terry mcsweeney is live at trace elementary in san jose. that school already has the lowest speed limit, right? >> reporter: that's right it's one of three schools with a speed limit near the school when children are present of 15 miles an hour, not 25 but there is a move to make the law of land throughout the city, not everybody likes that plan. take a look at video, a councilman is sponsoring this plan and a 2008 state law allows speed limits 15 miles an hour within a 1,000 feet of school. 15 miles per hour has been the speed limit for a year here but according to the councilman, a lot of people like it. but there are problems, one is money. in order to do this you are required to have engineering and traffic studies that would cost hundreds of thousands of dollars here in san jose they don't have the money. they have been laying off firefighters and police officers but he says san francisco has found around that requirement and has imposed the law itself. problem number two, some people say there is nothing wrong with 25 mile-an-hour lim

the city of san jose is in a mess. they are projecting deficits as far as the eye can see. 80 million short fall next year. will there be more layoffs? so far firefighters have taken a pay cut to avoid more than they they've had. they've had of you layoffs. the mayor is calling for drastic measures, closing libraries, closing community centers, smaller pensions. possibility of more cuts to the department. we don't know what is going to happen in the future except at 11:00 today when 22 firefighters are officially welcomed back into the department and 29 to follow in the next few months. after that, who knows. terry mcsweeney, "abc 7 news." >>> just hours from now, two of the men convicted of murdering chauncey bailey are expected to be sentenced. a alameda judge is expected to sentence them to life in prison without the possibility of parole. bey the head of the your black muslim bakery, the gunman andre broussard has been sentenced to 25 years in prison after pleading guilty to voluntary manslaughter. that was part of

san jose city councilman wants to change this. he wants to lower the speed limit to 125 miles an hour. it's a move he believes will help save kids lives but not everyone agrees. the proposal will be considered tonight as the council rules open government committee. a year ago san jose reduced the speed limit to 15 miles an hour near trace alimentary, hoover middle and lincoln high school. this takes advantage of that allows local government to lower speed limits around school on two lane roads in residential areas where the speed limit is 30 miles an hour or less. now, supporters of the reduced speed limit say it worked. but critics says enough isn't done to enforce if it were changing all of these signs wouldn't be necessary. now, statistics show that half of people struck by a car going 30 miles an hour survive but 85% struck at 20 miles an hour. advocates for lower the speed limit say that's proof enough for them. a third of all traffic fatalities involve them walking or biking to school. now coming up a little bit later this m
