remember the story of aaron alexis, and they took him to a involvement hospital and the police saw him? the question in any one of these cases, you can go through the 60 plus major shootings there have been by someone who's majorly or mentally ill, when they were brought to the hospital, did someone see them as a threat to themselves or other people? we've heard many people where a parent has to go to the hpital and lie. that is, they have to lie and say, my child tried to kill me or my child threatened to kill me. without that danger, there's no reason the hospital personnel or magistrate will hold them. they'll say, look, he hasn't threatened anybody. i don't see evidence here of harm. you have to let minimum go. and parents, many times, can't even talk to the hospital. another federal law, the hipaa laws will say, doctors can't communicate with parents if the child is over 18 in most states, or in pennsylvania, over 14. >> so you're suggesting we've bent over too much in the name of civil liberties and not enough in the name of care and preserving a safe society? >> that's right. we

but seeing prior behavior here where aaron alexis, getting a police report would have flagged a very different set of conduct for anyone looking at that. so i believe we do have to change that. and if that comes to understanding with law enforcement across the country, i would be shocked having worked with so many police officers that they wouldn't be willing to have a -- have an understanding with the federal government on this, given what's at stake for the country. you know, one of the things that concern me also is i heard the discussion between -- between you and mr. tester was this issue of the uscis lawsuit and in 2011, coming before the committee, i wasn't a member of the committee then but the fact that these -- this suit was sealed and as a result of consultation with justice, you didn't feel because of the sealing of the suit that you could share that information. i understand you have to go to justice for advice on these issues, so i'm not being critical of you on this. but what i would be critical of is why wasn't there -- this seems to me a core issue of oversight that

backing out of the tragic incident at the navy yard with aaron alexis. some of you may follow that. that came up in one of our hearings. that again, that access to state and local law enforcement records would've been helpful in the investigation, and the background investigation for him and it would be a way to shortcut some of these investigations. today, as we've heard we are focusing more broadly on the question of who should have access to information, how much information should be classified, how can we more efficiently and effectively again go through the clearance process. i have appreciated your testimony. i've had a chance to hear from some of you and look forward to some your other tests when. i'm going to focus in on overclassification because i think that's one of the issues here. ultimately, when the going to be able to keep up with the clearance process if we continue to classify so much information. i think we need to get back to kind of the root of the problem and get it done i will ask more questions along the lines that chairman was asking. on overclassification
