marla tellez is tracking the details all morning long. she joins us live, she has all of the latest details. >> the shooter has been identified as 24-year-old james holmes. right now the investigation is centering around his apartment in north aurora in colorado not far from the shooting scene where he told police he may have more explosives. we may have a live look, the apartment complex is right there in the center. we just had a closer look at this and i can tell that you fbi agents there are in a cherry picker at a top floor window. we suspect this is the shooter's specific apartment and they are using precaution as they search. in the complex has been evacuated. this is not far from the century 16 theater. you can see the chaos, this gentleman here is walking out with a police officer, clearly very much has quite a bit of blood on his striped shirt. this happened about 11:30 our time, 12:30 mountain time. the gunman opening fire during the start of the batman movie. witnesses tell police he threw at least one canister at the front of

marla tellez joins us live with an update on the investigation. good morning. >> reporter: good morning, laura and jon. this happened about seven hours ago but as you can see behind me, still very much an active scene. we see plenty of investigators and police officers making their way in and out of this home. this is on the 4100 block of hanford street, not far from 880 in union city. again, this happened last night, 10:20 p.m., a home invasion robbery gone very wrong. we understand according to police that three suspects forced their way inside this home, four people were home at the time. at that point some sort of altercation happened. and that's when a 62-year-old woman was shot, her adult son was also hurt by one of the suspects. this morning we cannot tell you the condition of the woman, police not releasing her condition. according to police her adult son is in the hospital with non-life threatening injuries so he is expected to survive. in the end police are telling us this morning that three people got away, they are asking for the publi

i want to check in with marla tellez. she's live at the lexington reservoir near los gatos with more on the first spare the air day of the summer. good morning. >> reporter: good morning. first i wanted to start off showing you the dry hills that surround the lexington reservoir. they are brown, they are dry which is a clear indication we need rain. this is a familiar sight around the bay area. also a familiar sight, that fog bank. we are familiar with the fog in the bay. this is expected to burn off, though, as you heard christina say, expected to reach the 90s, even the triple digits. first thing to think about is high fire danger. it's in effect. secondly, it is the first spare the air day of the summer. the bay area air quality management district issues a spare the air day when air quality is forecast to be unhealthy. meteorologist christina loren tells me the east bay is the only portion of the bay area where extreme unhealthy air. so keep that in mind today. still, all of us are encouraged to stay inside as much as

i'm marla tellez with the latest on the breaking news we're following out of colorado. if you are just joining us, a mass shooting at a movie theater in aurora has killed at least 14 people with as many as 50 others injured. a 24-year-old man is in custody. the police chief says he was heavily armed wearing a gas mask and had a rifle and at least two more weapons. he also alluded to having more explosives at his apartment. we got new video in to the newsroom of the apartment complex. s.w.a.t. teams have it surrounded. it has been evacuated. i've been watching this investigation and have seen one man as you can see here propped on top of an armored vehicle with a pole reaching up to a top floor window, clearly they are searching for more explosives inside his apartment. back at the scene of the shooting. it happened at a century 16 theater at a mall in aurora. actually inside the theater during a midnight showing of the new batman movie. i'll be monitoring this story from the newsroom and also bringing you updates throughout the morning. >> thank you very much. a fluid s

marla tellez is live in palo alto with a look at cal train's new alert system. good morning. >> reporter: jon, good morning. this is only a test. that is the announcement that caltrain riders can expect to hear this week. caltrain gets started with its new realtime and departure system, at least the testing. it's all in an effort to make your trip on the train more predictable. when fully operating it will deliver your arrival and departure information one hour before the train is due to arrive in both visual and audio announcements. the new system ultimately will work with gps technology on caltrain and will transmit information about the train's speed and location to the central control center. from there it will be automatically sent in digital message signs and announcements over the public address system. the information will be available on caltrain's website and passengers, you can sign up to receive a free e-mail or text message. caltrain hopes to have the system in place by the end of the year. coming up in the next hour we're going to speak to the calt

marla tellez is live at san jose with the charges under consideration. good morning. >> reporter: good morning. in about 2 1/2 hours the jury will begin deliberating again. they are considering two counts against 44-year-old william lynch. he is facing one count of felony assault and one count of elder abuse. if found guilty he faces up to four years in prison. this is centered around the beating that he admitted to on the stand. he says he beat up jerry lindner after trying to get the priest to sexually assaulting him and his brother in the mid 1970s. to some extent lynch has won. >> he has exposed father lindner. >> this was a serious assault, there were significant injuries and you can't just overlook that because the message it sends is that it's okay to do certain criminal behaviors but not others. >> reporter: though father lindner initially took the stand the judge ordered the jury to strike that testimony. the the priest is now pleading the fifth and the defense says he created reasonable doubt for the jury. we'll be on standby waiting for the ve

marla tellez is on scene with all of the latest. what's happening out there? >> reporter: jon, good morning. it's a very active scene with 25 police officers still on scene. the call came in according to spd, the scene is a couple blocks behind us on the 300 block of north seventh street. joining me live is sergeant dwyer with the san jose police department. what do we know about the two people shot and killed? >> officers located a house they believed to be involved. they entered to conduct a sweep, make sure everybody was okay and unfortunately they did find two persons suffering from gunshot wounds. one an adult male, one adult female. both pronounced deceased. we don't have suspect information. we're conducting a search of the area to make sure the suspect is gone, make sure everybody is safe and the crime scene unit will process the scene. >> on my way over i noticed police around the perimeter blocks away from here so that should the public be worried at this point? >> again, we don't have specific indications that the suspect is present. if we do have a

marla tellez has been following it for us all morning long. what is the latest? >> the latest is that we're hearing from homeland security secretary janet napolitano. agencies are responding. new information is that the associated press is reporting the youngest victim is a 3-month-old baby. currently being treated at the university of colorado hospital. that hospital alone is taking care of at least 21 victims. all innocent unsuspecting moviegoer who thought they were in for an entertaining night. some witnesses telling police they thought the gun fire and smoke was part of the movie, some sort of special effects. in fact, though, it was the work of the suspect who is in custody that is 24-year-old james holmes. he is talking to police. officials say he has no known criminal history, no length that they know about to terrorism. he is a resident of aurora where the shooting happened. his car is said to have tennessee license plates. he was carrying at least four weapons including a rifle, also wearing a gas mask, presumably to protect himself from the gas caniste

marla tellez joins us with that entire story. good morning. >> good morning. the california state university's 23 campuses, they could lose a collective $250 million soon. this is if voters reject the governor's plan to increase both income and sales taxes, the system must decide whether to raise tuition or cut enrollment. the board will debate the two. here's what the first look like. tuition would increase 5% for in state students, nonresidents 9%. and employees, they would feel it too with a 2.5% cut in pay and benefits. the second option calls for a 1.5% cut in enrollment, that equals about 6,000 students. 750 employees would be let go while pay and benefits for remaining employees would drop by 5%. three campus presidents are set to receive a 9% to 10% pay increase and ironically the board is scheduled to vote on those salaries at the same meeting they debate raising tuition or cutting enrollment. any salary increases according to the board will come from private fund raising and not your tax dollars. the meeting gets under way at 9:00 this morning. >> it

marla tellez is live at the lexington reservoir with how people are being urged to conserve. good morning. >> reporter: jon, good morning. we are in the middle of the lexington reservoir surrounded by plenty of dry brown hills. santa clara county, we found who else, smoky the bear warning everybody that fire danger is high today. so all of us have to do our part to prevent fires. we had a relatively dry spring so our landscape is ripe for high fire danger. the fire warning is coupled with our second spare the air day which means our air quality is deemed unhealthy. temperatures expected to reach the 90s in spots. this means it's a good idea to limit outdoor activity if you can. for some, though, that is hard to do. we spoke to one young man who delivers the newspaper. >> really hard to get used to it. then you get dehydrated and you don't want to work. >> reporter: well, even if you have to work today you are encouraged to drive less. so always a good idea to try carpooling, maybe take public transportation or walk or ride your bike. an astonishing statistic that came out rel

marla tellez joins us with a look at how london is dealing with problem. >> good morning. the question is are the london games adequately protected? up until a few hours ago the answer was not absolute. but britain's government is assuring the world that the city of london, the olympic village, the more than 10,000 athletes there, and the thousands of spectators are and will be safe and secure. london officials announcing just this morning it has deployed 1200 more troops, this is in addition to the 3500 it was forced to roll out last week. the private company it hired coming forward last week saying it did not have the manpower to fill its 10,000-guard quota. this has caused the military and police to step in, in the end, one defense expert says the games may be better off. >> who would you roth ayou rath looked after by. >> the other concern is transportation because there are more than 6,000 buses in london and it would be just too time consuming to check everyone's bag and impossible to put a police officer on every bus. looking at video here, london was hit by a home

. >> and i'm marla tellez in for jon kelley. new this morning, police are still searching for a suspect who fatally stabbed a man. this happened near the corner of east st. john and second street in downtown san jose. bob redell is live with an update on this investigation. good morning. >> reporter: good morning to you. san jose police are trying to i.d. a suspect. they found out about this from several 911 calls from people driving by. this happened around 8:40 last night. and what people reported was a man lying face down on the sidewalk in front of trinity church here. it's the oldest church in san jose. people thought the man might have been hit by a car but they realized he had been stabbed at least once in the chest. they took the man to the hospital where he died. he does not have a wallet on him according to a sergeant we spoke with earlier. so there is no i.d., they don't know who he is but appears in his early 30s. st. james park across the street from this church is a popular place for people who live oyn the streets

i'm marla tellez. >> i'm jon kelley. good morning, everybody. it was a holiday week that should have meant an easy commute, well, it was far from it. people head from san francisco to oakland this thing was not even close to being smooth out there. nbc christy smith is joining us with details on a shooting on the bay bridge that stalled the traffic for eight hours. how are things looking now? >> all lanes of the lower deck of the bay bridge are back open after a mess of the morning commute even those this is a reverse commute direction it had quite an impact. ramps like this one were at a stand still after a crash, a shooting, an investigation, as you said lasted over eight hours. the chp says the driver in this car lost control and slammed into the side rail of the lower deck of the bay bridge. this is around 1:30 morning. officers say they actually spotted the driver speeding. he blew right past them and officers were trying to hard to catch up with that driver but by the time they did, they say the driver had already past the s-curve. officer

i'm marla tellez. >> good morning, everybody. i'm jon kelley. we have breaking news to tell you about out of the east bay. a gravel spill right now affecting southbound mike is here with latest. >>> 880 southbound, like jon said, at broadway. word of a gravel spill earlier this morning, didn't sound like a big deal. it's covering three lanes now. chp says all southbound lanes are stopped at broadway. that means you have an alternate, though, if you're coming off the bay bridge or out of the east shore freeway out of the berkeley area. you can take 580 away and take 90 back down to 880, connecting you back onto the roadway there. there's also the fact that the traffic will be allowed on 580 for big rigs. that's going to change things up a little bit as far as the flow coming off of the maze and it may add to congestion out of oakland. southbound 8 l 80 closed at broadway because of a gravel spill. the sweeper should arrive soon. we'll bring you significant updates as they come in. >> thank you very much. >>> we are following developing news this

. >> i'm marla tellez. we begin with breaking news in the east bay. the verdict is in in the hans reiser trial. the announcement coming just minutes ago in the wrongful death suit brought by his own children. nbc bay area's bob redell is live at the hayward hall of justice with the latest. bob, good morning. >> reporter: good morning to you, marla. this was a unanimous verdict for the jury that was trying to figure out whether hans reiser was liable or not liable in the murder of his wife, nina. they did find him liable and the surprise is how much damages they awarded to his two children who are suing him for the death of their mother. the plaintiff's attorney was asking for $10 million for each child in compensatory damages and $5 million in punitive. well, the jury came back with $25 million for each child plus another $10 million total in damages. so basically you're looking at $30 million for each child for the death of their mother. the jury just announcing this verdict within the past five minutes here at the hayward hall of justice. we spoke w

. >> i'm marla tellez. we begin with developing news in the east bay. a young couple is dead after an early morning fire in pleasant hills. it happened at the briar apartments on donegal court. nbc bay area's bob redell has been at the scene all morning live. bob, the fire department says this fire was survivable. that was the case, huh? >> reporter: yes. good morning to you, marly. the fire department said the two young people who were killed here early this morning could have survived this fire if they had a working smoke detector. a young cup who will had recently moved in with each other, both in their early 30s, died along with one of their pets when their unit caught fire around 3:00 this morning at the briars apartments. the fire department can't tell us the smoke detector did not go off because it needed new batteries or it was nonexistent. based on where the bodies were found, it does appear the couple did try to escape their second-floor bedroom, but they died before gettinging out of that room. the investigator tells us he had a pretty good i
