a panel of judges from the ninth circuit court of appeals decided debra milky should get a new trial. in a scathing opinion, federal judge alex cosinski, tossed out the conviction saying her confession was illegally obtained adding it probably never occurred. court documents show he didn't record the interrogation and no other officers and no one watching through a two-way mirror and no cameras or microphones to record it. and there is more. saldotnt never asked debra to put the confession in writing and skipped the most basic step of having her sign a miranda waiver. the federal appeals court judges didn't say she's innocent but there is no physical evidence linking her to the crime. the judge found prosecutors failed to disclose what they knew about the detective's history of misconduct, disciplinary action and lying. the judge cited eight cases where confessions, indictments or convictions were tossed out or set aside because saldonte had either lied under oath or violated constitutional rights. in one case, saldonte lead a motorist with a faulty taillight go in exchange for sex an

debra villalon is live now with why officers say they never launched a pursue of that driver. >> reporter: gasia, he's a hit and run driver possibly drunk who caused two deaths. tonight, the victim's families came here to the spot. they brought flowers and candles. their grief is mixed with anger. >> it's not fair. it's not fair. >> reporter: families gathered where their loved ones lives ended. 63-year-old carmen zivala was giving a coworker a ride this morning. both food service workers at san jose's airport. when zivala's vehicle was t boned by a mercedes, the driver got out and ran. >> turn yourself in please. do yourself a good deed, please. for my family's sake. >> reporter: it tears them up. the driver left the people who hit to die. and they're anguished to hear people saw this vehicle speeding and swerving. it sped off through a red light, and the officers chose not to chase. >> they felt at that time, that for safety reasons, the best decision was to not pursue the vehicle. >> reporter: those same officers happened upon the fatal crash a half mile away, two minutes later. >> non

debra villalon is live now with why officers say they never launched a pursue of that driver. >> reporter: gasia, he's a hit and run driver possibly drunk who caused two deaths. tonight, the victim's families came here to the spot. they brought flowers and candles. their grief is mixed with anger. >> it's not fair. it's not fair. >> reporter: families gathered where their loved ones lives ended. 63-year-old carmen zivala was giving a coworker a ride this morning. both food service workers at san jose's airport. when zivala's vehicle was t boned by a mercedes, the driver got out and ran. >> turn yourself in please. do yourself a good deed, please. for my family's sake. >> reporter: it tears them up. the driver left the people who hit to die. and they're anguished to hear people saw this vehicle speeding and swerving. it sped off through a red light, and the officers chose not to chase. >> they felt at that time, that for safety reasons, the best decision was to not pursue the vehicle. >> reporter: those same officers happened upon the fatal crash a half mile away, two minutes later. >> non

debra is live at the crash scene. >> reporter: it happened here on hill crest avenue. there are candles and balloons on the spot where the young man lost his life. lie dell benjamin was a senior and a passenger in a vehicle that ripped into a tree last night. people in the area say it made an horrendousemphasis noise. he lost his life. the crash site has become a place for friends and family to gather and mourn and share memories. lie dell's brother was following in another car and witnessed what happened and jumped out. he was unable to save his brother. >> you just have to be careful. cars kill. cars are weapons. the guns are not our only enemy. you have to be careful and i can't emphasize it enough. one gone and another fighting for his life. >> the speed limit the 45 miles an hour and we're confident they were in excess of that. >> reporter: you don't know if they were racing? >> in, we'll wait until the investigation is over. >> reporter: some witnesses say it looked like they were. all of this is under investigation but these young lives are changed forever. mond
