welcome to "america live," everyone, i'm megyn kelly. today's struggle being felt by millions caught in the aftermath of hurricane irene. at least 40 people have died now in 11 states. 2.5 million people are still without power, and we're getting word that emergency helicopters are airlifting food, water and supplies to towns in vermont that are cut off by flooding at this hour. small communities in new york's cat skill mountains are now seeing some of the worst of irene's aftermath. take a look at this video from the town of fleischmann, new york. look at this. folks left with very little. entire communities have literally been washed out. main bridges and roads have been wiped out as well, and further south in little falls, new jersey, not much better. look at this. hold on. thousands of homes and businesses -- look at this -- underwater and completely destroyed. rescue crews are still looking for people who are trapped in their homes. survivors now trying to figure out their next steps. >> this is crazy. >> yeah. >> i ain't never seen

welcome to "america live," everyone, i'm megyn kelly. eyeing a potential disaster as hurricane irene barrels toward the u.s. in the less than an hour, we will have an update on its strength and path, but north carolina is bracing for the first impact. warnings of power outages that could last for days, flash flooding and strong winds. some 80 million people up and down the eastern seaboard are on high alert, and america's largest city, new york, is right in this thing's path. thousands in coastal areas being told to pack up and go, meteorologist janice dean tracking how hard irene will hit from the fox weather center as she has been now for days. j.d., what do we know? >> reporter: well, we know this is a category two storm, but the takeaway message remains the same as yesterday as a category three storm. it's still going to create a lot of problems up and down the northeast corridor. the storm the right now, again, 105 mile-per-hour sustained winds, but we do have maximum winds of 120 miles per hour within the core of this storm. we're

megyn: kelly's court is back in session. on the docket today, free men nearly 20 years after a heinous crime they now insist they did not commit. damian eccles, jesse and be jason baldwin dubbed the west memphis three back in 1994. they were all convicted of murdering three young cub scout in what prosecutors called a satanic ritual, the details of which are far too horrific to get into here. all three walked out of prison last week after pleading guilty to the crime. so first they pleaded not guilty, they got convicted. now 20 years later they pleaded guilty and were set free. it's all part of a complicated legal maneuver that allows them to maintain their innocence while pleading guilt. dna testing that the men's dna was not present, but does that mean that they are innocent of these crimes? the let's ask our panel. defense attorney and former prosecutor arthur aidala. this case is so disturbing, i truly can't get into the details of what was gone to these -- done to these three little boys, but these guys have been in pri

hey, everybody i'm megyn kelly. as we await the latest advisory on the category 3 hurricane the east coast is preparing for the korz. emergency crews are mobilizing, folks are evacuating from their homes, stores are stocking up and quickly selling out of stormy sessions. the first atlantic hurricane of the season packing a huge punch, hitting the carolinas as a powerful category 3 storm on saturday morning before it barrels forward at this point it's a category one storm. let's check in with janice dean on that and all the latest. >> reporter: this could impact 80 million folks across the east coast in the next several days. i want to show you the east coast impacts. this is with the current track that we received at 11:00 from the national hurricane center. new advisory coming out at 2:00, sometimes it comes out early and you will have it first, i promise. winds at least 100 miles per hour across the coastal carolinas. all up and down the east coast winds in excess of 50 miles per hour. this is not a little storm.

"the wall street journal" now backing up previous reports suggesting that the nation's biggest banks are getting closer to signing off on a multibillion-dollar loan forgiveness plans for american homeowners having difficulty with their mortgages. cheryl casone has the story. >> reporter:th is fascinating story. this is coming from our partners over at "the wall street journal" here is what the report says. bank of america, remember the nation's largest bank is working on a deal behind the scenes with state and federal regulators to get themselves out of a major lawsuit they are facing. actually lawsuits plural. here is what bank of america wants. bank of america wants a deal from the feds from the states, that they will have protection from lawsuits that they are currently facing and also future lawsuits if they forgive some of the loan amounts for troubled borrowers, their own borrowers. these are homeowners that have a loan at bank of america or have a service, loan that is serviced
