it is under continued discussion with caltrans at this point. honestly from the department's perspective, we were given this information kind of after the fact, after the building permit was approved, after construction had begun and well underway before we found out this issue. really there is only one of two alternatives right now to the property owner barring the demolition of this building. one is the major encroachment permit which is in front of you. the alternative is to vacate or purchase that portion of the right of way so that it's part of their building, part of their property now, and then they would be made -- then the applicant and the city would be made whole by them paying a fair market value for this piece of land. i'm not sure whether that answers all your

caltran was able to get in there and clear out the roadways. there is snow in the forecast let me show you how things work this afternoon. this is a caltrans camera along interstate 80 at the donner summit. the road is clear, but look at the piles of fresh snow one the sides of the road here. a couple miles away, same story near the the donner lake exit. now even though the 80 looks good at the moment, caltrans is screening trucks for snow chains eastbound at applegate and westbound in truckee. now let's take a look along highway 50 in south lake tahoe. again lots of fresh new snow, but the roads are clear. maybe a little slick here. now, if you're headed to the mountains to go skiing. it's all good news. to the north, squaw valley and alpine meadows are reporting their second snowiest christmas on-record. in the past week squaw has received 70 inches of new snow. 220 inches in total so far this season. northstar has received 54 inches over the past 48 hours. to the south, heavenly also is reporting 54" of new snow just over the weekend. and fi

caltrans says the highway 9 is still blocked. it is down there been a moment at blend harbor. a tree fell down over night and is still blocking the roadway. >> developing news out of campbell this morning where there is a fire. firefighters put out and discovered a body. will tran is there live with the details. >> they found the body at 1:00 this morning when someone around here on keen as drive called the fire department after seeing a small fire at the storage ride around the corner. it is next to the carport. when it came under the fire was not that big so only if it took a few minutes to put out. while putting out the fire they discovered the body. the body did did have some injuries but they did not tell us if it was a man or a one. around 5:45 a.m. the coroner's office remove the person and it is up to them to identify the body.

mark from 9:45 this morning it has receded six feet caltrans is here with cones to reroute traffic safely around the flooded areas this is all due to the king tide. it is expected to make some beaches disappear here it is making the road disappear. this low-lying area does flood routinely with high tides this extreme high tide will be the year's biggest. the king tide happens over the course of today, tomorrow and friday when the sun and moon's gravitational pulls are in alignment. that happens once a month. but that king tide is bigger when they coincide with winter storms. that's what is happening here in some areas that means water levels 10 feet above normal in the bay area today the high tide was at 9:45 this morning 7.1 feet. tomorrow is predicted to be 7.2 feet at 10:30. along with the extreme highs comes extreme lows. this afternoon beach combing should be spectacular.

we have been checking in with caltrans seeing where the major problem spots are right now. sounds like the eastbound lanes of 580, they are doing the usual roadwork approaching greenville to north flynn. three of the lanes are blocked. scheduled until with 11:00 this morning. your bridges though look great. if you are crossing the san mateo bridge, this is the commute direction of westbound 92. as you can see, both directions are nice and light so you're moving at the limit. right now the drive time is about 14 minutes to cross that span. elsewhere let's go to our maps, more overnight roadwork that connector ramp northbound 280 to southbound 101 is shut down towards san francisco as well as the eastbound lane highway 4 right there at railroad avenue just the left lane blocked westbound highway 4 still looks good in the commute direction. the nimitz, we also just checked in. both directions of 880 between the embarcadero exit, fruitvale, have various lanes blocked because of overnight roadwork. the drive though not impacted this time of the morning.

and we anticipate getting an approval from caltrans in early january. the publishing of the final eirs is now slated for february and that should allow us to bring the certification actually into this board on both the federal and the state documents by march 2013. in addition to that, i want to point out that we spent the last month and a half or so negotiating with mta on a transition plan. as you may recall, the plan all along has been for the authority to clear the project environmentally and then turn it over to the mta to finalize design and get it built. and that moment has come and i'm very pleased to report that we have reached agreement. i signed the transition plan document a couple days ago and, so, we are on schedule with that and will be a further action that will take place with an updated memorandum of the agreement between the two agencies which will come to you [speaker not understood] in december and that will memorialize at the policy level what we have already agreed to at the staff level. so, i'm really delighted about that and ver
