bart -- or da? >> reporter: yeah, a bad deal for bart passengers. that's for sure, allen. take a look at this right here. this is part of that tentative agreement and bart management is saying tonight that they made a mistake in this agreement. and right now those bart directors, they are meeting inside trying to figure out a way to fix that so-called contract glitch. union officials are saying you can't go back on a signed agreement. caught in the middle are bart riders. >> i don't want it to go on strike. >> i'm so angry at both sides. >> reporter: it's deja vu for bart riders looking at another potential strike. the dispute over a clause giving workers six weeks of paid family leave. bart management said it should have never been in the tentative agreement. they just discovered it. the union says it's not a glitch. all parties signed it. bart has to follow through. >> our members voted it. it's a done deal. and a contract is a contract. an agreement is an agreement. >> the board is the final party to sign it and we have not signed it so it is not a contract. >> reporter

bart's unions and management. instead now a bit of a hold up. >> i hope they come to some type of resolution because there is a lot of other people suspecting -- suspecting thousands and millions of people a day so it is like i would hope they would be able to come to some type of agreement. >> at issue in the agreement is this clause talking about paid family leave, bart says family law states workers are allowed up to 12 weeks of unpaid family leave. this copy of the contract obtained through sources says eligible employees would receive six weeks of that time paid. but from what we heard from bart's management and the board is this was something that was never agreed to. >> it was a mistake and we need to work together in order to move forward. >> bart says this page may have inadvertently been added to a stack of other tentative agreements. the unions however say this was not a mistake and a signed agreement agreed to by all sides in august. the local president says she is baffled by all this but still expects

bart union leaders disagree. the president says management is now trying to go back on agreements which were part of the deal. a vote on the final contract was set for next thursday. now a news conference is about to get underway. an update for us. >> vote no on the contract. only part of this is true. it is true that there is a paid family leave benefit that somehow managed to be in the contract despite prior agreements that it would not be a part of the contract. it is under investigation how it ended up there, whether it be an error or otherwise. we do not know the cause at this time. we are working to correct this error and hope to be able to radify the contract as scheduled at the november 21st board of directors meeting. again, we do not know how this got there. we are both investigating that and trying to evaluate what the impacts are of this provision in the contract. given that this is an investigation status and we do not have many answers, i likely will not be able to answer many of your questions info

bart's two largest unions ratifi contracts, but bart is now saying that a paid family leave provision in the contract was accidentally left into the final version, and that could cost up to $44 million over four years, allowing workers six weeks paid time off each year, and that would be in addition to sick leave and vacation and other leave. the extra would be on top of a $67 million labor package that was agreed on. this just isn't doable. >> it's basically on our shoulders. it's unfortunate. we cannot allow an error to stand. >> they have a chief negotiator they paid half a million dollars to. they have an assistant general manager that's given this six figure salary to finance. you know, so you gave it to us. it's not something that we prepared and gave to them. they prepared it. they signed it. we signed it. it's an agreement. they say they can't go back and piecemeal parts of their contract to their entire union membership. they say that's just not something that can be done. also, at this point, neither side seems to even agree on the cost of this family leave. we're hearing $2
