>> reporter: raj and jessica, this case is under investigation but tonight the sheriffs department says michael montgomery has been released from jail. the sheriffs deputy tells me the computer tells her michael montgomery was released at 9:04 tonight. now, the victim in this case is 24-year-old jonathan denver. the dodgers fan was stabbed to death just a few blocks from the ballpark. investigators say montgomery was wearing a giants hat and that his group and denver's group may have exchanged words inside a bar about the team rivalry. then the groups cross the paths later at third and harrison, where denver was killed. nbc bay area spoke with michael montgomery's mother today. she told us her son was hit with a chair and he was trying to defend himself. the district attorney's office saen the san francisco police department are both asking the public for help in this case. they're looking for witnesses and video evidence. the san francisco police department says they arrested michael montgomery because he made incriminating statements while interviewed by police. but tonight it is now

i'm raj math zblirkz and i'm jessica aguirre. fans were checking into a marriott in oakland when a cabby waiting for a fare was shot and stumbled bleetiding into the lobby. within minutes police arrived searching for the shooter. another stain on oakland's reputation. >> reporter: the ohio state football team and their fans are staying here at the marriott hotel in downtown oakland. many of them are telling me tonight that they heard the gun shots. >> i was up in the pool area. and just relaxing. i hear bap bap bap bap. and my first thought was, where's my buddy mark. >> reporter: his friend, mark hill, was in the lobby of the marriott hotel in downtown oakland taking cover. he also heard the gunfire. >> dove behind a pillar. and advised some other people to do the same thing. >> reporter: around 3:00 this afternoon, someone fired a weapon in the heart of downtown oakland. a cab driver was shot in the leg. >> so we're trying to determine what led up to the shooting. >> reporter: the cab driver suffered a nonlife-threatening injur

i'm raj matthai. >> we begin with breaking news. a cabbie caught by a stray bullet during a shootout in oakland a few hours ago. it happened in front of the marriott city center on broadway. where the football team the ohio state buckeyes are staying ahead of their game with cal tomorrow. one man is in custody and they're searching for another. nbc bay area joins us with the latest. >> reporter: it happened in front of the marriott hotel in downtown oakland. a cab driver in front of the marriott possibly waiting for a passenger, maybe waiting to pick up someone. shots were fired and a stray bullet hit the cabbie. no one else was injured. once the cabbie was hit, the shooter took off. he was detained two blocks away on martin luther king boulevard. oakland police spokesman jonna watson picks up the story from here. >> we have one person detained who may be connected to the shooting and that's largely in part to witnesses who stayed on scene when they heard the shooting. they stayed and worked with the police. >> reporter: he was an o

i'm raj matthai. >> an emotional and compelling day in court today. prosecutors ask the jury to sentence serial killer joseph naso to death. the 79-year-old convicted last month of killing four california women. today the prosecutor showed the court just how vicious his crimes really were. nbc bay i hernandez is live outside the courthouse in san rafael. >> reporter: jessica, the jury will begin deliberating the face of joseph naso tomorrow morning. should he live or be sentenced to death? that after a very dramatic day inside the courtroom as both sides presented their closing arguments. the prosecution says 79-year-old joseph naso is a coldhearted ruthless killer who deserves to die for his crimes. prosecutors told the jury roxene roggasch, tracy tafoya, along with women naso also killed have waited a long time for justice. in a dramatic move, ahana let a two-minute timer run to zero asking jurors to imagine what the victims went through in their final minutes as naso strangled them. >> what i wanted from the two minutes for them to be able to exper
