and its union leaders. let's listen in now as one of the union negotiators talks to the news media. >> as well as the over 900 active and over 50 retired members of 1855 deserve better than what transpired today. the unions from the first day of bargaining may 13 have come to the table honestly, openly and with a full fair and equitable contract that should have been resoeverred on june 30th. unfortunately that was not the case for b.a.r.t. management. they have demonized workers and certainly undeserves of the members of 1555. we were at the table today ready. we were so close to get ago deal. when we came to the table at 4:00 p.m. the district unceremoniously yanked their offer, gave us a last and best final offer. giving us a demonstration that they would no longer be willing to offer. when we questioned them if they understood what last and final offer meant they said yes. it was very disheartening. our members and riders deserve better than this. we're not going to go on strike because the public deser

this is not a union strike. this is a management strike brought on by absolute arrogance and the fact that they thought they can take workers rights away. we were close to closing this deal. we had come together on areas of wages, pension, everything they were asking for. we were this close. and yet, at the last minute, they threw in a management rights clause to take away our rights as workers. everything else was done and slud shud have been done wex stand here today disappointed. this continues as an unfair labor practice strike. make no mistake about it this, is not an chick strike. it's an unfair labor practice strike. we're apalled at the behavior of the district not only with their workers but with the riding public that counts on this system every day to get back and forth to work, school, doctor, where they need to go. our workers take pride in our jobs and our representatives standing behind me took the effort every single day, 33 hours later telling you we did everything we can to get this deal done.

it's the union. we are available to continue to bargain and to discuss items. >> what's the work rules? give us the -- everybody wants to know what the work rules are. >> one of the things that's called beneficial past practice was an essential item for us. what that means is, we want to introduce technology into the workforce, for example, and in that introduction of technology it wasn't used in a prior year, then the workers have the right to say that we don't have to do that. so the table is turned on the worker side. one example is pay stubs. we have one union that -- i'm going to tell -- listen up. we all receive electronically our pay stubs online. but because back in history everyone received their pay stub in an envelope, we now use our four workers time for one union to go out and hand deliver a pay stub to each individual worker and they waste their time doing something that could be done with automation. there are a number of those things that go on at bart and it is time for management to

because they felt unionized workers today, us tomorrow. that was the pattern that was being set. the whole economy prospered out of that because workers moved into the middle class, had more to spend. that spending power created jobs. now it's just the opposite for many people. they say as bart workers or other unionized workers have this, and i don't, why should they have it? they think that their higher bar comes at their penicillin and when just the opposite is very likely true. as bart workers earn less, other workers in the bay area are going to earn even less in similar occupations. >> even so, given that public perception is what it is, do you think it will feed into broader issues by calls for abandoned ac transit strikes, the broader issue of pension reform, and also infrastructure that could affect bart in the future? >> i think that all of this could have an impact in these areas. that is, the anger that was out there. so far it has not gotten traction. particularly with the thought of banning strikes or rearranging collective b

what do the unions have to say to commuters? >> reporter: well, they say that they are sorry they didn't want this to happen, but obviously it did. when we saw these union workers yesterday that had been bargaining so long, more than 24 hours, so long, in fact, they had on day old clothes, it seemed like a good sign. everyone wanted a deal done and then the bottom fell out. here we are this morning, they are on the picket lines again, not a bart train in sight. the second time these workers have walked off the job in a month, even a federal mediator couldn't save the talks. now 400,000 riders are forced into a plan b this morning. the commuters are frustrated at this point and that could be the understatement of the year. they are upset about this. now, we heard from the head of the local seiu union this morning, and the big issue seemed to take them by surprise. they say management tried to impose new work rules to cut costs. a worker can call in sick on the fourth day and get overtime on the fifth day, bart wants to change tha

yesterday, one union leader came out just after 3:00 p.m. here and told us despite concensus if not formal agreement the whole deal fell apart over work rules. bart said that was about things like incorporating new technologies and how pay stubs are distributed but unions reacted angryly and said issues go to the core of worker rights n any case, mediator came out later and said his work here is done. >> there is nothing further we're able to do. again rg -- at this point in time and as a result our mediation process has come to an end. >> when you have a head of presidential appointee head of the he federal mediation service here working 20 hours per day for four days, the parties should have been able to come to an agreement. it's because this employer is entractable and committed to having the workers go out on strike its not management that asked for a strike it's union. we're available to continue to bargain and to discuss items. >> now, unions say they will work through end of the schedule tonight. they will not leave passengers strand
