. >> kristen: i'm kristen sze. let's begin with the latest on a campus shooting that left three people dead at san jose state university. terry mcsweeney joins us from the parking garage where it happened. >> reporter: look at the scene you would not know anything happened out here. police are gone, cleanup crews are gone. shooting took place on the fifth floor of the six story garage between ninth and tenth. take a look from an hour or so ago. cleanup was still underway. removing blood from some of the parking spots. san jose state police saying all three people are dead including the gunman. whether the victims were students or not. they are not saying that. but they are saying some things about the shootings. >> it was an ordinary evening at san jose state. we hold classes from early in the morning until quite late at night. there were a their number of faculty employees on campus. this is not at all a drive-by shooting. we have no reason to believe it was gang-related, it was isolated. >> reporter: dozens of st

details coming up. >> kristen: 5:30. thank you for starting your day with us. >> eric: san jose police are looking for a motive behind a triple shooting at san jose state university in a parking garage that left three people dead. terry mcsweeney is live at the campus with the latest. >> reporter: here at south tenth street is where the parking garage is. half the garage is all parking. there are four stories of parking and the ground floor is dedicated to student services offices. the shooting happened on the fifth floor. take a look at the pictures. cleanup is still underway. crime scene cleanup removing blood from one of parking spots in one of garages. san jose police are quoted as saying all three shooting victims are dead. one of them the gunman. they are not saying if any of the victims are students. they are saying that it was not gang-related. that it was an isolated skin. dozens of zuindz were not allowed to get back into their cars. some were upset with the notification system. >> i'm not part of alert system

that there are some things that have been covered up that will come to light. >> kristen: in the civil suit for timothy mitchell's death. they will hear arguments from both sides and decide if the case will go to trial. >> eric: campbell police have located a missing three-year-old girl that they believe was abused by the mother and mother's boyfriend. they found the girl with her mother. the mother jane marin was taken into custody. >> it's an area where we have information she may have had some friends in that area. so they developed some leads that she would possibly going to this particular parking lot. they set up on the parking lot and located them. >> the girl was taken to a hospital and is now with child protective service. the mother's former boyfriend george rodriguez is also wanted for child abuse. they searched for her after getting a lead that the toddler was the victim of severe child abuse. while at the house on the border where rodriguez lives. >> san francisco's public defender has release a surveillance video that he says shows undercover cops breaking the law. they s

i'm kristen sze. >> i'm eric thomas. a southern california woman accused of kidnapping her granddaughter from the east bay could be transferred from jail in los angeles to east bay. we're getting details about how bizarre the plot is to kidnap the grand daughter became. amy hollyfield has more. amy? >> reporter: her acquaintances in southern california say she claimed to be pregnant and even threw herself a baby shower. she then showed up with 4-month-old ramy gallego and the acquaintances became suspicious. she said the baby was hers and the baby was 2 weeks old. the acquaintances didn't believe her and they called the police. they believe ericka gallego snuck in her son's home, her son and his wife's home sometime saturday night. their home in knightsen. grabbed the baby girl, 4-month-old ramy while the parents were asleep. >> came in my house and took my baby girl, because she wasn't mentally there. i don't know. don't know why she did it. >> i will be happy if they lock her away. i have don't have hatred in my heart.

i'm kristen sze. alameda police and fire blame budget cuts for the death of a man who waded out in the bay and drowned, but witnesses say the firefighters and police just stood on the beach for an hour and watched the man succumb to the cold without making a move. abc7's amy hollyfield is live in alameda at crown beach. amy? >> reporter: kristen, police and firefighters say they are going to talk about this today. the bottom line is this iland city doesn't have the ability to rescue people who are in trouble out in the water. the man stood in the water up to his neck for more than an hour. there were several people on crown beach. they were all watching wondering why rescue crews didn't help him. police officers and firefighters also stood by and watched. as the man slowly went under. the coast guard couldn't get him because the spot where he was standing was a little too shallow for the boat to get to. and the coast guard helicopter arrived too late. it had been on another call. officials at the fire
