying about the fight here in the bay area. >> it is about 2,000 miles away, yet a flier is being distributed inviting folks to stand at a rally tomorrow. 2,000 miles away, we are here in silicon valley and folks are feeling the pinch of the union assault. while jennifer thomas' students are on a school break, the teacher is grading papers from home. as she does rs this is on her mind. tens of thousands of people rising up against their governors plan. >> look at all these people. there's 60,000 people there. thank god somebody's saying something. it's really hard to be a teacher right now. >> reporter: she is forced to take furlough days because of the california budget and those are the kinds of working conditions unions would no longer have control over if the governor wins his fight there. >> we are deeply concerned. we don't really view this as an attack on the union, but the middle class. the unions are made up of the middle class in this country. >> reporter: in october, nurses marched outside oakland's children's hospital

nbc bay area's kris sanchez is in the newsroom with more on the potential impact on communities across the state. kris? >> hi, there, tom. governor jerry brown's idea is to send about 37,000 state prisoners back to the counties where they would ultimately end up after they're released. that would put them closer to the services that they would need during their parole, and it would also save the state about $1.4 billion a year. now, according to state and local population statistics, our local jails do have room, many of them, santa clara county has 1,400 beds or so available. alameda county has about 500. but the san mateo county sheriff says he's already 20% overcapacity after losing many beds. but with or without beds, taking on state prisoners is no simple proposition. >> over 50% of our sentenced population is already doing their time outside of jail. so we have long embraced alternatives to incarceration. but there's a point at which we can't make anymore room. >> we're fortunate that we do have some beds, but we also have tremendously high costs in this county compared to the re
