reporting live, i'm cheryl hurd, nbc bay area news. >> cheryl, thank you. >>> now to the big story in san jose. a police officer charged with child abuse pleaded not guilty to all three counts today. he was charged with having inappropriate sexual contact with two teenage boys in which he met online. the d.a.'s office says the teen's online ad listed the age at 18. however, the officer allegedly knew the boy and his friends were under aged. his attorney says his client vigorously denies all of the allegations. the defendant is out on bail until the next hearing. later this month, he also worked for many years as a campus officer. in fact, that was before his time with the san jose police at san jose's leyland high school. >>> we told you about the deadly gas explosion in menlo park. there's another issue, and this explosion happened on wednesday destroying a condo. pg&e found seven gas leaks in this neighborhood. >> reporter: when an explosion gutted this townhouse wednesday, it reignited fears of becoming victim to a deadly pipeline explosion similar to the one in san bruno last year

live in hayward, cheryl hurd, nbc bay area news. >> cheryl, thank you. a lot of good information tonight. so what's next here? she will face a judge tomorrow in her first court appearance. trying a murder case without a body will be a challenge, but two other local high profile cases were similar. a former district attorney and nbc bay area legal analyst teach clark says the prosecution will try to prove le's disappearance was no accident. >> it's going to be a circumstantial case, and the prosecutor can going to rely on lots of bits and pieces of evidence to create a picture that michelle le died at the hands of another. that's going to be real important. and they're going to have to show motive and opportunity to convince the jury to come back with a murder conviction. >> clark says the prosecutor will not be in a hurry to try this case because there's no statute of limitations on murder. we'll be at the court hearing tomorrow. but our coverage of this case continues online tonight and into the morning. tune in to our morning coverage beginning at 4:30

cheryl hurd is live in san francisco where clinton is spending the night. cheryl? >> reporter: secretary of state clinton left about two hours ago. no doubt on her mind the possible release of two jailed hikers in iran. secretary of state hillary clinton waved at a small crowd of onlookers as she entered boulevard restaurant in san francisco. as diplomacy was taking place inside between australian dignitaries and the u.s., there's a struggle going on in iran for the freedom of uc berkeley grads jailed for espionage. the attorney for the pair says things are moving forward and bail arrangements are being made for their release. >> translator: i have informed the hiker's families and the swiss embassy, which represents their interest, and as soon as the bail is prepared, we will deposit, and god willing, they will be released. >> reporter: a similar scenario took place when sarah shourd was released last year. it was iraq's president who negotiated the release when he was in iran last week. and it was verbalized by iranian president mahmoud ahmadinejad. >> translator

cheryl, what happened? >> reporter: as you can see, things are back to normal, but earlier today, things were chaotic and some reporters were left wondering what happened to their rights? at 5:00, a planned protest by the group no justice, no b.a.r.t. was greeted by b.a.r.t. and san francisco police officers. it was clear from the beginning that police wanted to be in control. >> by the time things got started, a large number of police were here. at no point were the fair gates actually blocked by protesters. people were basically just standing in there and shouting, holding banners, giving out flyers. >> reporter: police put an end to the protest before it got started. by 5:30, b.a.r.t. police decided the protesters created a safety issue. >> police had to intervene and create clear passage. it was announced four to six times that people did not move would be arrested. >> reporter: close to 30 people were detanld, including some reporters covering the protest. some got their press passes taken away. at lea

joining us now from south san francisco, cheryl, what are the details here? >> reporter: well, walgreens is not talking tonight, but the main plaintiff inside this lawsuit filed by the eeoc is. >> i want my job back. >> reporter: that's what she wants, the former walgreen's employee who worked as a cashier for 18 years was fired for allegedly eating chips to avoid a sudden drop in blood sugar. her attorney says she's diabetic. >> she reached for a piece of candy in her pocket, she didn't have one, so she grabbed a $1.39 bag of chips and ate some to avert an emergency. >> reporter: the assistant manager saw what happened. hernandez says she was suspended for three days. after that, she says she went on vacation and when she came back, she was pulled into the office and fired. hernandez says the reason -- >> for grabbing the chips, eating before i pay. >> reporter: hernandez said she did pay the $1.39 before leaving that day. a lawyer for the u.s. equal employment opportunity commission, the federal agency filed the lawsuit against walgreens because it believes
